Council Meeting
December 11, 1980
The regular Council Meeting of the County of Newell No. 4 was held
in .the County Office at Brooks, Alberta on Thursday, December 11, 1980
commencing at 10:20 a.m.

1, ~ Minutes
Minutes of the November 6, 1980 meeting were presented to the
Council. Moved by Councillor Christensen that we adopt these
minutes. Carried.
2. Business from the Minutes
6-10 A. Bradshaw Street
Further discussion took place in regard to this street and the
Administrator was instructed to send a letter to Mrs. Bradshaw
indicating that from the corresp~o~,~dence that we have, it is the
opinion of Council that this is~a private road. Further, if she
~~~~~ does not agree with this opinion, that she advise the County in
writing within 7 days of receipt of this letter.
- 3-12 Rainier Hall Board Tax Rebate
No report.
8-5 Senior Citizens` Club - Rolling Hills Lease
Moved by Councillor Hajash that we advertise the proposed subdivision
of this Public Reserve area and, after having a Public Hearing, if
there are no objections to the advertising that we proceed with the
application for subdivision of this area for sale to the Senior
Citizens' Club of Rolling Hills. Carried.

The Administrator advised that this is a political appointment and
the appointment should be made within the next two or three months.
- 4-4 William Te11 Jr. - Application for Closing & Purchase of Street
Moved by Councillor Hajash that we proceed with the necessary advertisi
for the closing and sale of this street in Cassils as requested. Carri
3. Cprrespondence
P- 1. Alberta Municipal Affairs
Letter from Alberta Municipal Affairs concerning the 1981 Dominion
Census was presented to the Council for their information. Further
information will be presented on this subject at a later date.
2. Alberta Municipal Affairs - Annual Inspection
The Annual Inspection of the County of Newell was presented to the
Council for their information,

in regard to the work done in the past year in order to obtain this goc
report. Carried.

~- 3. Alberta Municipal Affairs
Letter from Alberta Municipal Affairs advising that our County Crest
has now been approved by the Attorney General was presented to the
Council. It was also advised that any person wishing to use this
Crest must First obtain the-permission of County Council to do same.
r 4. Alberta Transportation By-law 694-80
Letter fxom Alberta Transportation advising that By-law 694-80, being
the closing of a street in the Hamlet of Scandia, has received approval
of the Minister of Transportation and can now receive third reading,
was presented to the Council. Moved by Councillor Andrews that By-law
694-$0 receive third and final reading. Carried Unanimously.
5. Local Authority Board ~ Brooks Axinexation
Letter from, the Local Authorities Board advising of the proposed
annexation by the Town of Brooks for a street in the South area of
Sunny .Lea was presented to Council. Moved by Councillor Hajash that
we advise the Local Authorities Board that we have no objections to
this annexation..
6. Younie Enterprises Ltd; - Business T,ie~ence
Applcp.ton fxom Youne Enterprises Ltd. for a business licence on
their property in Ni~T 9-21-14-4 was presented to the Council. Moved
by Councillor Scheuerman that we approve this application subject
to all other regulations being met. Carried.
7. TJnderwood McLellan - Scandia Sewer
The final inspection report on the Scandia Sewer was presented to the
CounclA Moved by Councillor Andrews that we accept this report.

,~. 8. Bid pn Tax Sale Land - Pt. LSD 7 SE 20-21-18-4
A bid on this property was received and after' being reviewed by
the Council it was moved by Councillor Scheuerman that we refuse
this bid as there is no public access to this parcel. Carried.
9. Revelstoke Company Ltdm - Bow 'City Gravel"Pit
Information was presented to the Council in regard to this gravel
pit and a. further study is to be made on this item and report back
to the. Council.
1Q. Ca.lgary Power Ltd.
Letter fro~u Calgary Power Ltd. concerning the proposed construction
of the Nova-Jenner line was presented to Council for review, and the
Administrator was instructed to send a letter to Calgary Power
expressing the Council's concern in regard to the 18' set-back
from the road allowances and obtain a written commitment or advice
from Calgary Power in regard to future moves of this line due to
road widening..
h , A.A.M..De &'C. - Ambulance Service
Letter from th.e A.A.M..An, & C. requesting the County's opinion in
regard to ainbu7_ance service in Alberta was presented to the Council.
