Hoffman All members were in attendance at this meeting. Minutes 1) Council Minutes -January 07, 1999 Minutes of the January 07,1999 meeting were presented. Moved by Councillor Berg that we adopt these minutes as circulated. Carried. 2) Minutes of January 07, 1999 Public Hearings Minutes of the January 07, 1999 Public Hearings were presented. Moved by Councillor Stobbs that we adopt these minutes as circulated. Carried. Call for Post Agenda Items The Reeve called for post agenda items. January 2I, I999 Page I 1 4. AdoQtion of Agenda Moved by Councillor Fabian that we adopt the agenda as amended. Carried. 5. Business from Minutes 9-2 Street Signs - Hamlet of Scandia This item will be brought forward at a February meeting. 11-ASB-1 Mowing Policy This item will be brought back at a future meeting. 10-5 Brooks Landfill Agreement This item was not lifted from the table. 7-2 Water S, stY_ ems This item will be brought to the February 25`h, 1999 meeting. 9 Mun 1 Scott & Leza Sewell -Closure and Sale of Road Within S '/Z of 23-20-13-W4 -Road Plan 3233 BM This item will be brought to a February meeting. ' , s 12-1 Chamber of Commerce This item will be put on the agenda for the next Town of Brooks /County of Newell joint meeting. 7-4 Canadian Pacific Railway -Purchase of Bassano Subdivision County Administrator, M. Bowen, gave an update on the number of people who had responded regarding the purchase of the Bassano Subdivision rail line. January 21, 1999 Page 12 6. Correspondence 1. A.A.M.D.&C. -Visioning Conference A letter from the A.A.M.D.&C., with regard to a possible Visioning Conference, was presented to Council. Moved by Councillor Loewen that we advise the A.A.M.D.&C. we are in agreement with hosting a Visioning Conference and prefer it be held in conjunction with the Spring 1999 Convention. Carried. 2. Alberta Municipal Affairs -Seminar for Municipal Councillors A letter from Alberta Municipal Affairs, with regard to a Seminar for Municipal Councillors, was presented to Council. The County Administrator stated that the Councillors have been registered for the seminar to be held in Brooks on March 26`h, l 999. 3. Alberta Environmental Protection -Red Deer River Corridor Integrated Management Plan A letter from Alberta Environmental Protection, with a copy of the draft Red Deer ~ River Corridor Integrated Management Plan, was presented to Council. Moved by Councillor Stobbs that we approve the draft Red Deer River Corridor Integrated Management Plan for a public consultation process. Carried. 7. Other Business 1. Planner -Introduction to Planning Law The County Administrator reported to Council that the Planner received a mark of excellent on his Introduction to Planning Law course. 2. John Dell -Vacation Extension Moved by Councillor Douglass that we approve the vacation extension to April 30`h, 1999 for the Assessor, John Dell. Carried. .-- January 21, 1999 Page 13 3. Awards Nib Awards Night will be held in Bassano this year with Councillors Steinbach, Douglass and Baksa in charge of the arrangements. 4. Divisions 5 & 10 Recreation Requisition Increase The County Administrator presented to Council one letter in opposition to the requisition increase request. Moved by Councillor Harbinson that we approve an increase to the Division 5 & 10 recreation requisition from $42,000 to $60,000. Carried. 5. Tenders for Auditors Moved by Councillor Fabian that Young, Parkyn, McNab and Company be awarded the auditor tender for 1999. Carried. 8. Borrowing Bylaw - 1273-99 Moved by Councillor Stobbs that Bylaw 1273-99, being a bylaw to allow for borrowing for the purpose of General Operating Expenses, receive first reading. -- Carried. Moved by Councillor Douglass that Bylaw 1273-99 receive second reading. Carried. Moved by Councillor Loewen that consent be given for third and final reading of Bylaw 1273-99. Carried Unanimously. Moved by Councillor Harbinson that Bylaw 1273-99 receive third reading. Carried. 