MUNICIPAL PLANNING COMMISSION MEETING
May 9, 2019
The regular Municipal Planning Commission Meeting of the County of Newell was held in the
County Office at Brooks, AB on Thursday, May 9, 2019 commencing at 10:01 a.m.

3.1 April 25, 2019 Meeting Minutes
MOVED BY COUNCILLOR TRACY FYFE that the minutes of the April 25, 2019
Municipal Planning Commission meeting be adopted as presented.

P-35/19 MOVED BY COUNCILLOR LIONEL JUSS that the agenda be adopted as presented.

6. DEVELOPMENT REPORT
MPC inquired if the reason the applicants were getting a permit was because the house
was old. Staff responded that once the applicants realized the house was built prior to
permits being required they asked for the house to be brought up to compliance.

E. Unruh excused herself due to a pecuniary interest at 10:03 a.m.
7.1 2019-0-010 - SW1/418-16-15-W4M, To create one new parcel approximately
30.57 acres (12.37 ha) in size, containing an existing residence, shop, and barns, CJ�
from a previously unsubdivided quarter section for residential use.
The ORRSC Jr. Planner provided background information on the proposed
application.
MPC requested clarification regarding the size of the subdivision. D. Horvath
responded that it had been previously approved by Council for rezoning to Small
Holdings in order to accommodate the larger parcel, a dry corner for a full section
pivot irrigation system. She added that a parcel of this size meets the requirements
of the Small Holdings district. There was further discussion about the use and
intent of the Small Holdings district.
P-36/19 MOVED BY COUNCILLOR WAYNE HAMMERGREN THAT the Country Residential
subdivision of SW1/4 18-16-15-W4M (Certificate of Title No. 131 209 932 +3), to create
one new parcel approximately 30.57 acres (12.37 ha) in size, containing an existing
residence, shop, and barns, from a previously unsubdivided quarter section for
residential use BE APPROVED subject to the following:
CONDITIONS:
1. That, pursuant to Section 654(1)(d) of the Municipal Government Act, all outstanding
property taxes shall be paid to the County of Newell.

7.2 2019-0-011 - NW1/418-16-15-W4M, To create one new parcel approximately
31.11 acres (12.59 ha) in size, containing an existing residence, from a previously
unsubdivided quarter section for residential use.
The ORRSC Jr. Planner provided background information on the proposed
application.
MPC requested clarification about the location of the septic field in proximity to the
subdivision boundary. D. Horvath indicated that the location of the septic field is
listed as a condition of approval prior to finalization. She added that adjusting the
property line should have minimal impact on the area of the parcel.
A discussion followed regarding the location of the septic field and whether further
information should be required prior to approval.
P-37/19 MOVED BY REEVE MOLLY DOUGLASS THAT the Country Residential subdivision of
NW1/4 18-16-15-W4M (Certificate of Title No. 131 209 932), to create one new parcel
approximately 31.11 acres (12.59 ha) in size, containing an existing residence, from a
previously unsubdivided quarter section for residential use BE APPROVED subject to
the following:
CONDITIONS:
1. That, pursuant to Section 654(1)(d) of the Municipal Government Act, all outstanding
l property taxes shall be paid to the County of Newell.

P-38/19 MOVED BY COUNCILLOR TRACY FYFE THAT the Country Residential subdivision
of NW1/4 18-16-15-W4M (Certificate of Title No. 131 209 932), to create one new
parcel approximately 31.11 acres (12.59 ha) in size, containing an existing residence,
from a previously unsubdivided quarter section for residential use BE TABLED until
addition information is received.

7.3 2019-0-029 - NE1/4 24-20-14-W4M, To create one new parcel approximately
30.54 acres (12.36 ha) in size, containing an existing residence and accessory
structures from a previously unsubdivided quarter section for residential use.
The ORRSC Jr. Planner provided background information on the proposed
application.
MPC requested clarification about the fence on the west side and the dugout on
the north side of the proposed subdivision. D.Horvath explained that the applicant

was requesting that the property line on the west side be based on the historical
fence to accommodate future improvements. 0
D. Horvath added that MPC could require the property line to be adjusted to
accommodate the historical dugout if they so desired.
P-39/19 MOVED BY COUNCILLOR BRIAN DE JONG THAT the Residential subdivision of
NE1/4 24-20-14-W4M (Certificate of Title No. 011 113174), to create one new parcel
approximately 30.54 acres (12.36 ha) in size, containing an existing residence and
accessory structures from a previously unsubdivided quarter section for residential use
BE APPROVED subject to the following:
CONDITIONS:
1. That, pursuant to Section 654(1)(d) of the Municipal Government Act, all outstanding
property taxes shall be paid to the county of Newell.
MOTION CARRIED
7.4 2019-0-062 - Lot 1, Block 1, Plan 171 0622 & NW1/4 32-17-14-W4M, To correct
an encroachment by subdividing a 0.40 acre (0.162 ha) portion of NW 1/4 32-17-
14-W4M and consolidating the land to the adjacent parcel legally known as Lot 1,
Block 1, Plan 171 0622.
The ORRSC Jr. Planner provided background information on the proposed
application. MPC was given the opportunity to ask questions.
P-40/19 MOVED BY COUNCILLOR ANNE MARIE PHILIPSEN THAT the County Residential
subdivision of Lot 1, Block 1, Plan 171 0622 & NW1/4 31-17-14-W4M (Certificate of Title
No. 181 274 439, 181 237 805), to correct an encroachment by subdividing a 0.40 acre
(0.162 ha) portion of NW1/4 31-17-14-W4M and consolidating the land to the adjacent
parcel legally known as Lot 1, Block 1, Plan 171 0622 BE APPROVED subject to the
following:
RESERVE: The 10% reserve requirement, pursuant to Sections 661 and 666 of the
Municipal Government Act, be deferred by caveat on the parcel to be
created with the actual acreage to be dedicated being determined at the
final stage, for Municipal Reserve purposes.
CONDITIONS:
1. That, pursuant to Section 654(1)(d) of the Municipal Government Act, all outstanding
property taxes shall be paid to the County of Newell.
2. That the subdivided portion of NW 32-17-14-W4M be consolidated with the adjacent
parcel legally known as Lot 1, Block 1, Plan 1710622 in a manner such that the
resulting Certificate of Title could not be subdivided without the approval of the
Subdivision Authority.
