CALL TO ORDER The Chairman called the meeting to order at 10:01 a.m. 2. EXCUSED FROM MEETING All members were present. 3. MINUTES 3.1 March 21, 2019 Meeting Minutes P-15/19 MOVED BY COUNCILLOR HUBY KALLEN that the Council Meeting minutes be adopted as presented. _, /' � MOTION CARRIED Municipal Planning Commission April 11,2019 4. CALL FOR POST AGENDA ITEMS The Chairman called for post agenda items. 5. ADOPTION OF AGENDA P-16/19 MOVED BY COUNCILLOR KELLY CHRISTMAN that the agenda be adopted as presented. MOTION CARRIED 6. DEVELOPMENT REPORT The Development Clerk was available to answer questions. There were no questions. This item was accepted as information. 7. DEVELOPMENT PERMITS 7.1 DP 2019007 - Lot 1, Block 2, Plan 1310356, NW 16-19-15 W4M, Renewal of Home Occupation Permit 2018032. Operation of an Animal Attraction (White Barn Fun Farm), installation of a shed to be used for the business. The Development Clerk provided background information on the proposed permit application. M. Jackson responded to questions regarding the operation, indicating that things were going well. She indicated that there has been good feedback from the community and they did a travelling petting zoo. The coming year looks really promising with bookings already made. P-17/19 MOVED BY COUNCILLOR TRACY FYFE That the Municipal Planning Commission APPROVE the Home Occupation Permit 2019007 to operate an animal attraction business, on lands legally described as Lot 1, Block 2, Plan 1310356, NW 16-19-15 W4M. This development approval is subject to the conditions outlined below. DP 2019007 is Approved for the following reasons: 1. The proposed development complies with the Municipal Development Plan. 2. The Development Authority is satisfied that the proposed development is suitable for the purpose for which it is intended under the Agricultural District (Schedule 2), Standards of Development (Schedule 3) and Home Occupations (Schedule 4 Section 9), as specified in the County of Newell Land Use Bylaw 1892-17. 3. No objections have been received from adjacent landowners or referral agencies with respect to the proposed development. 'I , Page 2 of 8 Municipal Planning Commission April 11,2019 Conditions of Development Approval a) This approval is effective as of May 2, 2019 (21-day appeal period). This permit is permanent. b) The development must be located as shown on the site plan approved with the application and submitted May 11, 2018. It must be built according to the description provided with this approval. Any changes shall require the written approval of the Development Authority. c) Any additional development shall require prior approval of a separate permit application. d) That there are no more than 2 resident employees involved in the operation of this business. The addition of any employees will require a new permit application. e) That the only advertising being permitted on the property be limited to one freestanding sign of 6 ft2 (.06 m2) to be installed 10 ft (3 m) from the property line. fl That all buildings/structures must have a separation distance of 10 ft (3 m) g) That the business adheres to the guidelines set out by Alberta Health Services animal attraction operations. The proposed development must comply with: a) The provisions pertaining to the Agriculture District and all relevant schedules, as outlined in the County of Newell Land Use Bylaw 1892-17. b) All Federal, Provincial and Municipal statutes, regulations, codes and standards. c) All Alberta Building Codes and Safety Codes, where applicable. MOTION CARRIED LEFT THE MEETING M. Jackson left the meeting at 10:06 a.m. 7.2 DP 2019008 - Lot 3, Block 3, Plan 0214002, SW 9-19-14 W4M, Construction of an accessory storage building with a variance to the side yard setback The Development Clerk provided background information on the proposed permit application. MPC expressed concerns with water run-off and traffic flows around the buildings. M. Reinhold explained that the drainage s/opes towards Highway 1 and there have __ been no issues with pooling or puddling up to this time. M. Reinheller added that they will be adding gravel and doing touch-ups to any areas that require them this � � Page 3 of 8 Municipal Planning Commission _ April 11,2019 spring. He also indicated that there have been no issues with traffic flow on the site, since there are not a lot of vehicles at the site at one time. P-18/19 MOVED BY REEVE MOLLY DOUGLASS That the Municipal Planning Commission APPROVE Development Permit 2019008 for the construction of a 3900 ft2 (362 m2) storage building with a variance to the setback on lands legally described as Lot 3, Block 3, Plan 0214002, SW 9-19-14 W4M. This development approval is subject to the conditions outlined below. DP 2019008 is Approved for the following reasons: 1. The proposed development complies with both the Municipal Development Plan and the Intermunicipal Development Plan. 2. The Development Authority is satisfied that the proposed development is suitable for the purpose for which it is intended under the Rural Industrial District(Schedule 2) and Standards of Development (Schedule 4) as specified in the County of Newell Land Use Bylaw 1892-17. 3. No objections have been received from adjacent landowners or referral agencies with respect to the proposed development. Conditions of Development Approval: a) This approval is effective as of May 2, 2019 (21-day appeal period). b) The development must be located as shown on the site plan approved with the application and submitted March 4, 2019. It must be built according to the description provided with this approval. Any changes shall require the written approval of the Development Authority. c) That there is a 10 ft (3 m) separation distance between the new building and any other buildings or structures on the parcel. d) That any dwelling/structure is located a minimum distance of 3 m (10 ft)from any right of way or easement on the parcel. e) That access can be provided for Emergency Services vehicles to the east, west and south sides of the building. fl That the following setbacks on all sides are maintained for this development: Front (south): 50 ft (15.2 m) Rear (north) 30 ft (9 m) as per Alberta Transportation Side (east): 25 ft (7.6 m) Side (west): 