Minutes of Council Meeting
March 23, 2000
The regular Council Meeting of the County of Newell No. 4 was held in the County Office at
Brooks, AB on Thursday, March 23, 2000 commencing at 10:00 a.m.

1. Council Minutes -March 9.2000
Minutes of the March 9, 2000 meeting were presented. Moved by Councillor Berg that we adopt
the minutes as presented. Carried.
2. Public Hearing Minutes -March 9, 2000
Minutes of the March 9, 2000 Public Hearing were presented. Moved by Councillor Douglass that
we adopt the minutes as presented. Carried.
3. Call for Post Agenda Items
The Reeve called for post agenda items.

A - Agricultural District to CR -Country Residential District
Moved by Councillor Douglass that the following motion be lifted from the table. Carried.
"Moved by Councillor Baksa that we deny the request to amend the land use designation of Pt.
NE & SE 14-20-IS-W4 from A -Agricultural to CR -Country Residential District. " Vote on
motion. Defeated. Moved by Councillor Douglass that we approve the request to amend the land
use designation of Pt. NE & SE 14-20-15-W4 from A -Agricultural District to CR -Country
Residential District. Defeated.

Paddock Wayne & Reita (owners -Paddock & Barge) Residential Subdivision
Moved by Councillor Eckert that the following motion be lifted from the table. Carried. "Moved
by Councillor Baksa that, to protect current farming practices in that area, subdivision
application 00 NL 006, Pt. NW 4-20-14-W4 and Plan 8011572, Block 1 be denied. " Myles
Paddock and Fred Barg were in attendance to present information on this application.

Councillor Harbinson arrived t the meeting at 10:30 a.m.
Vote on motion: "Moved by Councillor Baksa that, to protect current farming practices in that
area, subdivision application 00 NL 006, Pt. NW 4-20-14-W4 and Plan 8011572, Block 1 be
denied. " Defeated.

Councillor Loewen arrived at the meeting at 10:53 a.m.
Moved by Councillor Douglass that we approve subdivision application 00 NL 006, Pt. NW 4-20-
14-W4 and Plan 8011572, Block 1, waiving the requirements of Section 49 of the land use bylaw
pertaining to the size of residential requirements of a subdivided parcel in the A -Agricultural
District and subject to the following conditions:
1. The dedication of road along the westerly boundary of the remnant parcel in the form of a
plan.
2. The applicant entering into a shared access agreement with the owner of the NW 4-20-14-
W4 to provide access to the proposed parcel. This agreement shall be registered on each
title and be in a form agreeable to the County.
3. The re-evaluation ofthe municipal reserve value paid previously in a subdivision application
as that was based on this parcel not having a residence.

4. The applicant entering into an easement as well as a conveyance agreement forthe proposed

parcel.
5. Oil and gas companies will require that all Board Orders, surface lease agreements, access
agreements, rights-of--ways, etc., be continued on title when the proposed parcel is registered
and land titles office.
6. The applicant entering into a development agreement for access to the proposed parcel.
Carried.
6. Delegation -Young, Parkyn. M`Nab & Co. -George Virtue -Financial Statement
George Virtue, of Young, Parkyn, M`Nab & Co., was in attendance to present the 1999 Financial
Statement to Council.

Council recessed for lunch from 11:45 a.m. to 1:30 p.m.

Councillor Fabian returned to the meeting from the lunch recess at 1:40 p.m. during the In Camera

8. Delegation -Brooks & District Women's Shelter
Bonita Levie and Eileen French, of the Brooks & District Women's Shelter, were in attendance
to present information on their organization and ask for $20,000 to be used to pay down the
mortgage on their newly purchased safe house.
9. Delegation -Brooks & District Chamber of Commerce
Terri Magnuson and Anne-Marie Shields, of the Brooks & District Chamber of Commerce, were
in attendance to request that Council appoint someone to sit on a Tourism Committee.

1. Delegation -Emerson Bridge Park `~"
Brian Godwin, Contract Operator for Emerson Bridge Park, was in attendance to update Council
on his plans for upgrading the park.

Moved by Councillor Steinbach that we appoint a member to the Brooks & District Chamber of
Commerce Tourism Committee. Defeated.
Delegation -Brooks & District Women's Shelter (cont'd)
Moved by Councillor Eckert that we support the Brooks & District Women's Shelter by donating
$20,000. Carried.
ll. Correspondence
1. Bassano Rural Fire Protection (1999) Association -Insurance
A letter from the Bassano Rural Fire Protection (1999) Association, requesting that they be
included in our Liability Insurance Policy, was presented to Council. Moved by Councillor ._.-
Harbinson that we include the Bassano Rural Fire Protection (1999) Association in our Liability
Insurance Policy as an additional insured with all premiums being paid by the Fire Association.
Carried.
2. Newell Recycling Association -Annual General Meeting
A letter from the Newell Recycling Association, inviting Council to their Annual General
Meeting, was presented to Council. Moved by Councillor Harbinson that Reeve Daniels attend
the Newell Recycling Association's Annual General Meeting. Carried.
3. A.A.M.D.&C. -Spring Convention Resolutions
The A.A.M.D.&C. Spring Convention resolutions were presented to Council as information.

