HomeMy WebLinkAbout1881-17 Local Improvement - Tilley Infrastructure Upgrades - Phase 1 & 2 (Tax Rate) COUNTY OF NEWELL PROVINCE OF ALBERTA BYLAW No. 1881-17 A BYLAW OF THE COUNTY OF NEWELL, IN THE PROVINCE OF ALBERTA, TO AUTHORIZE THE COUNCIL OF THE COUNTY OF NEWELL TO IMPOSE A LOCAL IMPROVEMENT TAX IN RESPECT OF ALL LANDS THAT DIRECTLY BENEFIT FROM THE "HAMLET OF TILLEY INFRASTRUCTURE UPGRADES— PHASE 1 & 2" LOCAL IMPROVEMENT PROJECT. WHEREAS, the Council of the County of Newell has decided to issue a bylaw pursuant to Section 397 of the Municipal GovernmentActto authorize a local improvement tax levy to pay for the "Hamlet of Tilley Infrastructure Upgrades— Phase 1 &2" local improvement project. WHEREAS local improvement plan has been prepared and the required notice of intention to undertake and complete the"Hamlet of Tilley Infrastructure Upgrades—Phase 1 & 2" project has been given to the benefiting owners in accordance with the attached Schedule "A" and Schedule "B". WHEREAS Council has decided to set a uniform tax rate per utility service type based on the total number of parcels connected to Hamlet of Tilley utility services. The total number of parcels connected to water services during construction was ONE HUNDRED AND SEVENTY-TWO (172). The total number of parcels connected to sewer services during construction was ONE HUNDRED AND SIXTY-THREE (163). WHEREAS Plans and specifications have been prepared. The total cost of the project is $8,313,502 with the following contributions to be received or applied to the project: 1) Benefiting Owners (Water Service): $1,446,959 1) Benefiting Owners (Sewer Service): $2,596,188 2) Provincial Grants: $1,100,697 2) Municipality: 3 169 658 TOTAL: $8,313,502 The local improvement tax will be collected for TWENTY-FIVE (25) years. The total amount levied annually against the benefiting owners connected to water services is 86 681. The total amount levied annually against the benefiting owners connected to sewer services is 155 528. All the required approvals for the project have been obtained and the project is in compliance with all Acts and Regulations of the Province of Alberta. NOW, THEREFORE, the Council of the County of Newell duly assembled, enacts as follows: 1. That for the purpose of completing the "Hamlet of Tilley Infrastructure Upgrades — Phase 1 & 2" local improvement project the sum of EIGHTY SIX THOUSAND, SIX HUNDRED AND EIGHTY ONE DOLLARS ($86,681), and the sum of ONE HUNDRED FIFTY FIVE THOUSAND, FIVE HUNDRED AND TWENTY EIGHT DOLLARS ($155,528� be collected by way of an annual, uniform local improvement tax rate assessed against the benefiting owners connected to Hamlet of Tilley water and sewer utility services respectively, and as provided in Schedule "A" and Schedule "B" attached. 2. The net amount levied under the bylaw shall be applied only to the local improvement project specified by this bylaw. 3. This bylaw comes into force the date of final reading.
