Council Meeting
October 11, 1984
The regular Council Meeting of the County of Newell No. 4 was
held in the County Office at Brooks, Alberta on Thursday,
October 11, 1984 commencing at 11:30 a.m.

1. Minutes
Minutes of the September 20, 1984 meeting were read to the Council.
Moved by Councillor Wallace that we adopt these minutes as corrected.
Carried.
2. Business from Minutes
9-1 Joe Buck Property - Rolling Hills
A further report was given on this item. Moved by Councillor
Workes that a letter be sent to Mr. Buck indicating that an
extension-for cleaning up the property will be given up to
November 15, 1984 as per his verbal commitment given to
Councillor Wallace. Carried.
9-4 E.I.D. - Texas Gates - By-law 858-84
Moved by Councillor Wallace• that By-law 858-84, being a By-law to
approve the application for 4 Texas Gates to be installed by the
Eastern Irrigation District, receive first reading. Carried
Unanimously.
Moved by Councillor Douglass that By-law 858-84 receive second
reading. Carried Unanimously.
Moved by Councillor Workes that By-law 858-84 receive consent of
Council for third and final reading. Carried Unanimously.

final reading. Carried Unanimously.
Lunch
Council recessed for lunch from 12:00 - 1:30 p.m.
Moved by Councillor Regehr that we recess for the Public Hearing
at 1:30 p.m. and the Organizational Meeting for the Board of
Education. Carried.
Moved by Councillor Hall that we return to the full Council Meeting
at 2:20 p.m. Carried.

3. Correspondence
1. Jubilee Insurance - Bodie Claim
Letter from Jubilee Insurance advising no County responsibility
for this accident was. presented to the Council and Mr. Bodie is
to be advised of this situation.
2. Calder & Co. Adjusters - Gravel Truck Claim
The proposed settlement for this gravel truck was presented to
the Council for consideration. Moved by Councillor Hall that
we accept the cash settlement of $14,000.00 on this truck, less
the deductible of $250.00. Carried.
Moved by Councillor Andrews that the Municipal Committee Chairman
and the P.W. Supervisor. investigate possibilities of purchasing
a used gravel truck to replace this vehicle. Carried.
3. Minister of Municipal Affairs - M & E Assessment
Letter from the Minister of Municipal Affairs in regard to this
matter was presented to Council for information.
4. Alberta Transportation - By-la~~ 48-84
Approval from the Minister of M~~ -~~' e~f^~vc on By-law 848-84
r was presented to Council. Moved by Councillor Andrews that By-law
~~ 848-84 receive third and final reading. Carried.
5. Crerar, Lutes, Shantz & Bell
Letter from Crerar, Lutes, Shantz & Bell concerning Lakeside Packer's
strikers was presented to the Council for information.
6. Alberta Environment - Rainier Water Supply
Letter from Alberta Environment regarding Hamlet of Rainier Water
Supply was presented to Council and they are to be advised that
Council will be reviewing this matter further.
7. Medicine Hat Health Unit - Water Reports
A water report for the Hamlet of Scandia was presented to the
Council - this report being satisfactory.
8. Municipal Affairs - Hamlet Discussion Paper
This item was presented to Council for information. Further
discussion will take place at a later date.

9. A.A.M.D. & C. - Pesticide Container Site
Letter from Alberta Public Works Supply & Services, and a copy
of a letter from the A.A.M.D. & C., concerning insurance on this
site was presented to Council. Moved by Councillor Wallace that
we table this item until the Fall Convention for more information.
Carried.
10. Early Childhood Development
Request from the Early Childhood Development Co-ordinator requesting
the County to declare the week of October 21 - 27, 1984 as Week of
the Pre-School Child was presented to Council. Moved by Councillor
Andrews that we declare this week as the Week of the Pre-School
Child. Carried.

ll. Duchess Grazing Association - Rosemary Landfill Site
Letter from the Duchess Grazing Association concerning the
Rosemary Landfill. Site was presented to Council, discussed and
referred to Councillor Regehr for further study and report back
to Council.
12. Soren Nielsen - Old Landfill Site
Information from Mr. Nielsen in regard to the levelling of this
old site was presented to the Council. After discussion, it was
moved by Councillor Hall that the County carry out the levelling
of this site as soon as possible. Carried.
13. J. Manchur - Scandia Lot
A complaint on unsightly premises in the Hamlet of Scandia was
presented to Council and the matter was referred to the Development
Control Officer for further study and report back to Council.
14. A.A.M.D. & C. - Spring Convention Resolutions
Copies of the Government report on these resolutions were given to
the Council for their information.

