~ __ __ __ County of Newell No. 4 Council Meeting April 30, 1979 The regular Council Meeting of the County of Newell No. 4 was held in the County Office at Brooks, Alberta on April 30, 1979 commencing at 10:30 a.m. Members Present Reeve Councillors Administrator T. Musgrove A. Vogel V . Fabian L. Brockelsby J. Hajash W. Christensen J. Boehme H. Janzen D. James 141. Minutes Minutes pf the April 17, 1979 meeting were adopted as corrected. 142, Court of Revision Minutes of the Court of Revision meeting of April 17, 1979 were adopted as presented. 143. Business from Minutes 57. Koch Subdivision 79 SE 15 This item was tabled for a further report from Councillor Hajash. ',, 70. Rolling Hills Water & Sewer °~ e, The Administrator advised that he had received a report from __ Associated Engineering Services Ltd. and from Alberta Environment as to the amount of eligible grant for the proposed Water & Sewer System for the Hamlet of Rolling Hills. This file was then ordered filed until a further report is received from the residents of the Hamlet of Rolling Hills. 95. G. Christianson - Road Allowance Lease Councillor Janzen reported further on this item and the application for Road Allowance Lease was ordered filed. - 98. Hamlet Census The Administrator advised that 2 Census have been completed: one for the Hamlet of Rolling Hills and one for the Hamlet of Cassils. The Councillors indicated that the balance of the Hamlet Census would be carried out very shortly. 102. By-election Division 8 Moved by Councillor Janzen that we call a By-election for Division 8. Carried. Moved by Councillor Hajash that a nomination day for the By-election for Division 8 be set for May 16, 1979. Carried. Moved by Councillor Brockelsby that M. Seely be appointed as Returning Officer for this By-election. Carried. Page 34 103. Planning-Commission Application 79 SE 55 - D ck This item was tabled until a report is received from Councillor Boehme Application 79 SE 64 - Sekura Moved by Councillor Hajash that we approve this application subject to an Agricultural Subdivision. Carried, Application 79 SE 67 - Lepp This application was tabled pending a report from Councillor Boehme. 107. Bow Cit Park Councillors Brockelsby and Musgrove reported on their inspection of this proposed Park-Site. After discussion on the. item, the Administrator was to contact Alberta Environment to obtain their proposed plan on ariy development along the Bow River property at Bow City. 125.. Group Life Insurance No report at this meeting. 137. Nuisance By-law 665-79 Moved by Councillor Vogel that By-law 665-79, being a By-law respecting nuisances and unsightly premises, receive first reading. Carried Unanimously. j Moved by Councillor Christensen that By-law 665-79 receive second reading. Carried Unanimously. Moved by Councillor Janzen that By-law 665-79 receive consent of Council for third and final reading.- Carried Unanimously. Moved by Councillor Hajash that By-law 665-79 receive third and final reading. Carried Unanimously. Moved by Councillor Vogel that under direction of By-law 665-79 we direct Mr. J. Buck, of Rolling Hills, to clean up his residential property immediately and that the necessary proceedings be commenced on this matter. Carried. 144. Correspondence 145. Scandia Sewer Account from Underwood McLellan (1977) Ltd, in the amount of $409.52 was presented to the Council. Moved by Councillor Brockelsby that we approve this account for payment. Carried. 146. Y Ocelot Industries Ltd. Application from Ocelot Industries Ltd. for the drilling of an oil well in LSD 9-5-18-13-4 closer than 125' from a road allowance was presented to Council. The Administrator was instructed to forward a copy of our By-law to Ocelot Industries Ltd. in regard to this matter. 147. E.I.D. r Letter from the E.I.D. re: Morrison Culvert & Account was presented to the Council. The Administrator was instructed to obtain the complete file on this matter and report back to Council. gage 35 148. A.A.M.D. & C. Resolutions A copy of the 1979 Spring Convention Resolutions was presented to the Council for their information. 150. J. Chizik ' Information was presented to the Council in regard to the outstanding taxes on the land leased by Mr. Chizik from Marathon Realty Co. Ltd. The Administrator is to advise Marathon that taxes on this property are their responsibility and any dispute in regard to the lease will have to be settled between Mr. Chizik and themselves. 151. E.I.D. Applications from the E.I.D. for Road Use Agreements were presented to Council for the following locations: NE 13-18-13-4, NW 18-19-13-4, SW 7-20-13-4, WZ 31-15-15-4. Moved by Councillor Fabian that we approve these applications. Carried, 152. Calga ~ Power Ltd. Letter from Calgary Power Ltd. re: power line move in Sections 30 & 31-14-13-4 was presented to Council, and referred to Councillor Vogel for further study. 153. Calgary Power Ltd. a Letter from Calgary Power Ltd. advising of the cost of the proposed installation of power to the new Scandia Subdivision was presented to Council and referred to Councillor Brockelsby for further study -°` and a meeting with Calgary Power. 