Council Meeting
November 4, 1977
The regular Council Meeting of the County of Newell No. 4 was held
in the County Office at Brooks, Alberta on Friday, November 4, 1977
commencing at 10:45 a.m.

'; Mr. Ebel met with the Council to discuss a proposed Mobile Home Park.
After discussing this matter with Mr. Ebel, it was pointed out to him
'; that the present owner of the property would have to make application
to have the Country Residence Caveat withdrawn from this property
', before any further action may be taken on this matter.

', 698. Evergreen Equipment__Ltd. - Tractor Repairs
After discussion on the repair account to the 5010 tractor, it was
moved by Councillor Janzen that we would pay this account in full
on inspection of the billings. Moved by Councillor Hajash that we
amend this motion to read: "parts only". Vote on the amendment - lost.

720. Medicine Hat Health Unit
The matter of the investigation as to ownership of the Medicine Hat
land at the Health Unit Building in Medicine Hat, was discussed and
Council decided to continue their investigation into this matter.

Letter from Disaster Services advising that they had approved an
' expenditure for C.B. Radio Equipment for the motor graders was
presented to Council. Moved by Councillor Fabian that we tender
for 8-40 channel C.B. Radios for the motor graders. Carried.
775® Underwood, McLelland & Associates Scandia Sewer System
Calgary Power
Application from Calgary Power for line extension in NW 4-20-14-4
~' was presented to Council. Moved by Councillor Bartlett that we
approve this application subject to all regulations. Carried.

Application from Calgary Power Ltd, for line extension in SW 8-19-15-4
was presented to Council. Moved by Councillor Bartlett that we
approve this application subject to all regulations. Carried.
Calgary Power
Application from Calgary Power Ltd, for line extension in SW 28-19-14-4
wa.s presented to Council. Moved by Councillor Janzen that we approve
this application subject to all regulations. Carried.
Account from Underwood & McLelland for engineering services on the
proposed Scandia Sewer System was presented to Council. Moved by
Councillor Brockelsby that we approve this account for payment. Carried.
776. I Mattheis Engineering Ltd,
'!; Application from Three Walking Sticks Ranch for the closure and
'; leasing of all road allowances within their ranch area was presented
to the Council. After discussion on this matter, it was moved by
;Councillor Christensen that we refuse this. request. Carried.
777. Bid on Lots 14 & 15 Block 3 Patricia
j A bid on the above-noted Tax Sale lots was presented to Council for
their consideration. After discussion on this matter, it was moved
'; by Councillor Bartlett that we tender these lots for sale and that
they be reviewed at a future Council Meeting. Carried.
778. Robert Preston - Mobile Home Park

Request from Robert Preston for the establishment of a Mobile Home
!Park on his property at Cassils was presented to Council. After
I discussing this matter, the Administrator was instructed to advise
IMr. Preston that this property contains a Country Residence Caveat
i and that this Caveat would have to be lifted before he could develop
a Mobile Home Park on this area.
IBroaks Golf Club
;Letter from Brooks Golf Club requesting Council to consider the
rebating of all or part of their 1977 taxes based on a Recreational
' Grant,. was presented to Council. After discussion on this matter,
it was moved by Councillor Brockelsby that we refuse their request
I, for a rebate of taxes on the Golf Club and advise that possibly the
',Club should look at the possibilities of having this area annexed
~'iinto the Town of Brooks. Carried.

780. Eastern Irrigation District - Hamlet Water Accounts
Letter from the Eastern Irrigation District advising of the various
Hamlet Water Accounts was presented to the Council. After discussion
on this matter, it was moved by Councillor Janzen that we retain the
surface irrigation by ditches in all the Hamlets of Patricia, Rainier,
Rolling Hills & Scandia. Carried.

781. ~ R, Dixon - Rosemary
', A plan of development was presented to Council showing the various
buildings and septic fields that Mr. Dixon proposes to establish on
his property at Rosemary, located in SE 25-20-16-4. Moved by
{ Councillor Boehme that we accept this plan subject to any future
move of the septic field to be borne by Mr. Dixon. Carried.

Councillor Janzen reported on the minutes of this meeting and it
~: was moved by Councillor Janzen that we accept this report. Carried.
797, Road Use Agreement Forms
'; Applications from the E.I.D. for Road Use Agreement Forms in the
NW 19-21-15-4 and NW 5-22-16-4 were presented to Council. Moved
by Councillor Brockelsby that we approve these applications and
advise the E.I.D, of the omission of the flat area over the

j The Administrator advised that the necessary advertising had been
~ 1 carried out for the cancellation of Public Reserve on Block R and
'. since there were no written submissions to be heard by Council, he
was instructed to proceed further on the cancellation of the Public
Reserve on this Block R.

799. Spicer Salvage Yard
'. The Administrator advised that complaints have been received from
' the public concerning the condition of this salvage yard and he
j was advised to refer this matter to our Solicitor, and our County
!, By-law and have Mr. Spicer remedy this unsightly condition of the
salvage yard.

The Administrator advised that the purchaser of Lot 6 has not
fulfilled his agreement on this lot and that some action should be
'taken by Council. Moved by Councillor Brockelsby that we cancel
~ the option to purchase on this lot and that this lot be advertised
'for sale under the same conditions as the previous tenders. Carried.
Hamlet of Patricia Land Purchase
`;Further to discussion and correspondence between the County and the
Eastern Irrigation District for the County to purchase certain lands
north of Block R at Patricia, it was moved by Councillor Musgrove
;that we approve the purchase of this land from the E.I.D. Carried.
Closure of Road Allowance Application
Application from P. Barg for the closing and leasing of Road Allowance
lying to the west of his property in SW 13-19-14-4 was presented to
Council. After discussion on this matter, it was moved by Councillor
Hajash that we refuse this request„ Carried.
Moved by Councillor Fabian that Motion 651 be lifted from the table.
Carried.
After further discussion on this matter, it was moved by Councillor
Fabian that we include North of 32 & 33-17-13-4 from the Old ~~l
Highway to the Rolling Hills Highway in the 1978 Road Allotments for
Division 2. Vote on the motion - lost.
Road Allotments
Moved by Councillor Hajash that the road allowance lying east of the
south east of 7-19-14-4, one half mile, be included in the 1978 Road
,Allotment for Division 5, with. approval to build this road this year
and that the cost be deducted from his 1978 allotment; this approval
being given subject to a signed contract for construction to be
approved by Council prior to any construction taking place. Carried,~'~y