The Administrator was instructed to advise him that it is the
County's opinion that the County should operate the ambulance with
a share being changed to the residents of the Gounty plus a substantia_
grant from. the Governments Also, that all transfer cases receive
100% support from the Government.

Information was presented to the Council in regard to the Spring
Convention to be held in Calgary on March 26 & 27. The Administrator
was instructed to make reservations for this Convention.

5, Committee Reports

Moved by Councillor Fabian that we recommend to the Brooks School
District that 10% of the cash in-lieu-of Public Reserve collected
for subdivisions within the Brooks School District contained in
the County of Newell boundaries, be paid over to the Brooks School
District, Carried,

loved by Councillor Wallace that we approve the purchase of a new
fence post pounder and billing be arranged for 1981, Carried.

This report was presented to the Council for their information by

-- Alberta 75 Funds
Reeve Musgrove advised that the Alberta 75 Funds must be cleared
from the ledgers by the end of the year. In this regard, the following
motions were passed to clear outstanding balances:
Patricia - Moved by Councillor Scheuerman that the sum of $1093.30
be transferred to the Patricia Hall Capital Fund, Carried,
Duchess Ceramics Club - ~`?oved by Councillor Scheuerman that the sum
of $251.,53 be transferred to the Duchess Ceramics Club to make final

payments on the craft room and flooring in the Duchess Hall. Carried.
Brooks r Moved by Councillor Hajash that the sum of $4900.00 be
transferred to the Newell Overture Piano Fund for purchase of a
new piano, Carried,

Letter from Algas 'Mineral Enterprises Ltd, advising of their acceptance
and conditions in regard to purchase of additional road allowance in
SE 2-19-14-4 was presented to Council, Moved by Councillor Hajash
that we accept. this agreement, Carried,

The Assessor presented a list of tax cancellations required due to
various situations as set out in his report.

b) Elizabeth. Redelback - Moved by Councillor Hajash that taxes in
the amount of $124.68 in regard to Acct, ~~4380 be cancelled. Carried.
c) Petro Canada Exploration Ltd, - Moved by Councillor Fabian that
pipe & power line tax in the amount of $43.84, Acct. 46328, be
cancelled,
The following tax cancellations were requested due to the Homeowner
Funds: being applied for but not received by penalty date: J.
Sekura, Acct. 44'2497, $10.41; G, Covey, Acct. 411320, $5,20;
M, Zubot, Acct. 411322, $8.04; J. Wiebe, Acct, 411458, $5,69.
Moved by Councillor Wallace that we approve these cancellations.

A report was submitted to th.e Council from the Utility Officer
and the Administrator advised of visits from members of the E.R.C.B.
Board in regard to this Co-op.
~: 4. Represeritative to the. Hussar Seed Cleaning Plant
Councillor Wallace presented a report on this item as received from
the. County of Wheatland. After discussion on the item it was moved
by Councillor Christensen that we appoint Councillor Ceorge as
County representative to this Seed Cleaning Plant. Carried,.
5. Bid on Old Steamer
A bid an the old steamer was received in the amount of $1250.00.
Moved by Councillor Fabian that we accept this bid. Carried.

6. Serviceman for Waterstems
A discussion task place on this subject and Councillor Andrews
advised that-they would have a serviceman for the Eainier system
very shortly..

Moved by Councillor Fabian that By-law 719-80 to amend By-law 358,
receive first reading. Carried Unanimously.
Moved by Councillor Scheuerman that By-law 719-80 receive second
reading, Carried Unanimously.
Moved by Councillor Christensen that third and final reading of
Byelaw 719-$0. Carried Unanimously.

Request. fxom D® Coffey to attend the Utility Officer's Meeting
on January 14, 1980 was presented to the Council. Moved by
Councillor Fabian that we approve this request, Carried,

The Administrator presented reports on the proposed land fill sites
at Bow C%ty and Rosemary and was instructed to advise the P.W.
