HomeMy WebLinkAbout2020-04-09 Municipal Planning Commission (Regular) Minutes COUNTY OF NEWELL MUNICIPAL PLANNING COMMISSION MEETING April 9, 2020 The regular Municipal Planning Commission Meeting of the County of Newell was held in the County Office at Brooks, AB on Thursday, April 9, 2020 commencing at 10:02 a.m. Section 199 of the Municipal Government Act was followed with the CAO being the Designated Officer in attendance at County Council Chambers which was open to the public to view and listen to the meeting proceedings. Notice was posted on the front entrance advising the public of the meeting and Council and staff members joined in electronically through GoToMeeting. MEMBERS PRESENT: M. Douglass, Reeve C. Stanway, Brooks Bulletin ATTENDANCE: 1. CALL TO ORDER The Chairman called the meeting to order at 10:02 a.m. 2. EXCUSED FROM MEETING All members were present. 3. MINUTES 3.1 February 20, 2020 Meeting Minutes � Municipal Planning Commission April 9,2020 P-15/20 MOVED BY COUNCILLOR KELLY CHRISTMAN that the minutes of the February 20, 2020 Municipal Planning Commission meeting be adopted as presented. MOTION CARRIED 4. CALL FOR POST AGENDA ITEMS The Chairman called for post agenda items. 5. ADOPTION OF AGENDA P-16/20 MOVED BY COUNCILLOR ANNE MARIE PHILIPSEN that the agenda be adopted as presented. MOTION CARRIED 6. DEVELOPMENT REPORT The Development Clerk was available for questions from MPC. There were no questions, this item was accepted as information. 7. NEW BUSINESS 7.1 Ministerial Order 022/20 The Supervisor of Planning & Development provided background information. The Supervisor of Planning & Development explained that the Ministerial Order issued March 31, 2020 extended the finalization and appeal date for all development and subdivision applications to October 1, 2020. She commented that this has had a significant impact on the ability to approve any permits at this time, as any development authority decision can be appealed up until October 1, 2020. The Supervisor of Planning & Development said recommendations from the Oldman River Regional Services Commission (ORRSC) and Brownlee LLP is - to wait until Alberta Municipal Affairs has issued an amendment to the Order, which is expected in the next week or two. The Supervisor of Planning & Development indicated that she had spoken with Municipal Affairs and they are aware of the impact to developers and Municipal Affairs is working on an amendment to the Order. ARRIVED AT MEETING: H. Kallen arrived at 10:07 a.m. There was further discussion regarding the impact of the Ministerial Order. Reeve Douglass inquired on the ramifications of approving any development or subdivision applications and Councillor Hammergren commented if MPC approved the applications and an appeal was filed later, the applicant could be out all construction costs if they lost the appeal. There was further discussion. Page 2 of 4 � Municipal Planning Commission April 9,2020 The Manager of Planning, Development &Engineering indicated that we are still able to issue permits, but the applicant needs to be made aware of the possible ramifications. Councillor de Jong asked if MPC has an opportunity to make amendments to the deadline. The Manager of Planning, Development & Engineering commented that his understanding was a municipality doesn't have the right to dictate or specify appeal deadlines. The appeal deadline is October 1, as per the Ministerial Order. The County Planner emphasized that the order has set the deadline and the Municipality must follow it. A discussion followed on the incumbrances of the Ministerial Order. The County Planner commented that the applicants for subdivision files on the MPC agenda are fine with waiting as well. Councillor Christman stated that it would be appropriate to table all application decisions until the next MPC meeting. Councillor Fyfe asked why the order was put in place since it has such a negative impact on any development or business progress. MPC Chairman Amulung felt the reference to the October 1, 2020 deadline for appeals was likely an error that slipped through with the other items that had been included with the original Ministerial Order. The Development Clerk indicated that she has spoken to all the applicants and said they were all fine with waiting except for Mr. Sandau, who stated that he is willing to take the risk of appeal. There was further discussion. The Director of Corporate Services suggested that instead of making a decision on the application, MPC leaves it for two weeks. This will give an applicant the opportunity to decide whether to proceed without a permit, knowing that any work would be at their own risk and hopefully Municipal Affairs will have an amendment in place and the permit would then be subject to the standard appeal period. P-17/20 MOVED BY COUNCILLOR KELLY CHRISTMAN that Municipal Planning Commission TABLE the following applications until the next MPC meeting in anticipation that an amendment to the Ministerial Order will be issued prior to the meeting date, and the concern with the extended appeal date and exposure to possible appeals will be _ addressed: Subdivision files 2020-0-029, 2020-0-037, & 2020-0-039 Development Permit files DP 2020005 & DP 2020007.
