Council Meeting
October 9, 1980
The regular Council Meeting of the County of Newell No. 4 was
held in the County Office at Brooks, Alberta on Thursday,
October 9, 1980 commencing at 10:30 a.m.

1. - Minutes
Minutes of the September 25, 1980 meeting were presented to the
Council. Moved by Councillor Vogel that we adopt these minutes.
Carried.
2. - Business from the Minutes
5-4 Alaska Highway Gas Pipeline - Councillor Janzen reported on
his meeting with Alaska Highway Gas Pipeline and advised that
they would proceed and try to find a new site for our refuse
grounds at Gem in order that they may obtain easement through
this area.

-- 3-5 Village of Rosemary Land Fill Site -The Administrator advised
~ that the E.I.D, has accepted our proposed site for this land fill
and would be drawing up an Agreement for this area subject to
fencing, retaining fence and fire guard. Moved by Councillor
Grosfield that we accept this offer. Carried.
3-9 Lot 16 Block 2 Scandia - No reply.
6-10 A. Bradshaw Street- No reply.
5-3 F. Genovese Road Lease - No reply.
3. Correspondence
1. Bow City Community
Letter from the Bow City Community in regard to a land fill site
in their area was presented to the Council. The Administrator was
instructed to advise them that they are looking for a new site acid
also that a letter be sent to Alberta Environment asking why the
present site was fenced off.
~- 2. Alberta Hail & Crop Insurance - Flood Areas
Letter from Alberta Hail & Crop Insurance regarding flood areas and
a proposed Insurance Program being developed by Alberta Hail & Crop
was presented to the Council and ordered filed.
3. Construction News - Advertising
Letter from Construction News regarding advertising of our Building
Permits within the County was presented to the Council. Moved by
Councillor Fabian that we provide them with copies of our Development
Permits. Carried,

4. B.W. King - Scandia Lot
Letter fzom B,W. King requesting waiver of the 12 month development
clause in the Purchase Agreement of Lots in Scandia was presented
to the Council, Moved by Councillor Christensen that we refuse
this request. Carried.
~- 5. Imperial Oil Ltd.
Application from Imperial Oil Ltd. to relocate its key lock service
in the area of the NE 8-19-14-4 was presented to the Council and
referred to the Development Control Officer for a Development Permit.

Letter from the Eastern Irrigation District regarding relocation
of two canals, one in SW 25 & SE 26-14-13-4 and one in SW 6-20-14-4
was presented to the Council. Moved by Councillor Vogel that we
approve this application subject to the toe of the bank being 17 feet
from the fence line and all necessary drainage being provided off
the road allowance, Carried.
~° 7. Alberta Disaster Services - Rescue Kits
Letter from Alberta Disaster Services regarding Rescue Kits was
presented to the Council for their information,
8. Alberta Disaster Services - Alert Fanout System
Letter from Alberta Disaster Services advising of their test
to be carried out in Alberta for Civil Alert Fanout System was
presented to the Council for their information.
- 9. R.G._ Boyce & Associates Ltd,- Damage Claim
Information was presented to the Council in regard to damage claim
which took place at the Duchess C.P,R. crossing on September 11, 1979.
The Administrator advised that this information has been forwarded to
our Insurance Company.
M- 10. J; Bilder~hein - Development of Race Track
Letter from the Brooks Auto Racers Association and a letter of
consent from Joe Bildershein to build a Auto Race Track North
of the Cassils Road and East of Highway 36 was presented to the
Council and referred to the Development Officer for a Development
Permit.
~- 11. PanCanadian Petroleum Ltd.
Application from PanCanadian Petroleum Ltd. to develop a road
allowance in WNW 21-22-18-4 was presented to the Council. Moved
by Councillor Christensen that we approve this application subject
to the road being built to County standards.
-° 12. Rainier Hall Board
Letter from the Rainier Hall Board regarding taxes on their
property was presented to the Council. Moved by Councillor
Brockelsby that we table this item for further study. Carried,

'The Administrator advised that the Service Road on this subdivision

Moved by Counchor Grosfield that By-law 691 be amended by changing
the Land Use of the following areas: Pt, NE 12-20-15-4 from
Agricultural to Country Residence, Block G Plan 2429 G, M. from
'[.Jrban Fringe to Residential, and that By-law 715-80 receive first
reading.: Carried Unanimously,.

The Administrator advised that the Organizational Meeting for
the County would be held on October 23.
~- 2. Division 5 Fire Area By-law Amendment By-law 716-80
Moved by Councillor Habash that By-law 716-80 to increase the
mill rate of the Brooks Rural, Fire Area from 2 mills to 4 mills
commencing January 1, 1981 receive first reading, Carried Unanimously.
Moved by Councillor Brockelsby that By-law 716-80 receive second
reading.-0 Carried Unanimously,

~ Info~maton:was presented to the Council in regard to the Provincial
Planning Conference to be held on November 3,4 & 5, 19$0,

~. Brocilcs Airport
The Administrator reported on his meeting with. Bob Jenkins and
Gordon Tnlilspn, of tle. Town of Brooks, in regard to the Brooks
Airport,. Zt was agreed by the Council that a Committee be set
up after the Organizational Meeting to meet with the Airport
Commission to dis-cuss the matter of Fire Protection, Land Use,
and Development Permits at the Brooks Airport.. It was also
moved by Councillor Fabian that a letter be sent to the Town of
Brooks in regard to the fees charged for licences at the airport
and a request for a refund of these fees, Carried.
.- 5, Sr, Citizens' Club -- Rolling Hills
Moved by Councillor Vogel that we draw up a lease for the property
that the Senior Citizens' Club is leasing from the County of Newell
in the Hamlet of Rolling Hills.: Carried.

`' 6, R, Perrini - Tree Locations
The Council. a.dyised that Mr. Perrini has located trees closer than
125' from the centre of the rand allowance and the Administrator
was instructed to send Mr, Perran a copy of our By-law in this
regard,
7., Report on Old Cars located within the Count
A report was submitted to the Council from the Development Control
Officer in regard to unsightly Premises within the County and old
cars-, Council instructed that procedures be started far the clean-up
of the area in NW 17-19~-13-4, SE 18-19~-14-4, ~ NW 31-18-14-4.

$. Town of Brooks Sewage Lagoon
The ,A,dmnistrator was instructed to send a letter to the Town of
Brooks expressing the Council's concern in regard to trhe sewer
line crossing underneath the irrigation canal and any possible
breakage of this line and seepage into the canal. A copy of
this letter is to be sent to Alberta Environment.

Road Agreement for Jacobson Stock Farms Ltd. was presented to the
Council„ Moved by Councillor Brockelsby that we approve this
Agreement.Carried..

.-~ 11. Proposed Amendment to Land Use By-law Hamlet of Scandia
A proposed amendment to the Land Use. By-law concerning the Hamlet
of Scari.da, and also buildings mpved into Hamlets, was presented
to the Council... Moved by Councillor Brockelsby that we table
this item until our November Meeting. Carried.
,--- 12., County Water Supply Systems
Moved by Councillor Grosfield that there be a monthly test of the
water quality from all water systems under County jurisdictions.
The results of these tests are to be provided to County Council
and published for the n.farmation of the Public. Carried.
