Minutes of the Council Meeting
October 11, 1990
The regular Council Meeting of the County of Newell No. 4 was
held in the County Office at Brooks, Alberta on Thursday,
October 11, 1990 commencing at 10:00 a.m.

1. Excused from Meeting
Moved by Councillor Douglass that we excuse Councillor Bulger
from this meeting. Carried.
2. Minutes
Minutes of the September 27, 1990 meeting were presented to
Council. Moved by Councillor Wallace that we adopt these
minutes as amended. Carried.
3. Business from Minutes
5-1 Patricia Water System
No report.
7-4 Speed Limits - By-law 976-89
The Administrator gave a short update on this item.
4-4 Town of Bassano - Ambulance District
The Administrator advised that Bassano cannot attend this meeting
but will be attending the October 25th Council Meeting.
6-1 Intensive Livestock - Minimum Distance Separation
Moved by Councillor Conners that we lift this item from the table.
Carried.
Discussion took place on the resolution prepared for Council
on this matter. Moved by Councillor Nelson that we approve the
resolution as presented and that this be submitted through the
Foothills Little Bow Association and then to the Fall Convention.
Carried.
7-4 Development Permit ~~916
Moved by Councillor Nelson that we lift this item from the tab7.e.
Carried.
A lengthy discussion took place on this item and it was then
moved by Councillor Henderson that we issue an Order of Compliance
to Robert Schmidt advising him that this garage will have to
be moved back to the required set-back as per regulations under
the By-law. Carried.

Moved by Councillor Nelson that the Reeve, M.P.C. Chairman, the
local Councillor and any other required Administrative staff
meet with Mr. Schmidt to explain the situation to him in regard
to this Order of Compliance. Carried.
4. Correspondence
1. Canadian Diabetes Association,
Letter from the local Diabetes Association requesting the County
to declare November 5 - 9, 1990 as Diabetes Month was presented.
Moved by Councillor Conners that we declare November 5 - 9, 1990
as Diabetes Month within the County of Newell. Carried.
2. Scandia Residents - Dog Problem
Letter from residents of the Hamlet of Scandia regarding noise
by confined dogs in the Hamlet was presented. After discussion,
it was moved by Councillor Nelson that we table this item for
further research. Carried.
3. A.A.M.D. & C. - Corporate Pooling for Education
Letter from the A.A.M.D. & C. regarding this item was presented
to Council for information.
4. Town of Brooks - Curb & Gutter - Second Avenue
Letter from the Town of Brooks advising of the estimated cost
of $8,200.00 for the curb & gutter to be installed on Second
Avenue adjacent to the County Office, was presented. Moved by
Councillor Fabian that we approve this expenditure and that it
be paid in one lump sum, not on a frontage basis. Carried.

5. Southeastern Alberta Health Unit - Water Reports
Water reports from the various Hamlets were presented for
information.
6. Southeastern Alberta Health Unit - Rainier Water System
Letter from the Southeastern Alberta Health Unit regarding the
Rainier Water System and the boil order was presented to Council.
After discussion, this item was referred to Councillor Nelson
who will meet with the residents in the Hamlet of Rainier.
7. Southeastern Alberta Health Unit - County Landfill Sites
Letter from the Southeastern Alberta Health Unit concerning the
operation of the County landfill sites was presented. After
a lengthy discussion, it was moved by Councillor Douglass that
we proceed with the requirements as set out by the Health Unit
and regulations for the operation of landfill sites. Carried.
8. Alberta Public Works - Regional Emergency Equipment Grant
Letter and information was presented to Council on this item
and it was referred to the Disaster Services Committee for further
study and report back to Council.
9. Alberta Career Development - P.E.P. Program
Information was presented to Council in regard to this Program
with a recommendation that we make application for one office
clerk. Moved by Councillor Douglass that we approve the request
to submit an application and the possible hiring of an office
clerk at the rate of $7.50 per hour under the P.E.P. Program.
Carried.

5. Cheques for Payment
Moved by Councillor Conners that we approve Cheques ~~3692 - 4045,
in the amount of $837,166.45, for payment. Carried.
6. Committee Reports
Municipal
1. PanCanadian - Application for Set-back - 13-8-19-16-4
Further information was presented on this matter and, after
discussion, it was moved by Councillor Workes that we refuse
this request for set-back as requested. Carried.
2. Canadian Western Natural Gas - Waiver of Set-back
SE 22-19-14-4, NE 15-19-14-4 & NE 4-19-14-4 - After discussion
on this item, it was moved by Councillor Wells that we approve
the set-backs as requested subject to Canadian Western Natural
Gas being responsible for any future move of these lines. Carried.
7. Other Business
1. Policy - Sprinkler Irrigation on County Roads
Moved by Councillor Wallace that we adopt this Policy as presented.
Crried.
2. Rolling Hills Agriculture Society - Water Agreement
Further information was presented to Council in regard to the
possible charges for this water service as set out by the Hamlet
Advisory Committee. After discussion, it was recommended that
the Agriculture Society and the Hamlet Advisory Committee meet
~~ to discuss this matter further and come up with a final proposal
in order that the Water Agreement may be completed between the
County and the Agriculture Society.

3. By-law to Adopt Previous Year's Assessment By-law 1017-90
Moved by Councillor Henderson that By-law 1017-90, being a By-law
to adopt the previous year's assessment, other than the annual
assessments as required, receive first reading. Carried.
Moved by Councillor Douglass that By-law 1017-90 receive second
reading. Carried.
Moved by Councillor Wallace that By-law 1017-90 receive consent
of Council for third and final reading. Carried Unanimously.
Moved by Councillor Conners that By-law 1017-90 receive third
and final reading. Carried.
4. C.R.C. Grants - 1990
A report was given on the 1990 C.R.C. Grants for the County of
Newell recreation areas, being Rolling Hills, Patricia, Bow Slope
and Gem. It was indicated that the Hamlet of Patricia was unable
to use $1,687.00 of their Grant and they requested that it be
transferred to Rolling Hills for their Agriculture Society Multi-
use Arena. The Administrator advised that Alberta Recreation
has no problem with this transfer. After a brief discussion,
it was moved by Councillor Conners that we transfer the sum of
$1,687.00 to the Rolling Hills Agriculture Society for their
Multi-use Arena and that they make application under the Grant
System for these funds. Carried.

5. Mini-bus Report for September
The Mini-bus Report for September was presented to Council for
information.
6. December 3rd - G.S.T. for Farmers
Information regarding this Seminar, being sponsored by the E.I.D.,
was presented to Council. Council indicated that they will try
to attend following the Municipal Committee Meeting on that date.
7. City of North York - G.S.T.
A copy of a resolution submitted to the Federal Government on
the G.S.T. was presented to Council, along with a request for
support to the resolution. After discussion, it was moved by
Councillor Wallace that we support the resolution as submitted
by the City of North York. Carried.
8. Alberta Municipal Affairs - Minister's Council Report
Letter from Alberta Municipal Affairs was presented to Council
on this item for information.
9. T. Musgrove - October 31st Presentations
Letter from Tom Musgrove, M.L.A., advising of presentations to
y~' be made on October 31st for various grants, was presented to
