Fabian P. Wallace K. Conners M. Andrews F. Workes R. Hall F. Regher A. Scheuerman M. Douglass D. James 1. Minutes Minutes of the December 8, 1983 meeting were read to the Council. Moved by Councillor Wallace that we adopt these minutes as corrected. Carried. 2. Business from Minutes 3-2 Tax Sale - NE 10-20-13-4 No report on this item. 1 ~-- ~T( 7-12 Crawling Valley - Proposed Park Five members from the Crawling Valley Recreation Committee, three members from the Eastern Irrigation District, M.L.A. Tom Musgrove, and Solicitor Ben Plumer, of Bassano, met with the Council at 10:45 a.m. and presented more information in regard to this proposed Park. They outlined their proposed operating costs and requested Council's further consideration in the application for grant. After the presentation Council discussed this matter in detail and it was moved by Councillor Douglass that the tabled motion of the December 8, 1983 meeting which reads: "That we apply for the grant in order that the Crawling Valley Recreation Committee may proceed with the proposed work with the construction contractors that are on the site at this time. This application is subject to the condition and provisions that the Committee have two County Councillors on the Committee at all times." be lifted from the table. Carried. Vote on the motion - Carried. Lunch Council recessed for lunch from 12:00 - 1:30 p.m. 3. Public Hearing Moved by Councillor Wallace that we recess for the Public Hearing at 1:30 p.m. Carried. Moved by Councillor Hall that we return to the full Council Meeting at 2:00 p.m. Carried. 4. Municipal Planning Commission Report The Municipal Planning Commission Report was submitted to Council and the following By-laws were given first reading concerning proposed Land Use Changes: Page 122 By-law 829-83 -R. Perini - SW 3-19-15-4 Moved by Councillor Conners that By-law 829-83 receive first reading. Carried. By-law 830-83 - H.G. Hein ..,, Moved by Councillor Conners that this By-law receive first reading. Carried. 5. Planning Commission 1. By-law 825-83 Moved by Councillor Hall that By-law 825-83 receive second reading. Carried Unanimously. Moved by Councillor Workes that By-law 825-83 receive third and final reading. Carried Unanimously. By-law 826-83 Moved by Councillor Andrews that By-law 826-83 receive second reading. Carried Unanimously. Moved by Councillor Douglass that By-law 826-83 receive third and final reading. Carried Unanimously. 2. 83 SE 91 - Koch After reviewing this application, it was moved by Councillor Andrews that we waive the 80 acre regulation regarding this subdivision and that the application be approved. Carried. 3. 83 SE 94 - E.I.D. Moved by Councillor Wallace that we approve this application. Carried. 4. 83 SE 90 - Mahadeva Moved by Councillor Scheuerman that we approve this application for the area in the South of the proposed application and that the balance of the area be consolidated back .into the quarter section and also that notation be made in regard to a Water Agreement with the owner of the quarter section and the Eastern Irrigation District. Carried. 5. Kay, Kay & Riggins - McConnell & Lukye Subdivision 81 SE 138 Further information was presented to the Council in regard to this matter. After a lengthy discussion, and due to an intensive review of the registered plan, it was moved by Councillor Hall that we leave the service road as registered at this time. Carried. 6. 83 SE 103 - Schaupmeyer Moved by Councillor Andrews that we approve this application subject to one approach to the two parcels and with the notification regarding the Water Agreement with the E.I.D. Medicine Hat Health Unit The following water reports from the M dicine Hat Health Unit were presented to the Council for info mation: Patricia, Rainier, Scandia, and Rolling Hills - all satis actory. ^` 2. Brooks Rural Area Crime Watch A Thank You letter from the Brooks Rural Area Crime Watch for the signs which were purchased and installed by the County was presented to Council for their information. 3. A.A.M.D. & C. - Spring Convention Information concerning, this Convention was presented to Council and the Administrator was instructed to forward the registration for rooms as soon as possible. 