MUNICIPAL PLANNING COMMISSION MEETING
N January 9, 2020
The regular Municipal Planning Commission Meeting of the County of Newell was held in the
County Office at Brooks, AB on Thursday, January 9, 2020 commencing at 10:00 a.m.

SUBDIVISIONS
7.1 2019-0-168 - Area W, Plan 9712203 within NW114 & portions of the SE1/4,
SW1/4, & NE1/4 all within 19-17-12-W4M, To create three new parcels
approximately 32.15 acres (13.01 ha), 25.70 acres (10.40 ha) and 136.50 acres
(55.24 ha) in size, containing a water reservoir, existing residence and agricultural
land
The assistant County Planner provided background information on the proposed
subdivision application.
MPC asked how the value of the land for the Municipal Reserve (MR) was
decided. The assistant County Planner explained that there is a County policy in
place that specifies values assigned for land in various areas of the County.
MPC inquired about access into each individual proposed parcel. The assistant
County Planner explained that access to Lot 1, Block 1 and Lot 1, Block 2 would
be from existing approaches off the road plan on the south boundary of the
proposed lots. Access to Lot 1, Block 3 is currently through Lot 1, Block 2. The
assistant County Planner explained that an easement could be put in place to gain
access to the east parcel, however should ownership change there is legal access
to all parcels from the road to the south, there is no physical access to Lot 1, Block
3 at this time.
MPC asked for clarification on the reserve payment options presented. The
assistant County Planner expanded on the 3 reserve options. The Director of
Corporate Services indicated that the County is the owner of a portion of the lands
to be subdivided and the County should cover the cost of the reserve dedication
associated with the County owned portion. The assistant County Planner
recommended that Option 1 is the recommended option which would achieve that
outcome. The landowner would also pay a portion of the MR as money in lieu of
some of his land and a portion could be deferred by caveat on the other proposed
parcel.

portions of the SE1/4, SW1/4, & NE1/4 all within 19-17-12-W4M (Certificate of Title
No.111 219 102, 191 133 053 + 1, 131 329 771 +4, 151 249 391), to create three new
parcels approximately 32.15 acres (13.01 ha), 25.70 acres (10.40 ha) and 136.50
acres (55.24 ha) in size, containing a water reservoir, existing residence and
agricultural land; BE APPROVED subject to the following:
RESERVE: The 10% reserve requirement, pursuant to Sections 661 and 666 of the
Municipal Government Act, be provided as money in lieu of land on the
15.96 acre portion of Lot 1, Block 1 at market value of $4,000 per acre
(approximately $6,384) and defer the reserve requirement by caveat on
Lot 1, Block 2.
CONDITIONS:
1. That, pursuant to Section 654(1)(d) of the Municipal Government Act, all outstanding
property taxes shall be paid to the County of Newell.
2. That, pursuant to Section 655(1)(b) of the Municipal Government Act, the applicant
or owner or both enter into a Development Agreement with the County of Newell
which shall be registered concurrently with the final plan against the title(s) being
created.

10. QUESTION PERIOD
MPC inquired if there were laser pointers to use on the TV screen for better visuals. The
Director of Corporate Services explained that the red laser pointers were absorbed into
the screen, but he will investigate into finding something that will work.

Being that the agenda matters have been concluded the meeting adjourned at 10:15 a.m.
