CALL FOR POST AGENDA ITEMS The Chairman called for post agenda items. 5. ADOPTION OF AGENDA P-72/19 MOVED BY COUNCILLOR KELLY CHRISTMAN that the agenda be adopted as presented. MOTION CARRIED LEFT THE MEETING M. Douglass excused herself due to a pecuniary interest at 10:00 a.m. 6. DEVELOPMENT PERMITS 6.1. DP 2019065 - Lot 1, Block 5, Plan 9711628, SW 10-19-14 W4M, Installation of a 1988 Manufactured dwelling 2 with a deck for residential use The Development Clerk provided background information on the proposed permit application. MPC asked staff why a security deposit was not listed as one of the conditions. Staff responded that previously, security deposits were requested on dwellings that needed repairs done on them, but in recent history, security deposits have not been requested for dwellings that were in good condition, MPC requested that a security deposit be added as a condition for this permit. MPC requested that going forward, the condition for a security deposit be included on all modular home 2, manufactured home 2 and moved in dwelling development permits. P-73/19 MOVED BY COUNCILLOR LIONEL JUSS That the Municipal Planning Commission APPROVE Development Permit 2019065, for the installation of a 1988 1152 ft2 (107 m2) manufactured dwelling 2 with attached 772 ft2 (72 m2) deck with variance to the setbacks, on lands legally described as Lot 1, Block 5, Plan 9711628, SW 10-19-14 W4M. This development approval is subject to the conditions outlined below. DP 2019065 is Approved for the following reasons: 1. The proposed development complies with the Municipal Development Plan. 2. The Development Authority is satisfied that the proposed development is suitable for the purpose for which it is intended under the Acreage Residential District (Schedule 2) and Standards of Development (Schedule 4) as specified in the County of Newell Land Use Bylaw 1892-17. 3. No objections have been received from adjacent landowners or referral agencies with respect to the proposed development. (q Page 2 of 4 Municipal Planning Commission September 19, 2019 Conditions of Development Approval: a. This approval is effective as of October 10, 2019 (21-day appeal period) The development must be located as shown on the site plan approved with the application and submitted August 26, 2019. It must be built according to the description provided with this approval. Any changes shall require the written approval of the Development Authority. b. Any additional development shall require prior approval of a separate permit application. c. That the property is not used for conducting a business or commercial operation without first obtaining the required permits. d. That the following setbacks are maintained for this development: Front (south): 50 ft (15.2 m) Side (west): 14 ft (4.3 m); variance from 25 ft (7.6 m) Side (east): 15 ft (4.6 m); variance from 25 ft (7.6 m) Rear (north): 25 ft (7.6 m) e. That the developer must start construction before October 10, 2020. In the event that this date cannot be met, the developer must apply for an extension and may be required to apply for a new permit. f. That the developer submit a $5000 security deposit, as the minimum required amount under Schedule 4, Section 18.15 of the County Land Use Bylaw 1892-17, to ensure the proper installation of the building. Once the development has passed inspection by the County Safety Codes Office (SCO), the security deposit will be refunded. The proposed development must comply with: a. The provisions pertaining to the Acreage Residential District and all relevant schedules, as outlined in the County of Newell Land Use Bylaw 1892-17. b. All Federal, Provincial and Municipal statutes, regulations, codes and standards. c. All Alberta Building Codes and Safety Codes, where applicable. 7.