154. Alberta Transportation Letter from Alberta Transportation advising of our 1979 Regular Road Grant in the amount of $326,543.00 was presented to Council for their information. 155. Tax Sale Lot A bid on Lot 17 Block 2 Scandia 4111 E.A. from Otto Wallewein was presented to the Council and referred to Councillor Brockelsby for further study. 156. Lunch Adjourned for lunch 12:30 - 2:00 p.m. 157. Delegation A delegation from Fording Coal Ltd., being Mr. H.G. Rushton and D.L. Gaspe, met with the Council and discussed and answered any questions on their proposed coal exploration program in the Bow City-Kitsim area. Alberta Transportation v Mr. L. Root and P. Walsh, of Alberta Transportation, met with the Council to discuss the Road Work Program for 1979. They outlined the new Program under the Resource Road Program and indicated that possible funds would be available from this Program for the County of Newell. .After a lengthy discussion on this item it was moved `' by Councillor Musgrove that we apply for the hardsurfacing of Secondary Road 5~'4 from Patricia east to our boundary. Carried. '` r Page 36 Further discussion then took place on the proposed Oiling Programs for 1979 and it was moved by Councillor Brockelsby that we prepare plans for the proposed oiling of Secondary Road 539 from Highway 36 to the Bow City Bridge.. Carried, 158. Committee Reports Board of Education The Board of Education minutes and report were presented to the Council by Councillor Janzen. Board of Education Budget - 1979 Moved by Councillor Janzen that we approve the proposed Board of Education Budget for 1979. Carried. Jenny Lind School Moved by Councillor Fabian that we advertise for the disposal of the old Jenny Lind School-and that tenders be reviewed at our second meeting in May. Carried. 159. Other Business 160. Assessor's Salary A review was made of the County Assessor's Salary, M. Harper, and as per Salary Agreement, it was moved by Councillor Fabian that we adjust the present salary of M. Harper from the 1977 grid to the 1979 grid under Grade 61. Carried. 161. By-law 666-79 r`' Moved by Councillor Musgrove that By-law 666-79 to amend By-law 554 as follows; 1. Delete Item 2 of By-law 554 and add "recovered by a frontage ~,..- foot tax on all property in the Hamlet." 2. Delete Items 7 & 8 and add "to be recovered by a frontage tax on all property within the Hamlet." and that this By-law receive first reading. Carried Unanimously. Moved by Councillor Vogel that By-law 666-79 receive second reading. Carried Unanimously. Moved by Councillor Janzen that By-law 666-79 receive consent of Council for third and final reading. Dueck Request from Mr. Jake Dueck to purchase a portion of unused road allowance at Cassils was presented to Council and referred to Councillor Hajash for further study. 163. Fence - 0. Jorgensen Request from 0. Jorgensen for fencing in SE 2-21-17-4 was presented to Council and referred to Councillor Christensen for further study, Page 37 164. Municipal Libra ~' Moved by Councillor Janzen that we set our rate of contribution to the County Municipal Library for 1979 at $1.62 per capita. Carried. w- Moved by Councillor Janzen that a member from the Gem area be appointed to the County Municipal Library Board, Carried. 165. Office Renovations The Administrator advised that work has commenced on the office renovations in the basement of the office building and these should be completed by the middle of May. 166. Bow Slo e Recreation Area The 1979 proposed Budget for the Bow Slope Recreation Board was presented to Council and it was moved by Councillor Brockelsby that we approve this Budget. Carried. 167. Form A's Division 2 - Moved by Councillor Fabian that we approve the Form A's for Secondary Road Construction & Drainage in the amount of $13,000.00. Carried. Division 3 - Moved by Councillor Musgrove that we approve Form A's for Local Road Gravel Only in the amount of $2400.00. Carried. Division 4 - Moved~by Councillor Brockelsby that we approve Form A's for Local Road Construction & Drainage in the amount of $10,000.00, Carried, Division 7 - Moved by Councillor Boehme that we approve Form A's for Local Road Construction & Drainage in the amount of $6000.00 and Local Roads Gravel Only in the amount of $700.00.. Carried. f Division 1 - Moved by Councillor Vogel that we approve Form A's for Hamlet Streets in the amount of $8000.00 from the Hamlet Street Allotment and $(000.00 for Street Construction & Drainage from Division 1 Form A's. Carried„ 168. y, Municipal Administrator's Seminar The Administrator reported on the Municipal Administrator's Seminar to be held in Banff on June 6,7 & 8 and requested attendance at this Seminar. Moved by Councillor Fabian that we approve this request. Carried. 169. Planning Commission Application 78 M I34 - Dahl Moved by Councillor Hajash that we set the cash in-lieu-of on this Subdivision at $752.00.
