MINUTES 3.1 October 24, 2019 Meeting Minutes MOVED BY COUNCILLOR BRIAN DE JONG that the minutes of the October 24, 2019 Municipal Planning Commission meeting be adopted as presented. MOTION CARRIED Municipal Planning Commission November 7, 2019 4. CALL FOR POST AGENDA ITEMS The Chairman called for post agenda items. 5. ADOPTION OF AGENDA P-87/19 MOVED BY COUNCILLOR ANNE MARIE PHILIPSEN that the agenda be adopted as presented. MOTION CARRIED 6. DEVELOPMENT REPORT The Development Clerk was available to answer any questions. This item was accepted as information. 7. SUBDIVISIONS 7.1 2019-0-142 - Lot 1, Block 2, Plan 1312662 & Lot 2, Block 2, Plan 1312663 within NE % 2-17-13-W4M & S Y2 2-17-13-W4M, To reconfigure 2 existing titles by subdividing a 4.02 acre (1.63 ha) portion of Lot 1, Block 2, Plan 1312662 within the NE % 2-17-13 W4M containing a farmstead development, and consolidating the remaining 7.32 acre (2.96 ha) portion of land to the adjacent parcel, Lot 2, Block 2, Plan 1312663, to create a new agricultural parcel approximately 70.3 acres (28.45 ha) in size. The County Planner provided background information on the proposed subdivision application. There were no questions. P88/19 MOVED BY COUNCILLOR KELLY CHRISTMAN THAT the Agricultural & Country Residential subdivision of Lot 1, Block 2, Plan 1312662 & Lot 2, Block 2, Plan 1312663 within NE % 2-17-13-W4M & S'/2 2-17-13-W4M (Certificate of Title No. 131 261 300, 131 261 315), to reconfigure 2 existing titles by subdividing a 4.02 acre (1.63 ha) portion of Lot 1, Block 2, Plan 1312662 within the NE % 2-17-13 W4M containing a farmstead development, and consolidating the remaining 7.32 acre (2.96 ha) portion of land to the adjacent parcel, Lot 2, Block 2, Plan 1312663, to create a new agricultural parcel approximately 70.3 acres (28.45 ha) in size; BE APPROVED subject to the following: CONDITIONS: 1. That, pursuant to Section 654(1)(d) of the Municipal Government Act, all outstanding property taxes shall be paid to the County of Newell. 2. That, pursuant to Section 655(1)(b) of the Municipal Government Act, the applicant or owner or both enter into a Development Agreement with the County of Newell which shall be registered concurrently with the final plan against the title(s) being created. 3. That the residual portion of Lot 1, Block 2, Plan 1312662 be consolidated with the adjacent parcel legally known as Lot 2, Block 2, Plan 1312663 in a manner such that Page 2 of 4 (Y r� I ) Municipal Planning Commission November 7, 2019 the resulting Certificate of Title could not be subdivided without the approval of the Subdivision Authority. (7) MOTION CARRIED 8. DEVELOPMENT PERMITS 8.1 DP 2019086 - Parcel L, Plan 1089FV, Hamlet of Tilley, Public School - replacement and greenhouse for school use The Development Clerk provided background information on the proposed permit application. There were no questions. P-89/19 MOVED BY COUNCILLOR HUBY KALLEN That the Municipal Planning Commission APPROVE Development Permit 2019086 for the construction of a 25252 ft' (2346 m2) school and a 409 ft2 (38 m2) greenhouse for school use, on lands legally described as Parcel L, Plan 1089FV, Hamlet of Tilley. This development approval is subject to the conditions outlined below. DP 2019086 is Approved for the following reasons: 1. The proposed development complies with the Municipal Development Plan. 2. The Development Authority is satisfied that the proposed development is suitable for the purpose for which it is intended under the Public Service District (Schedule 2) and Use Specific Standards of Development (Schedule 4), as specified in the County �- of Newell Land Use Bylaw 1892-17. 3. No objections have been received from adjacent landowners or referral agencies with respect to the proposed development. Conditions of Development Approval a) This approval is effective as of November 28, 2019 (21-day appeal period). b) The development must be located as shown on the site plan approved with the application and submitted October 3, 2019. It must be built according to the description provided with this approval. Any changes shall require the written approval of the Development Authority. c) Any additional development shall require prior approval of a separate permit application. d) That the Developer enter into a Development Agreement with the County of Newell for any construction and connection to any infrastructure maintained by the County of Newell prior to commencing construction. e) That the following setbacks are maintained for this development: Front (west): 13 ft (4 m); variance from 25 ft (7.5 m) Side (north): 21 ft (6.4 m); variance from 25 ft (7.5 m) Side (south): 82 ft (25 m); variance from 100 ft (30 m) f) That there is a 10 ft (3 m) separation distance between the new building and any other buildings or structures on the parcel. g) That any dwelling/structure is located a minimum distance of 3 m (10 ft) from any right of way or easement on the parcel. h) That the existing school be removed upon occupancy of the new school. Page 3 of 4 Municipal Planning Commission November 7, 2019 i) That no part of the proposed school is used for living purposes. j) That the developer must start construction before November 28, 2020 and complete by November 28, 2021. In the event that these dates cannot be met, the developer CJ must apply for an extension and may be required to apply for a new permit. The proposed development must comply with: a) The provisions pertaining to the Public Service District and all relevant schedules, as outlined in the County of Newell Land Use Bylaw 1892-17. b) All Federal, Provincial and Municipal statutes, regulations, codes and standards. c) All Alberta Building Codes and Safety Codes, where applicable. MOTION CARRIED 9. POST AGENDA ITEMS There were no post agenda items. 10. IN CAMERA There were no in camera items. 11. QUESTION PERIOD 12.