4. Town of Brooks Information was presented to the Council in regard to a 1983 donation from the County to the Town of, Brooks in regard to the operation of the Brooks Nuisance Grounds. After discussion, it was moved by Councillor Workes that we ,donated $7,700.00 to the Town of Brooks for 1983. Carried. Information was presented•to Council in regard to the annual donation which the Council makes to the Cultural Center. After discussion, it was moved by Councillor Andrews that we approve a donation of $3,810.00 for 1983 to the Brooks Cultural Center. Carried. 5. Foothills Little Bow Information was. presented to Council in regard to the Foothills Little Bow Meeting to be held on January 30, 1984 at Swen Erickson's Family Restaurant, in Lethbridge, commencing at 10:00 a.m. 7. Committee Reports Municipal. No report. Board of Education No report. A.S.B. No report. Brooks Hospital & Nursing Home This report was submitted by Councillor Andrews. Bassano Hospital This report was submitted by Councillor Douglass. Medicine Hat Health Unit This report was submitted by Councillor, Andrews. Airport Commission This report was submitted by Councillor Workes. Farm Labour Pool. No report. Disaster Services This report was submitted by Councillor Hall. Library Board No report. Shop Committee No report. 8. Other Business V 1. Development Report v " The Development Report for November was presented to Council for their information. 2. Hardsurface Account A statement on the repairs made to the pavement on Secondary Road 544 was presented to the Council. Moved by Councillor Wallace that we transfer the sum of $15,600.00 from the Hardsurface Account to the General Operating Fund to cover this cost.. Carried. 3. Report on Tax Sale ~e Adz~inistrator gave a report on the Tax Sale held on December 14/f . . 4. By-law 83~-~3 A draft copy of By-law 831-83, being a By-law to prohibit the installation of any further septic fields within the Hamlets of Patricia, Rolling Hills & Scandia, was presented to Council. After review, it was moved by Councillor Wallace that By-law 831-83 receive first reading. Carried Unanimously. Moved by Councillor Conners that By-law 831-83 receive second reading. Carried Unanimously. Moved by Councillor Andrews that By-law 831-83 receive consent of Council for third and final reading. Carried Unanimously. By-law 832-83 ~, A draft copy of By-law 832-83, being a By-law to prohibit the bathing or swimming in any Hamlet Water reservoir located in - the County of Newell, was presented to Council. Carried Unanimously. Moved by Councillor Hall that consent of Council be given for third and final reading of By-law 832-83. Carried Unanimously. Moved by Councillor Andrews that By-law 832-83 receive third and final reading. Carried Unanimously. 6. Cancellation of Tax - Jim Neely Jr. - Sec. 19-21-13-4 Information was presented to the Council in regard to the tax penalty on this property. It was recommended that the penalty in the amount of $31.88 be cancelled. Moved by Councillor Conners that we approve the cancellation of this tax. Carried. 7. Cancellation of Tax - Paul Stauffer Information was presented to the Council in regard to the penalties charged on Account ~~2982. After reviewing this matter,. it was moved by Councillor Andrews that we cancel the penalty on this property in the amount of $100.99. Carried. 8. Cancellation of Tax - Great Basin Petroleum Information was presented to Council in regard to the penalty on Account ~k83508 and 9715.02. After reviewing the information, it was moved by Councillor Douglass that we cancel-the penalties on these two properties in the amount of $698.42. Carried. 9. James By-law 825-83 Proposed Land Use Change - Clive-Schaupmeyer From Urban Fringe to Country Residence No one was in attendence to discuss this application. By-law 826-83 C.E. Glover - Land Use Change - Country Residence to Commercial No objections were presented in regard to this application. By-law 827-83 Proposed Land Use Change - S. Mahadeva From Agricultural to Country Residence Mr. T. Dejong spoke in regard to this application and indicated his concerns in regard to the water rights for the subdivided parcels.
