County of Newell No. 4 Minutes of Municipal Planning Commission Meeting July 30, 1996 The regular Municipal Planning Commission 11111eeting of the County of Newell No. 4 was held in the County Office at Brooks, Alberta on Tuesday, July 30, 1996 commencing at 10:00 a.m. Members Present Councillors V. Excused from Meeting All members were in attendance at this meeting. ~-- ~ .... 2. Minutes Minutes of the June 25, 1996 meeting were presented to the Commission. Moved by Councillor Scheuerman that we adopt these minutes as circulated. Carried. 3. Call for Post Aoenda Items The Chairman called for post agenda items. Arrived at Meeting A. Zagorsky arrived at 10:05 a.m. 4. Adoption of Agenda Moved by Councillor Baksa that the agenda be adopted as amended. Carried. .~^ July 30, 1996 Page 39 t ,.- 5. Delegations 1. Robert Perini -Permit #1559 -Eastern Irrigation Ag. Society Building - NW 20-18-14-W4M Robert Perini and AI Bessey were in attendance on behalf of the Eastern Irrigation Ag. Society and presented information on the above permit. Moved by Councillor Baksa that we approve this permit subject to the applicant entering into a Development Agreement with the Town of Brooks regarding the construction of the required access road N of NW 20-18-14.4 and subject to the applicant meeting the requirements of any other applicable Provincial regulations. Carried. 2. Rob Kendall -Nova -Subdivision Process Rob Kendall was in attendance to discuss the subdivision and development process and how it relates to the regulations of the Energy Utilities Board. V ` .... 3. Teresa Perry -Permit # 1565 -Moved an Buildings -Plan 8311138 Block 1 Lot 1 Teresa and Dean Perry were in attendance and presented information on the above permit. Moved by Councillor Scheuerman that we approve this permit subject to the applicant installing new siding and doors on both moved in buildings, and subject to the applicant providing the r-, County of Newell with an irrevocable Letter of Credit in the amount of S 15,000.00 valid until August 1, 1997 to ensure that the required installation of new siding and doors is completed. Carried. Lunch -~ The Commission recessed for lunch from 12:05 ~ m. - 1:15 p.m. 4. Bill Kazimir -Permit # 1557 -Shop -Plan 7910951 Block 1 Lot 5 INE 22-18.14.41 Bill Kazimir was in attendance and presented information regarding the above permit application. Moved by A. Zagorsky that we approve this permit and relax the maximum wall height requirement for accessory buildings to 14 feet (4.27 meters) and that we relax the maximum building height requirement for accessory buildings to 17.5 feet (5.34 metersl. Carried. The Commission's decision on this application was based on the following: The requested relaxation only dealt with height and not area of the building -the large size of the acreage minimizes the impact on neighbouring properties -the applicant obtained signatures from all landowners in the subdivision stating that they had no objections to the proposed development. r- July 30, 1996 Page 40 ~ 5. Stark (Breakell -Subdivision 96 NL 23 -Lot 7, 8 & 9 Plan 8310857 Bob Breakell, Maxine Breakell and Mark Breakell, Marguerite Stark and Rick Stang were in attendance and presented information on this subdivision. Moved by Councillor Baksa that for the existing development only, we relax the side yard setback for the north property line of proposed Lot 7 to the northern edge of the existing development; that for the existing development only, we relax the side yard setback for the south property line of proposed Lot 8 to the southern edge of the existing development; and that we recommend to Council the approval of this subdivision. Carried. A copy of the proposed subdivision plan indicating the relaxations is attached to, and forms part of, these minutes. 6. Business from Minutes There was no business from the minutes. .... 7. Carried. 2. #1554 -Blaine & Heather Evans -Attached Carport - Ptn. SW 18-20-12.4 -Patricia Moved by A. Zagorsky that we approve this permit. Carried. 3. #1564 - Murray's Aircraft Repair (19801 Ltd. -Addition to Hangar -Plan 7610063 Lot 6 - SE 30-19.14-4 -Brooks Moved by A. Zagorsky that we approve this permit subject to the applicant providing the County of Newell with a written approval from the Town of Brooks stating that they will allow the encroachment into the parking area. Development Resort The Development Control Officer presented her report for June 20, 1996 to July 24, 1996. Moved by A. Zagorsky that we approve this report. Carried. 9. Home Occupation Permits 1. Byron Mushinski -Contract Painter -Plan 9211683 Block 1 Lot 2 - SE 6.19.14-4 -Brooks Moved by A Zagorsky that we approve this permit. Carried. 10. Land Use Chances There were no land use changes. ~- 11. Subdivisions 1. 96 NL 20 - SW 29-17-13-4 -Stauffer, Paul Moved by Councillor Baksa that we recommend to Council the approval of this subdivision subject to the applicant meeting all requirements of the Eastern Irrigation District with respect to the conveyance of water and subject to the applicant entering into a Development Agreement with the County of Newell to provide access to the remnant parcel. Carried. 2. 96 NL 21 • N'/: 9-19.14.4 -Hargrave, Douglas Moved by Councillor Scheuerman that we recommend to Council the approval of this subdivision subject to it consisting of only one parcel that would include both proposed parcels one and two; subject to the applicant meeting all requirements of the Eastern Irrigation District with respect to the conveyance of water and subject to the applicant providing Canadian Western Natural Gas with an easement on the remnant parcel to provide natural gas service to the proposed subdivision. Corresaondence There was no correspondence. 12. Other Business 1. Proposed Area Structure Plan - E'/: 36-20.15.4 Moved by J. Doerksen that we refer the proposed Area Structure Plan for the E'/: 36-20-15-4 back to the developer for further consideration of the affects of the wellsite, the setback location of the dugout and the moving of the proposed water lines from inside the roads to easements within the proposed lots. Carried. 2. Sagebrush Estates The Development Control Officer presented information to the Commission on Sagebrush Estates. 13.
