Council Meeting
May 24, 1984
The regular Council Meeting of the County of Newell No. 4 was held
in the County Office at Brooks, Alberta on Thursday, May 24, 1984
commencing at 10:00 a.m.

1. Minutes
' Minutes of the May 10, 1984 meeting were read to the Council. Moved
', by Councillor Regehr that we adopt these minutes as read. Carried.
2. Business from Minutes
7-2 J. Manning - Car Report
i No report.
3-10 Engineering Contracts - Scandia System
The Administrator advised that they are still waiting for the Contract
on this matter.
11-3 H. Rommens - Drain
No report.
6-3 Well Site - LSD 13-34-17-14-4
The Administrator reported on this item and advised that they may
have located the owner of this well.
6-6 Town of Bassano - Landfill Account
No report.

8-6 Road Allowance - By-law 845-84
The Administrator reported on this item and advised that Mr. White
had discussed this matter with him but no further action was taken.
' 9-7 Shepherd House - Patricia
j A report was given on this house and it was indicated that this
'i house has now been sold and will be removed from the lot.
9-7 (4) - Frank Berry - Hook up to Sewer
The Administrator advised that Mr. Berry & Mrs. Gellings have
~~ partially completed the application for water & sewer hook-up but
j were not in agreement with the application fee. After discussion
', on this item, it was moved by Councillor Conners that we waive the
hpok-up fee as set out in the application. Carried.

9-9 Serviceman & Apprentice Wages
The Administrator reported on this item to the Council and advised
that this matter has now been settled.
Correspondence
1. PanCanadian Petroleum - Waiver of Set-back
Application from PanCanadian for waiver of our set-back regulations
to drill a well within approximately 76' from the east boundary of
the road allowance, was presented to Council and more information
was requested on why they want to drill at this location.
2. Chevron Canada Ltd. - Waiver of Set-back
Application from Chevron Canada Ltd. for waiver of our set-back
regulations to locate a road allowance parallel to the east boundary
of our County .road allowance located in 13-28-17-12-4, was presented
to the Council. After discussion, it was moved by Councillor Fabian
that we approve this waiver of set-back. Carried.
3. Provincial Treasury - Part-time Pensions
Information was presented to Council in regard to part-time
administrative staff wishing to remain on the Local Authorities
Pension. After discussion, it was moved by Councillor Hall that
we approve the participation of part-time staff if they so choose
to continue in the Plan. Carried.
4. Town of Bassano - Ambulance
Letter from the Town of Bassano advising that they will be with-
drawing from the Brooks & District Ambulance Service within one
year from the date of their letter, was presented to Council for
their information.
5. G. Desruisseaux - Part Payment on Mobile Home Licence
Application from G. Desruisseaux for partial payments on his mobile
home licence was presented to Council. Moved by Councillor Workes
j that we approve payment of this account in two payments. Carried.
6. B. Schuett - Road Approach
Application from B. Schuett for road approach in SW 19-19-13-4 was
presented to the Council. Moved by Councillor Workes that we approve
this application and that this road approach be installed at County
expense as per Policy. Carried.
7. Francana Oil & Gas - Road Crossing - NNE 32-18-11-4
Application for road crossing at the above-noted location was
presented to Council. Moved by Councillor Fabian that we approve
this application. Carried.
8. Medicine Hat Health Unit - Water Reports
The following water reports were presented to the Council for the
Hamlets of Patricia, Scandia and Rainier. All reports were
satisfactory.
9. Statement of Marks
Statement of marks on the Local Government Accounting Course, taken
by Richard Armstrong, and the Communication Part II Course, taken by
Joanne Manning, were presented to Council for their information.

10. A.A.M.D. & C. - Proposed Police Act Amendments
Letter from the A.A.M.D. & C. requesting input from the County
Council in regard to the proposed amendments to the Provincial
Police Act were presented to Council. After discussion, it
was moved by Councillor Conners that we advise the Association
that this Council strongly opposes the proposed amendments as
set out for the new Police Act as this would cause a great burden
on the County budget. Carried.
11. Alberta Municipal Affairs - Electoral Boundaries
Letter and map setting out the proposed changes to the electoral
divisions within the County of Newell was presented to the Council
and more discussion will take place on this item at the next
Council Meeting.

Public Hearing
Moved by Councillor Wallace that we recess for the Public Hearing
at 1:30 p.m. Carried.
Moved by Councillor Hall that we return to the Council Meeting at
1:35 p.m. Carried.

