MUNICIPAL PLANNING COMMISSION MEETING
December 19, 2019
The regular Municipal Planning Commission Meeting of the County of Newell was held in the
County Office at Brooks, AB on Thursday, December 19, 2019 commencing at 10:02 a.m.

3.1 December 5, 2019 Meeting Minutes
P-101/19 MOVED BY COUNCILLOR LIONEL JUSS that the minutes of the December 5, 2019
Municipal Planning Commission meeting be adopted as presented.

5. ADOPTION OF AGENDA
P-102/19 MOVED BY COUNCILLOR ELLEN UNRUH that the agenda be adopted as presented.
MOTION CARRIED
6. SUBDIVISIONS
6.1 2019-0-160 - NW1/4 3-20-14-W4M, To create one new parcel approximately
5.01 acres (2.03 ha) in size, containing an existing residence, from a previously
unsubdivided quarter section for residential use.
The County Planner provided background information on the proposed
subdivision application.
There were no questions from MPC.
P-103/19 MOVED BY COUNCILLOR BRIAN DE JONG THAT the County Residential subdivision
of NW1/4 3-20-14-W4M (Certificate of title No. 741 056 494), to create one new parcel
approximately 5.01 acres (2.03 ha) in size, containing an existing residence, from a
previously unsubdivided quarter section for residential use; BE APPROVED subject to
the following:
CONDITIONS:
1. That, pursuant to Section 654(1)(d) of the Municipal Government Act, all outstanding
property taxes shall be paid to the county of Newell.
2. That, pursuant to Section 655(1)(b) of the Municipal Government Act, the applicant
or owner or both enter into a Development Agreement with the County of Newell
which shall be registered concurrently with the final plan against the title(s) being
created.
3. That the applicant disable the existing open discharge system on the parcel as it
cannot meet the required 300 ft. (90 m) setback from the new property lines as per
the Alberta Private Sewage Systems Stand of Practice 2015. Written confirmation
that the system is disabled must be submitted prior to finalization.

7. DEVELOPMENT PERMITS
7.1 DP 2019099 - Lot 1, Block 19, Plan 0413384, NE 1-21-16 W4M, Operation of a
Mobile Wild game trimming and processing business
The Director of Corporate Services explained that there had been a procedural
error with the motion made at the December 5, 2019 MPC meeting. The motion
changed the Home Occupation 2 permit that was presented to a Home
Occupation 3. The Development Permit is now considered void and the motion
will have to be rescinded. The Director of Corporate Services indicated that
Planning & Development will be presenting the Home Occupation 2 for a new
motion.

P-104/19 MOVED BY COUNCILLOR ANNE MARIE PHILIPSEN to RESCIND Resolution P-96/19
approving Development Permit 2019088.
MOTION CARRIED
The Supervisor of Planning & Development commented that the applicant had
been made aware of the procedural error and indicated that the applicant had no
concerns with the change and was agreeable with a Home Occupation 2 permit
as it was originally presented.
The Development Clerk provided background information on the proposed permit
application.
There were no questions from MPC.
P-105/19 MOVED BY COUNCILLOR Anne Marie Philipsen That the Municipal Planning
Commission APPROVE the Home Occupation 2 Permit 2019099 to operate a mobile
wildlife trimming and finishing business, on lands legally described as Lot 1, Block 19,
Plan 0413384, NE 1-21-16 W4M. This development approval is subject to the conditions
outlined below.
DP 2019099 is Approved for the following reasons:
1. The proposed development complies with the Municipal Development Plan.
2. The Development Authority is satisfied that the proposed development is suitable for
the purpose for which it is intended under the Single Lot Agricultural District
(Schedule 2), Standards of Development (Schedule 3) and Home Occupations
(Schedule 4 Section 9), as specified in the County of Newell Land Use Bylaw 1892-
17.
3. No objections have been received from adjacent landowners or referral agencies with
respect to the proposed development.
Conditions of Development Approval
a) This approval is effective as of January 9, 2020 (21-day appeal period).
b) That there are no more than 2 non-resident employees involved in the operation of this
business.
c) That any intensification of use must be reported to the Development Officer;
intensification of use may require re-evaluation of the permit and other further action.
The proposed development must comply with:
a) The provisions pertaining to the Single Lot Agriculture District and all relevant
schedules, as outlined in the County of Newell Land Use Bylaw 1892-17.
b) All Federal, Provincial and Municipal statutes, regulations, codes and standards.
c) All Alberta Building Codes and Safety Codes, where applicable.
MOTION CARRIED
