HomeMy WebLinkAbout2020-07-23 Municipal Planning Commission (Regular) MinutesCOUNTY OF NEWELL MUNICIPAL PLANNING COMMISSION MEETING July 23, 2020 The regular Municipal Planning Commission Meeting of the County of Newell was held in the County Office at Brooks, AB on Thursday, July 23, 2020 commencing at 10:01 a.m. The Chief Administrative Officer, being the Designated Officer for the County of Newell, attended at the County Council Chambers to allow members of the public to watch the livestream meeting proceedings. EXCUSED FROM MEETING All members were in attendance at this meeting. 3. MINUTES 3.1 July 9, 2020 Meeting Minutes P-47/20 MOVED BY COUNCILLOR HUBY KALLEN that the minutes of the July 9, 2020 Municipal Planning Commission meeting be adopted as presented. MOTION CARRIED Municipal Planning Commission July 23, 2020 4. CALL FOR POST AGENDA ITEMS The Chairman called for post agenda items. 5. ADOPTION OF AGENDA P-48/20 MOVED BY COUNCILLOR LIONEL JUSS that the agenda be adopted as presented. MOTION CARRIED 6. DEVELOPMENT PERMITS 6.1 DP 2020026 - NW 3-19-14 W4M, Installation of a roof mounted solar panel for residential use The Development Clerk provided background information on the proposed permit application. Councillor K. Christman inquired if the installation of solar panels on residential properties will be an approved use once the current Land Use Bylaw has been reworked. The Development Clerk replied that they would. P-49/20 MOVED BY COUNCILLOR KELLY CHRISTMAN That the Municipal Planning Commission APPROVE Development Permit 2020026, for the installation 694 ftz (64 m2) roof mounted solar panel on an existing shop for residential use on lands legally described as NW 3-19-14 W4M. This development approval is subject to the conditions outlined below. DP 2020026 is Approved for the following reasons: 1. The proposed development complies with the Municipal Development Plan. 2. The Development Authority is satisfied that the proposed development is suitable for the purpose for which it is intended under the Fringe District (Schedule 2) and Standards of Development (Schedule 3) as specified in the County of Newell Land Use Bylaw 1892-17. 3. No objections have been received from adjacent landowners or referral agencies with respect to the proposed development. Conditions of Development Approval a) This approval is effective as of August 13, 2020 (21-day appeal period). b) The development must be located as shown on the site plan approved with the application and submitted June 15, 2020. It must be built according to the description provided with this approval. Any changes shall require the written approval of the Development Authority. c) Any additional development shall require prior approval of a separate permit application. d) The Solar panels must be located such as they do not create undue glare on neighbouring parcels or public roadways. e) Solar panels must not extend beyond the outermost edge of the roof. f) The developer must start construction before August 13, 2021. In the event that this date cannot be met, the developer may be required to apply for a new permit. The proposed development must comply with: a) The provisions pertaining to the Fringe District and all relevant schedules, as outlined in the County of Newell Land Use Bylaw 1892-17. b) All Federal, Provincial and Municipal statutes, regulations, codes and standards. c) All Alberta Building Codes and Safety Codes, where applicable. MOTION CARRIED Page 2 of 5 Municipal Planning Commission July 23, 2020 6.2 DP 2020029 -Lot 1, Block 1, Plan 0714614, NW 34-18-15 W4M, Operation of an Intensive Horticultural Operation, specifically a Market Garden for commercial use The Development Clerk provided background information on the proposed permit application. Councillor B. de Jong inquired if there was a reason why the applicant pushed the opening date to August 15. The Development Clerk replied that those were the dates that the applicant requested. Councillor H. Kallen commented that the late winter and COVID-19, could have been contributing factors to the late start. Councillor A.M. Philipsen requested that any dates on the conditions should be removed. The Development Clerk indicated that start and end dates are not noted in the conditions. Councillor K. Christman indicated that there was a date of August 13 showing on the conditions. The Development Clerk replied August 13 is the final appeal day and must stay. P-50/20 MOVED BY COUNCILLOR LIONEL JUSS That the Municipal Planning Commission APPROVE Development Permit 2020029 for the operation of a market garden, on lands legally described as Lot 1, Block 1, Plan 0714614, NW 34-18-15 W4M. This development approval is subject to the conditions outlined below. DP 2020029 is Approved for the following reasons: 1. The proposed development complies with the Municipal Development Plan. 2. The Development Authority is satisfied that the proposed development is suitable for the purpose for which it is intended under the Single Lot Agricultural District (Schedule 2) and Moved -in Buildings (Schedule 4) as specified in the County of Newell Land Use Bylaw 1892- 17. 