Planning
1. Motions re: Public Hearing
Moved by Councillor Andrews that we proceed with the necessary
transfer of the Public Reserve at the Rainier School Yard as
advertised at the Public Hearing. Carried
2. M.P.C. Report
Councillor Fabian gave this report.
3. Motions from M.P.C. Meeting
No motions were required.
4. Subdivision Application 84 SE 38 - R. Perinni
Information was presented to Council in regard to this application.
' Moved by Councillor Hall that he be excused from discussion and
voting on this application due to conflict of interest. Carried.

Moved by Councillor Scheuerman that we approve this application
subject to the Alberta Planning Board waiving the following sections
~ of the Subdivision Regulations: Section 20(a), which prohibits
subdivisions for Country Residential use within 8 km of Brooks;
Section 23(b), which requires an Area Structure Plan; and Section 24,
which requires a service road along the highway. Carried.
Moved by Councillor Andrews that the cash in-lieu-of on this
subdivision be set at $3000.00 per acre for the land separated
for Country Residential use. Carried.
5. Service Road - Application 82 SE 33 - Millard
The Administrator advised that this service road has not been
completed and that a letter will be sent to Mr. Millard to complete
the road within 30 days or the County will proceed under the
Servicing Agreement to complete the road.

7. Other Business
1. Bill 218 - Hospital Election Act
Information on this proposed Act was presented to Council for
their information.
2. Form A's
The following Form A's were presented to Council for approval:
Div. 1 - Local Roads Construction - $25,000.00 - Moved by
Councillor Wallace that we approve this Form A. Carried.
Div. 6 - Moved by Councillor Hall that we approve the opening up
of a new road allowance in E of 27-21-18-4 (one mile). Carried.
', Moved by Councillor Hall that we approve the Form A for Local Roads
Construction for $1,000.00. Carried.

!, ', $66,000.00 -Moved by Councillor Workes that we approve these

', 1. Mill Rate By-law 846-84
~~ ', The Administrator advised that. an error had been made in the
i calculation of the Municipal mill rate which read: 7.04 mills
', ! and should have read: 7.31 mills. Moved by Councillor Conners
that By-law 846-84, to amend By-law 844-84, to read: "Municipal
', mill rate of 7.31 instead of 7.04" receive .first reading.
Carried Unanimously.

reading. Carried Unanimously.
Moved by Councillor Andrews that consent of Council be given for
third and final reading of By-law 846-84. Carried Unanimously.

', ~ 2. Ella Beasley Property - Hamlet of Patricia
Information was presented to Council in regard to complaints
j received on an old car located on the Beasley property. Moved
by Councillor Conners that a letter be sent to Mrs. Beasley
', i advising to have this old vehicle~emoved from the property.

3. Dirt - Patricia Water Reservoir
j Discussion took place in regard to this item and it was moved by
Councillor Workes that the County dirt located at the Patricia
reservoir is not for resale or private use and that the area be
posted in this regard. Carried.
4. Old Bow City Store
Information was presented to Council in regard to the condition
of this store. After discussion, it was moved by Councillor
Conners that we advise the owners of this property to have this
building demolished and removed from the site due to its hazardous
;, condition. Carried.
5. Village of Rosemary
~ Request from the Village of Rosemary to purchase 50 yards of

y crushed gravel was presented to the Council. Moved by Councillor
V Regehr that we approve the sale of 50 yards of crushed gravel from
the Steveville Pit to the Village of Rosemary at $2.25 per yard.

6. Sprinkling of Road Allowances by Irrigation Systems

Further discussion took place in regard to this item and the
Administrator was instructed to advertise our Policy in regard
to the sprinkling of County road allowances. Also, that a
letter be sent to Mr. Genovese, at Patricia, in regard to the
sprinkling of County road allowance in that area.
7. Irrigation Sumps
Moved by Councillor Scheuerman that a letter be sent to
Mr. Doral Douglas regarding the location of his irrigation pump
along Secondary Road 873 and a copy of our Policy in regard to
set-back from road allowance. Carried.

Public Hearing
May 24, 1984
The Public Hearing was held in the County Office at Brooks, Alberta
at 1:30 p.m. on May 24, 1984 for the Council to hear any objections
against the exchange with the Rainier Community Club, of Rainier,
that portion of Public Reserve Rl which lies to the west of Public
Reserve R2, for that portion of R2 which lies in LSD 13 in
NW 24-16-16-4.
Reeve Fabian opened the meeting at 1:30 p.m.
As no members of the public were in attendance and no written
submissions were received in regard to this Public Hearing, the
Hearing was adjourned at 1:35 p.m.