in the amount of $756,242.25, for payment. Carried.
5. Treasurer's Report
The Treasurer's Report for September was presented to Council
for information. Moved by Councillor Andrews that we accept
this report. Carried.
6. Planning
1. By-law 855-84 - Proposed Land Use Change
Moved by Councillor Douglass that By-law 855-84 receive second
reading. Carried Unanimously.
Moved by Councillor Scheuerman that By-law 855-84 receive third
and final reading. Carried Unanimously.
2. Millard Subdivision 84 SE 50 -Service Road Cancellation
Moved by Councillor Workes that he be excused from discussion and
voting on this item due to a possible conflict of interest. Carried.
Moved by Councillor Scheuerman that we approve the necessary
advertising to be carried out for the closure of this Service
Road in the above-noted subdivision. Carried.
7. Other
1. Penalty By-law 859-84 - Mobile Home Licence Fees
Moved by Councillor Douglass that By-law 859-84, being a By-law
to impose penalties on Mobile Home Licence Fees, receive first
reading. Carried Unanimously.
Moved by Councillor Workes that By-law 859-84 receive second reading.

2. By-law re: Publishing of Minutes & Information - By-law 860-84
Moved by Councillor Wallace that By-law 860-84, being a By-law
concerning the publishing of minutes and information receive
first reading. Carried Unanimously..
Moved by Councillor Hall that By-law 860-84 receive second reading.
Carried Unanimously.
Moved by Councillor Workes that consent of Council be given for
third and final reading of By-law 860-84. Carried Unanimously.
Moved by Councillor Douglass that By-law 860-84 receive third and
final reading. Carried Unanimously.
3. Cancellation of Mobile Home Licence Fees
Moved by Councillor Wallace that we approve the cancellation of
the following Mobile Home Licence Fees:
Licence ~~111 - $29.13
Licence ~~ 66 - $10.82
Licence ~k 73 - $36.02
Licence ~~ 74 - $ 3.68 Carried.
4. Collection of Outstanding Accounts Receivables
The Administrator presented information to the Council in regard
to this matter and advised that collection procedures will be
taken.
5. Cancellation of Tax - Siehan Holding Ltd.
Information was presented to Council in regard to the taxes
on this property and the building that was destroyed by fire
on August 22, 1984. The Assessor presented information on
this item and it was then moved by Councillor Workes that we
cancel a portion of the taxes on this building in the amount
of $1238.08 on Account ~k4605.16 - Pt. NE 8-19-14-4. Carried.
6. Amendment to Frontages - Hamlet of Scandia
Due to recent subdivisions since the By-law was passed concerning
frontages for the Hamlet of Scandia Sewer System, the following
amendments were recommended: Moved by Councillor Andrews that
we set the frontage as indicated for Plan 8210126 Lot 1 - 70',
Lot 2 - 70', Lot 3 - 110', Lot 4 - 100', Lot 5 - 160'; Plan
8111737 Lot 9 - 150', Lot 10 - 150', Lot 11 - 75', Lot 12 - 75';
and that these footages be added to the frontage By-law and
charged the current tax rate of $1.70 per foot. Carried.
7. Summer Games
A request from Tom Krahn for the County to appoint an Ex-Officio
Director for the Summer Games Bid Committee was presented to
Council. Moved by Councillor Hall that we appoint Councillor
Workes to this Committee. Carried.

8. Reports
1. Development Report
The Development Report for September, 1984 was presented to
Council for their information.

2. Emerson Park Report
Council was advised that the chain link fence has now been
completed at Emerson Park.
There was also a request from Ed Pratt for winter improvements
to the Park for fire pits, material for posts, picnic tables and
toilets. He requested that the sum of $1800.00 be approved from
the Public Reserve Fund for these expenditures. Moved by
Councillor Scheuerman that we approve this expenditure. Carried.
9. Post Agenda Items
1. A.U.M.A. Labour Relations Work Shop
Information on this Work Shop was presented to the Council and
ordered filed.
10. In Camera.
Moved by Councillor Hall that we move into camera. Carried.
Moved by Councillor Hall that we return to the regular Council
Meeting. Carried.
Moved by Councillor Workes that we refer the letter from Kay,
Kay & Riggins to our Association Solicitor for further study
and that the other items presented by the Patricia Hamlet
Committee also be presented to our Association's Solicitor for
further study and comment. Carried.
Moved by Councillor Hall that we report the loss of the 4"
plastic pipe from the Patricia reservoir to the R.C.M.P. for
investigation. Carried.
Moved by Councillor Wallace that we contact the E.T.D. in regard
to the letter received from Small Community Engineering in regard
to the line that was replaced to the E.I.D. property in the Hamlet
of Rolling Hills and obtain their comments on this matter.

Public Hearing
October 11, 1984
The Public Hearing was held in the County Office at Brooks,
Alberta on Thursday, October 11, 1984 to hear the application
for amendment to Land Use By-law as submitted by Mattheis
Engineering Ltd.
Full Council was in attendance.
The Administrator read the application for Land Use Change and
advised that no one had requested to meet with the Council in
regard to this Hearing.
A letter from Alberta Transportation, Medicine Hat Office, was
presented indicating that they have no objections to this
proposed Land Use Change.
There being no further presentations, the meeting adjourned at
1:35 p.m.