30 ft (9 m), variance from 50 ft (15.2 m) Page 4 of 8 Municipal Planning Commission April 11,2019 The proposed development must comply with: a) The provisions pertaining to the Rural Industrial District and all relevant schedules, as outlined in the County of Newell Land Use Bylaw 1892-17. b) All Federal, Provincial and Municipal statutes, regulations, codes and standards. c) All Alberta Building Codes and Safety Codes, where applicable. MOTION CARRIED LEFT THE MEETING M. Reinheller left the meeting at 10:08 a.m. 7.3 DP 2019009 - Lot 9, Block 2, Plan 0511610, NE 8-19-14 W4M, Installation of a sign with a variance to the setback The Development Clerk provided background information on the proposed permit application. There were no questions from MPC. P-19/19 MOVED BY COUNCILLOR KELLY CHRISTMAN that the Municipal Planning Commission APPROVE Development Permit 2019009 for the installation of a 107 ft2 (9.9 m2) sign with a variance to the road allowance setback, on lands legally described as Lot 9, Block 2, Plan 0511610, NE 8-19-14 W4M. This development approval is subject to the conditions outlined below. DP 2019009 is Approved for the following reasons: 1. The proposed development complies with both the Municipal Development Plan and the Intermunicipal Development Plan. 2. The Development Authority is satisfied that the proposed development is suitable for the purpose for which it is intended under the Rural Industrial District(Schedule 2) and Standards of Development (Schedule 4) as specified in the County of Newell Land Use Bylaw 1892-17. 3. No objections have been received from adjacent landowners or referral agencies with respect to the proposed development. MOTION CARRIED 7.4 DP 2019011 - Lot 7, Block 4, Plan 8111991, NE 11-21-18 W4M, Installation of a moved in dwelling with an attached deck The Development Clerk provided background information on the proposed permit application. There were no questions from MPC. P-20/19 MOVED BY COUNCILLOR ANNE MARIE PHILIPSEN that the Municipal Planning Commission APPROVE Development Permit 2019011, for the installation of 1152 ftz (107 m2) moved in dwelling with attached 400 ft2 (37 m2) deck, on lands legally described as Lot 7, Block 4, Plan 8111991, NE 11-21-18 W4M. This development approval is subject to the conditions outlined below. DP 2018011 is Approved for the following reasons: 1. The proposed development complies with the Municipal Development Plan. 2. The Development Authority is satisfied that the proposed development is suitable for the purpose for which it is intended under the Acreage Residential District (Schedule 2) and Standards of Development (Schedule 4) as specified in the County of Newell Land Use Bylaw 1892-17. 3. No objections have been received from adjacent landowners or referral agencies with respect to the proposed development. Conditions of Development Approval: a) This approval is effective as of May 2, 2019 (21 day appeal period) b) The development must be located as shown on the site plan approved with the application and submitted March 12, 2019. It must be built according to the description Page 6 of 8 Municipal Planning Commission April 11,2019 provided with this approval. Any changes shall require the written approval of the Development Authority. c) Any additional development shall require prior approval of a separate permit application. d) That the property is not used for conducting a business or commercial operation without first obtaining the required permits. e) That the applicant submit a $5000.00 security deposit immediately upon permit approval and prior to installation of the dwelling. The deposit will be refunded when the construction permits have been approved and closed. fl That the following setbacks are maintained for this development: Front (east): 50 ft (15.2 m) Side (north & south): 25 ft (7.6 m) Rear (west): 25 ft (7.6m) g) That the developer must start construction before May 2, 2020. In the event that this date cannot be met, the developer must apply for an extension and may be required to apply for a new permit. h) That the applicant must install a temporary rural address sign at the road approach to the site as soon as construction starts. The sign must display the rural address as assigned by the County in the letter that will be mailed to the applicant after the permit has been approved. No other address may be displayed on the site. The sign must remain in place and in full view until it is replaced by a County of Newell issued rural address sign. The proposed development must comply with: a) The provisions pertaining to the Acreage Residential District and all relevant schedules, as outlined in the County of Newell Land Use Bylaw 1892-17. b) All Federal, Provincial and Municipal statutes, regulations, codes and standards. c) All Alberta Building Codes and Safety Codes, where applicable. MOTION CARRIED LEFT THE MEETING S. O'Neill left the meeting at 10:25 a.m. 8. OTHER BUSINESS Page 7 of 8 Municipal Planning Commission April 11,2019 8.1 Countess Concept Plan The County Planner provided background information on this item. W. Ragan provided an overview of the concept plan for a museum that will preserve the history and artifacts from the area. The County Planner indicated that the current Land Use Bylaw does not have provisions for a development of this nature and so a Direct Control District will be set up to accommodate this use. The County Planner responded to guestions, indicating that the concept plan is being presented today for information. She indicated that access to the development will be discussed later, noting that setbacks to SH550 must be discussed with Alberta Transportation. W. Ragan responded to further questions from MPC. 9. POST AGENDA ITEMS There were no post agenda items. 10. IN CAMERA There were no in camera items. 11. INFORMATION ITEMS 11.1 LU2017-45 Redesignation, Wheatland County The County Planner indicated that she spoke to Wheatland County about the redesignation, and they explained that they were changing all fifteen Hutterite Colonies to Direct Control. The County Planner did not recommend changing the zoning for all Hutterite Colonies in the County. This item was accepted as information. 12. QUESTION PERIOD A question period was held. 13.