3. No objections have been received from adjacent landowners or referral agencies with respect to the proposed development. Conditions of Development Approval a) This approval is effective as of August 13, 2020 (21-day appeal period). b) The development must be located as shown on the site plan approved with the application and submitted June 18, 2020. It must be built according to the description provided with this approval. Any changes shall require the written approval of the Development Authority. c) Any additional development shall require prior approval of a separate permit application. d) That the two agricultural buildings are not for commercial use. e) That the following setbacks on all sides are maintained for this development: Front (north): 100 ft (30 m) as per Alberta Transportation Side (west): 100 ft (30 m) Side (east): 25 ft (7.6 m) Rear (south): 25 ft (7.6 m) The proposed development must comply with: a) The provisions pertaining to the Single Lot Agriculture District and all relevant schedules, as outlined in the County of Newell Land Use Bylaw 1892-17. b) All Federal, Provincial and Municipal statutes, regulations, codes and standards. c) All Alberta Building Codes and Safety Codes, where applicable. MOTION CARRIED Page 3 of 5 Municipal Planning Commission July 23, 2020 6.3 DP 2020030 - SW 13-22-17 W4M, Installation of a Manufactured 2 Home as a 2nd Dwelling on the parcel for residential use The Development Clerk provided background information on the proposed permit application. There were no questions. P-51/20 MOVED BY REEVE MOLLY DOUGLASS That the Municipal Planning Commission APPROVE Development Permit 2020030, for the installation of a 2004, 1216 ftz (113 mZ) manufactured home 2 with attached 200 ftZ (19 mZ) deck to be used as a 2nd dwelling on the site, on lands legally described as SW 13-22-17 W4M. This development approval is subject to the conditions outlined below. DP 2020030 is Approved for the following reasons: 1. The proposed development complies with the Municipal Development Plan. 2. The Development Authority is satisfied that the proposed development is suitable for the purpose for which it is intended under the Agricultural District (Schedule 2) and Standards of Development (Schedule 3) as specified in the County of Newell Land Use Bylaw 1892-17. 3. No objections have been received from adjacent landowners or referral agencies with respect to the proposed development. Conditions of Development Approval: a) This approval is effective as of August 13, 2020 (21-day appeal period). b) The development must be located as shown on the site plan approved with the application and submitted June 18, 2020. It must be built according to the description provided with this approval. Any changes shall require the written approval of the Development Authority. c) Any additional development shall require prior approval of a separate permit application. d) That there is a 10 ft (3 m) separation distance between the new dwelling and any other buildings or structures on the site. e) That the developer shall provide a $5000.00 security deposit, as the minimum required amount under County Land Use Bylaw 1892-17. Once the development has passed inspection by the County Safety Codes Officer (SCO), the security deposit will be refunded. f) The developer must start construction before August 13, 2021 In the event that this date cannot be met, the developer may be required to apply for a new permit. g) That the following setbacks on all sides are maintained for this development: Front (south): 100 ft (30 m) Side (west): 558 ft (80 m) as per Alberta Transportation Rear (north): 25 ft (7.6 m) Side (east): 25 ft (7.6 m) The proposed development must comply with: a) The provisions pertaining to the Agriculture District and all relevant schedules, as outlined in the County of Newell Land Use Bylaw 1892-17. b) All Federal, Provincial and Municipal statutes, regulations, codes and standards. c) All Alberta Building Codes and Safety Codes, where applicable. 7. M Philipsen inquired if there had been any updates with the Headgates. The Manager of Planning, Development & Engineering explained that a tender had been advertised and there had been seven (7) contractors on site to view. The Manager of Planning, Development & Engineering indicated that they are still working with the landowner. He added that there should be a firm tendered price for local improvements soon and the expectation is the utilities are to be relocated in August and September, although there have been issues with the timeline due to COVID-19. Councillor E. Unruh asked if this was just for road construction or additional work.