9. Post Agenda Items 1. Town of Brooks -Joint Meeting The County Administrator presented a letter from the Town of Brooks, with regard to the annual joint meeting. Moved by Councillor Berg that we attend the joint Town/County meeting on March 17`h, 1999 at 7:00 p.m. Carried. January 21, 1999 Page 14 2. Power of Attorney for Planner, Gord Shaw Moved by Councillor Baksa that we delegate Power of Attorney to Planner Gord Shaw for signing authority when approving subdivisions. Carried. 3. Gem Fire Association The County Administrator presented a letter from the Gem Fire Association, requesting financial assistance for the purchase of a sump pump and hose. Moved by Councillor Harbinson that we put $500.00 in the 1999 Budget for the purchase of a sump pump and hose for the Gem Fire Association. Carried. 4. Superintendent of Public Works Evaluation A reminder was given that the Superintendent of Public Works evaluation needs to be completed. 5. Proposed Reuulatory Framework for Livestock Feeding Operations in Alberta ~- A discussion was held on the Proposed Regulatory Framework for Livestock Feeding Operations in Alberta. 6. ASB Truck Tender Steve Wylie, Agricultural Fieldman, was in attendance. The County Administrator presented the ASB Truck Tenders to Council.. Moved by Councillor Loewen that we accept the tender of International Summit Motors, being the lowest bid meeting our specifications, and that the funding in excess of the budgeted amount be taken from the Vehicle Replacement Reserve. Carried. 7. Ron Isinger -Precision Drilling Ron Isinger of Precision Drilling and Darren Gauthier of JoAnn Trucking were in attendance to present to Council information in favour of allowing wide 16 wheel tandems on County roads. Moved by Councillor Harbinson that we allow wide 16 wheel tandems, that are using a booster, on County roads until the February 8`'', 1999 Municipal Meeting at which time the policy will be reviewed. " Carried. Returned to Meeting Councillor Fabian returned to the meeting at 11:32 a.m. l0. Public Hearing -Bylaw 1269-98 Land Use Bylaw 1004 -90 Amendment Include Sec. 68, Being a Land Use District called Agricultural Intensive Moved by Councillor Stobbs that we recess for the Public Hearing at 11:32 a.m. Carried. The meeting reconvened at 11:45 a.m. 11. Bylaw 1269-98 Moved by Councillor Baksa that Bylaw 1269-98, being a bylaw to amend Land Use Bylaw #1004-90 to add an Agricultural Intensive land use district, receive second reading. Moved by Councillor Baksa that Bylaw 1269-98 be amended to remove "County Residence (one per quarter)" and change Minimum Lot Area from "approved ` by the Municipal .Planning Commission" to "approved by Council". Vote on amendment. Carried. Vote on second reading. Carried. Moved by Councillor Steinbach that Bylaw 1269-98 receive third and final reading. Moved by Councillor Baksa that this motion be tabled. Carried. January 21, 1999 Page 16 ,^ 12. Request to Address Council A member of the public, Bob Baxter, asked to be allowed to address Council. The Reeve asked if anyone was opposed to Mr. Baxter addressing Council. There were no objections. Mr. Baxter asked that in the future, Council consult with industry prior to making decisions that will affect them. Post Agenda Items (cont'd) 8. Rosemary Fire Committee Anointment Moved by Councillor Loewen that Council appoint Ron Wiebe to the Rosemary Fire Committee as a member at large. Carried. 9. Reeves and Mavors Meeting -Medicine Hat The Reeve reported on the Reeves and Mayors Meeting held in Medicine Hat on the /"' 19''' of January, 1999. Lunch Council recessed for lunch from 12:00 noon to 1:30 p.m. 13. In Camera Moved by Councillor Baksa that we move in camera. Carried. Moved by Councillor Stobbs that we move out of camera. Carried. Moved by Councillor Loewen that we send a letter to Canadian Pacific Railway accepting their offer to purchase the Bassano Subdivision after salvage has been completed and a Reclamation Certificate has been issued in accordance with the Alberta Environment regulations for rail lines abandoned after September 1 s`, l 993. Carried. Private Members' Bill - "Right of Choice" Moved by Councillor Harbinson that the Reeve send a letter to our MLA, Lyle Oberg, with a copy to Judy Gordon, stating that we are not in favour