Stanway, Brooks Bulletin The Chairman called the meeting to order at 9:59 a.m. 2. EXCUSED FROM MEETING All members were present. 3. MINUTES 3.1 September 19, 2019 MPC Meeting Minutes MOVED BY COUNCILLOR LIONEL JUSS that the MPC Meeting minutes be adopted as presented. 4. CALL FOR POST AGENDA ITEMS (6 MOTION CARRIED Municipal Planning Commission October 10, 2019 The Chairman called for post agenda items. 5. ADOPTION OF AGENDA P-75/19 MOVED BY COUNCILLOR TRACY FYFE that the agenda be adopted as presented. MOTION CARRIED 6. DEVELOPMENT REPORT The Development Clerk was available to respond to questions. ARRIVED AT MEETING S. Simpson arrived at 10:01 a.m. The Development Clerk indicated that the R. Torkelson permit is a discretionary application and would be at the next MPC meeting. The Development Clerk added that the Home Occupation application was for a goat cheese/milk operation. MPC mentioned that the Nesbitt application is in Division 5, not Division 10 as shown on the report. 7. SUBDIVISIONS 7.1 2019-0-115 - NW1/4 36-16-13 W4M, To create one new parcel approximately 5.81 acres (2.353 ha) in size, containing an existing residence and improvements, from a previously unsubdivided quarter section for residential use. The County Planner provided background on the proposed subdivision application. There were no questions. P-76/19 MOVED BY COUNCILLOR HUBY KALLEN THAT the Country Residential subdivision of NW114 36-16-13-W4M (Certificate of Title No. 031 190 428), to create one new parcel approximately 5.81 acres (2.353 ha) in size, containing an existing residence and improvements, from a previously unsubdivided quarter section for residential use; BE APPROVED subiect to the following: CONDITIONS: 1. That, pursuant to Section 654(1)(d) of the Municipal Government Act, all outstanding property taxes shall be paid to the County of Newell. 2. That the applicant install a septic tank and field or other suitable private sewage disposal treatment system to replace the existing open discharge system that cannot meet the required 300 ft (90 m) setback from the new property lines as per the Alberta Private Sewage Systems Standard of Practice 2009. 3. That the applicant enter into an agreement with the County of Newell for the installation of any required road approaches to the proposed and/or remnant parcels. 6 MOTION CARRIED Page 2 of 4 Municipal Planning Commission October 10, 2019 7.2 2019-0-126 - SW1/4 35-19-15 W4M, To create one new parcel approximately 28.84 acres (11.67 ha) in size which has been fragmented by Highway 36 for the purposes of disposing of the land to the adjacent landfill site operated by Newell Regional Solid Waste Management Authority. The County Planner provided background information on the proposed subdivision application. L. Juss indicated that The Newell Regional Solid Waste Management Authority (NRSWMA) is also acquiring the parcel of land directly west of this parcel and inquired why the parcel wasn't included in this subdivision application. The Supervisor of Planning & Development commented that the parcel may not require subdividing and could therefore be sold to the NRSWMA as is. B. de Jong asked how the subdivided parcel will be utilized by the landfill. L. Juss explained that the subdivided parcel is required for improving access into the site. P-77/19 MOVED BY COUNCILLOR ANNE MARIE PHILIPSEN THAT the subdivision of SW1/4 35-19-15-W4M (Certificate of Title No. 981 224 742 +1), to create one new parcel approximately 28.84 acres (11.67 ha) in size for the purposes of disposing of the land to the adjacent landfill site operated by Newell Regional Solid Waste Management Authority; BE APPROVED subject to the following: RESERVE: The 10% reserve requirement, pursuant to Sections 666 and 667 of the Municipal Government Act, be provided as money in place of land on the 28.84 acres at the market value of $2000.00 per acre at a total of approximately $5,768.00 to be paid to the County of Newell. CONDITIONS: 1. That, pursuant to Section 654(1)(d) of the Municipal Government Act, all outstanding property taxes shall be paid to the County of Newell. 2. That, pursuant to Section 655(1)(b) of the Municipal Government Act, the applicant or owner or both enter into a Development Agreement with the County of Newell which shall be registered concurrently with the final plan against the title(s) being created. 3. That a 30-metre wide service road shall be dedicated by caveat located perpendicular and across the highway frontage of the parcel to be created to comply with Section 15(2) of the Subdivision and Development Regulation. The applicant should contact Alberta Transportation to finalize this condition. 4. That the applicant submit a copy of the Historical Resources Act approval prior to registration of the plan of subdivision. MOTION CARRIED 8.