T~epartment to cozmnence the digging of these two sites,

'~Trm. Rick Broad, Councillor froze the. Town of Bassano, and Brian
Whitson, of the S,.E. Alberta Regional Planning Commission, met
with. the Council to present a report in regard to the proposed
Trans Canada Highway twinning program east of Bassano, In this
regard a County road approach. to .the Trans Canada Highway may
hake to be closed. After discussion on this item, it was moved
by Councillor Christensen that we advise the Town of Bassano
that we. approve this request in principle. Carried,
,,. 2, Ocelot Izidus.tres Ltd.
fir. L,, Wombold, representative of Ocelot Industries., met with the
Council and a letter from their Calgary Office was presented to
Oouncil in regard to the late payment of taxes and the penalty
charged by the.Cpunty on their property, After hearing the
report from Mr~ Wombold sand the lengthy discussion on this item,
it was moved by Councillor ~Tallace that we advise Ocelot Industries
that we are unable to cancel the penalties an these taxes. Carried.
3 ~ Tnillam Oruski
Mr, Oruski met with the Council and presented his case and request
for refund of tax that wa.s charged to him from two years ago. After
hearing Mr, grusk's report and a lengthy discussion on this item,
it was moved by Councillor Christensen that we advise Mr, Oruski
that the Council will uphold its precious. decision and action in
this; regard, Garre.d,

The meeti'zzg was opened for the Public Hearing in .regard to the
proposed amendments to By-law 691.. The proposed amendments are;
Lots 1-$ Block 2 Plan 78113$9 froze Hamlet Residential to Hamlet
Single family 7~strict; Lots 1-4 Block 3,Lots 9-12 Block 2, and
Lots 912 Block 1 all in Plan 7811389 froze Hamlet Residential to
Hamlet Mobile. Home District, Schedule 2 - addition of permitted
and discretionary use regulations and minimum development standards
fox the Hamlet Single Family R-1 District (HMH), After hearing the
discussion on this Public Hearing it was moved by Councillor Andrews
that By-law 721-$Q receive first reading, Carried Unanimously,

Moved by Councillor Scheuerman that we approve Lot 1, only, of this
application, and that cash in-lieu-of be set at $2500.00 per acre,
a Serv-ice Agreement for the service road in the North of this parcel,
and that the oil well site be fenced. Carried.

Moved by Councillor Christensen that we approve this application.
Carried.

Moved by Councillor Hajash that we approve this application subject
to cash in-lieu-of being set at $3000,00 per acre on the total parcel.

Moved by Councillor Hajash that we return this application for a
re-draft of design. Carried.

Moved by Councillor Peltier that we approve this application and
defer the. Public Reserve. Carried,

Moved by Councillor Scheuerman that we approve. this application

Moved by Councillor Hajash that we approve this application subject
to cash. in-lieu-of Public Reserve being set at $5000.00 per acre.

Moved by. Councillor Scheuerman that we approve this application subject
to the parcel being xe~-drawn to eoin.cde with existing parcels to the
west of the proposed subdivision, and that Public Reserve be deferred.

'Moved by Councillor Hajash that we approve this application subject
to a 17" dedication for road widening and cash in-lieu-of Public
Reserve being set at $2500.00 per acre.. Carried.

The following applications were presented to Council for changes to

12. Letter of Compliance
The Development Control Officer presented information to the Council
in regard to a letter of compliance sent to Mr, R. A, Reesor. Moved
by Councillor Wallace that the Development Control Officer try to
contact this person one more time and, if unsuccessful, that we
proceed with. the necessary action in this regard. Carried.
s 13. Bzopks Airport
Reeve Musgrove presented information to the Council in regard to
the Town of Brooks charging a Business Licence at the Brooks
Airport. He advised that a legal opinion is being obtained on
this and a further report will be made as soon as this information
arrives.

Moved by Councillor Hajash that we approve this agreement as presented,

Moved by Councillor Hajash that we proceed with expropriation for
additional road widening on the J. Prins property, in order that
we~znay continue with. the planning of the widening and re-paving of
the Cassils Road, Mowed by Councillor Christensen that we table
this motion until our January Meetings Carried„