of the Private Members' Bill giving Counties and Municipal Districts the "Right of Choice" as to whether or not their Special Constables bear side-arms for their protection. Carried. Post Agenda Items (cont'd) Proposed Re ug l~ry Framework for Livestock Feeding_O~erations in Alberta (cont'd) Moved by Councillor Loewen that each Councillor individually complete and submit the questionnaire for the Proposed Regulatory Framework for Livestock Feeding Operations in Alberta and that a letter be sent to Alberta Agriculture, Food and Rural Development asking for an extension to their February 5`'', 1999 deadline for submissions. Carried. 14. Dele ate 1. Human Resources Group -Corporate Review Dimitre Pojidaeff gave a presentation to Council on the benefits of an organizational 1 review. 2. UMA & Alberta Transportation & Utilities -Presentation on Cassils / TransCanada Highway Intersection Value Assessment Al Porter of UMA made a presentation to Council with regard to the problems and possible solutions at the Cassils / TransCanada Highway Intersection. Municipal Planning_Commission Councillor Baksa gave this report. 1. Planning & Development Fees Moved by Councillor Baksa that we approve the planning and development fees as presented. Moved by Councillor Loewen that this motion be tabled. Carried. 2.99 NL O1 -County of Newell -Consolidation of Titles . C.P.R. Right-of--Way -Rosemary -Gem Spur Moved by Councillor Baksa that we approve this subdivision subject to the subject properties being consolidated with adjacent parcels, excepting the lands the County is retaining; subject to the Cash-in-Lieu of Municipal Reserve being waived in those quarter sections where previous subdivisions have occurred; and subject to the applicant meeting all requirements of the Eastern Irrigation District with respect to the conveyance of water as well as easements. Carried. January 21, 1999 Page 20 3. 99 NL 02 - NE 22-21-18-W4 -Division 6 ~ Godwin Brian -Agricultural Subdivision Moved by Councillor Baksa that we approve this subdivision subject to the applicant entering into an agreement with the County of Newell for the installation of any required accesses for the proposed and remnant parcels and subject to the applicant meeting all requirements of the Eastern Irrigation District with respect to the conveyance of water as well as easements. Members Present Reeve W. Daniels Councillors V. Fabian N. Berg E. Stobbs J. Harbinson R. Steinbach M. Loewen B. Scheuerman M. Douglass C. Baksa Administrator M. Bowen • Planner G. Shaw Recording Secretary P. Hoffman .-- The Reeve opened the Public Hearing at I I :32 a.m. There were nu members of the public in attendance. The Public Hearing dealt with Bylaw # 1269-98, being a bylaw to amend Land Use Bylaw #1004-90 to add an Agricultural Intensive land use district. The Reeve asked if any of the Councillors had any questions or concerns with regard to this bylaw. Councillor Harbinson asked for an explanation of what would actually happen ifan area was zoned Agriculturallntensive. Would it sterilize the surrounding area? TliePlannerresponded that it wouldn't affect other development until a Development Permit has been issued. Councillor Fabian asked for, and was given, clarification. Councillor Douglass suggested that we look at the Proposed Regulatory Framework for Livestock Feeding Operations in Alberta as it could be relative. Councillor Loewen felt it was a matter of whether we wanted to be masters of our County or not. '°" Councillor Berg asked for, and was given, the kinds of discretionary uses allowed. Councillor Baksa felt that Council should have the right to waive minimum lot size, not the MPC. She also expressed concern with Discretionary Uses; "Country Residence (one per quarter)" and "Other uses of a similar nature as approved by the Municipal Planning Commission". The Planner responded that by including "Other uses of a similar nature as approved by the Municipal Planning Commission" it could leave us open to a number of appeals. Councillor Scheuerman suggested that the MPC and/or Council could designate Agricultural Intensive areas.