12. Other Business
1. Dog_Bylaw -Johnson Subdivision
Moved by Councillor Fabian that we abide by the wishes of the majority of the residents of the
Johnson Subdivision and not implement a dog control bylaw. Carried.
13. 2000 Municipal Budget
Moved by Councillor Douglass that we pass the 2000 Municipal Budget subject to the transfer to
the contingency reserve being based on the final linear assessment figures; by adding an additional
$20,000 to charitable donations and by decreasing the transfer to the contingency reserve by
$20,000. Moved by Councillor Loewen that the motion be amended to increase the budget
amount for tourism from $5,000 to $7,5000. Defeated. Moved by Councillor Loewen that the
motion be amended to increase the budget amount for statutory planning from $20,000 to $30,000.
Defeated. Vote on original motion. Carried.
14. 2000 Total Count~Budget
Moved by Councillor Loewen that we refer the fire requisition topic to a workshop session and,
if we choose to follow it, it be implemented in 2001. Defeated. Moved by Councillor Eckert that
we approve the method of collection for the fire requisition as presented and that this method be
,~-- included in the 2000 Total County Budget. Carried. Moved by Councillor Douglass that we
approve the 2000 Total County Budget subject to the transfer to the contingency reserve being
based on the final linear assessment figures; an additional $20,000 being added to charitable
donations and the necessary changes be made to accommodate the approved method of collection

15. Bylaw 1315-00 -Recreation Tax Rate
Moved by Councillor Harbinson that Bylaw 1315-00, being a bylaw for the purpose of setting up
tax rates or requisitions to be charged for various Recreation Areas, receive first reading. Carried.
Moved by Councillor Douglass that Bylaw 1315-00 receive second reading. Carried.
Moved by Councillor Steinbach that consent be given to proceed with third and final reading of
Bylaw 1315-00. Carried Unanimously.

16. Bylaw 1314-00 -Fire Area Tax Rate
Moved by Councillor Douglass that Bylaw 1314-00, being a bylaw for the purpose of setting up
tax rates for requisitions to be charged to various Fire Areas, receive first reading. Carried.
Moved by Councillor Harbinson that Bylaw 1314-00 receive second reading. Carried.
Moved by Councillor Berg that consent be given to proceed with third and final reading of Bylaw
1314-00. Carried Unanimously.
Moved by Councillor Eckert that Bylaw 1314-00 receive third and final reading. Carried.
17. Bylaw 1313-00 -Library Tax Rate
Moved by Councillor Steinbach that Bylaw 1313-00, being a bylaw for the purpose of including
Divisions 5 & 10 into the Town of Brooks Municipal Library and Shortgrass Regional Library,
receive first reading. Carried.
Moved by Councillor Harbinson that Bylaw 1313-00 receive second reading. Carried.
Moved by Councillor Douglass that consent be given to proceed with third and final reading of

18. Bylaw 1316-00 - 2000 Tax Rate Bylaw
Moved by Councillor Berg that Bylaw 1316-00, being a bylaw for the purpose of authorizing the
various rates of taxation for various purposes in the year 2000, receive first reading. Carried.
19. Treasurer's Report
Moved by Councillor Harbinson that we approve the Treasurer's Report for February 2000.

2. Visitor's Guide Advertisin¢
Moved by Councillor Fabian that we place a full page advertisement with colour in the Visitor's
Guide the same as last year. Carried.
3. Councillor's Compensation & Expenses Policy
Moved by Councillor Harbinson that we accept the recommendations of the Budget Committee
and adopt the Councillor's Compensation & Expenses Policy as presented. Councillor Harbinson
requested a recorded vote. Moved by Councillor Loewen that we table this motion. Carried.
4. CPR Meetins
The Administrator reported on the March 22"d meeting with the Bassano-Empress CPR
Committee.
5. Ag Summit
Councillor Eckert requested that he be allowed to attend the Ag Summit being held in Olds on
/"' April 7`~ as the meetings being held in Claresholm, Taber and Drumheller conflict with previous
commitments. Moved by Councillor Berg that attendance at the Ag Summit in Olds be approved.
Carried.
