HomeMy WebLinkAbout2020-09-24 Municipal Planning Commission (Regular) MinutesP-66120 COUNTY OF NEWELL MUNICIPAL PLANNING COMMISSION MEETING September 24, 2020 The regular Municipal Planning Commission Meeting of the County of Newell was held in the County Office at Brooks, AB on Thursday, September 24, 2020 commencing at 10:01 a.m. The Chief Administrative Officer, being the Designated Officer for the County of Newell, attended at the County Council Chambers to allow members of the public to watch the livestrearn meeting proceedings. CALL TO ORDER The Chairman called the meeting to order at 10:01 a.m. 2. EXCUSED FROM MEETING All members were present. 3. MINUTES 3.1 September 10, 2020 Meeting Minutes MOVED BY COUNCILLOR KELLY CHRISTMAN that the minutes of the September 10, 2020 Municipal Planning Commission meeting be adopted as presented. MOTION CARRIED No Municipal Planning Commission September 24, 2020 4. CALL FOR POST AGENDA ITEMS The Chairman called for post agenda items. 5. ADOPTION OF AGENDA P-67120 MOVED BY COUNCILLOR TRACY FYFE that the agenda be adopted as presented. MOTION CARRIED 6. SUBDIVISIONS 6.1 2020-0-063 - SE 31-20-14 W4M, The purpose of this application is to create one new parcel approximately ±1.866 hectares (±4.61 acres) in size. The parcel is fragmented from the quarter by Highway 550. The proposed subdivision is a vacant parcel currently used for grazing purposes. The Supervisor of Planning & Development provided background information on the proposed subdivision application. Councillor A.M. Philipsen asked for clarification on the difference between the Municipal Reserve (MR) and the Deferred Reserve Caveat. The Supervisor of Planning & Development explained that since this parcel is not the first parcel out of the quarter section, Municipal Reserve is applicable on the new parcel. The Supervisor of Planning & Development added that MPC could request that the Deferred Reserve on the original subdivided parcel be paid as well as the Municipal Reserve on the proposed parcel, which would leave no monies owing on either parcel. She indicated that MPC could just request that the MR be paid on the proposed parcel, leaving the Deferred Reserve Caveat in place on the remnant parcel. P-68120 MOVED BY COUNCILLOR LIONEL JUSS That the Municipal Planning Commission APPROVE the Subdivision of the SE 31-20-14W4M to create one new vacant parcel approximately t1.866 hectares (t4.61 acres) in size for agricultural use subject to the following conditions: MUNCIPAL RESERVE: Municipal Reserve be taken on the 1.866 hectare (4.61 acre) proposed parcel at $7000 per acre for a total of $3,227.00, and the Deferred Reserve Caveat registered on title for 5.005 hectare (12.37 acres) remain on title for the remainder of SE 31-20-14W4M. CONDITIONS: 1. That, pursuant to Section 654 (1)(d) of the Municipal Government Act, all outstanding property taxes be paid. DEVELOPMENT PERMITS 7.1 DP 2020063 - Lot 5, Block 11, Plan 6819ER, Tilley, Approval of existing Single - Family dwelling with detached garage and deck with a variance to the side yard setback and a variance to the setback between the house and the garage. Construction of an addition, specifically a screened in porch. The Development Clerk provided background information on the proposed permit application. There were no questions from MPC. P-69120 MOVED BY COUNCILLOR HUBY KALLEN That the Municipal Planning Commission APPROVE Development Permit 2020053 for the approval of an existing 1236 ft' (115 W) Single Family dwelling with a 572 ftZ (53 m2) attached garage and a 475 ft2 (44 mZ) back deck and a 100 ft' (9 mz) front deck with a variance to the side yard setback, as well as the construction of a 224 ft' (21 mz) addition, specifically a screened in back porch for residential use on lands legally described as Lot 5, Block 11, Plan 6819ER, Hamlet of Tilley. This development approval is subject to the conditions outlined below. DP 2020053 is Approved for the following reasons: 1. The proposed development complies with the Municipal Development Plan. 2. The Development Authority is satisfied that the proposed development is suitable for the purpose for which it is intended under the Hamlet Residential District (Schedule 2) as specified in the County of Newell Land Use Bylaw ##1892-17. 3. No objections have been received from adjacent landowners or referral agencies with respect to the proposed development. Conditions of Development Approval a) This approval is effective as of October 14, 2020. (21-day appeal period). b) The development must be located as shown on the site plan approved with the application and submitted August 24, 2020. It must be built according to the description provided with this approval. Any changes shall require the written approval of the Development Authority. c) Any additional development shall require prior approval of a separate permit application. d) That the property is not used for conducting a business or commercial operation without first obtaining the required permits. e) That the following setbacks on all sides are maintained for this development: Front (east): 20 ft (6.1 m) Side (south): 5 ft (1.5 m) Side (north): 1 ft (.3 m); variance from 5 ft (1.5 m) Rear (west): 20 ft (6.1 m) f) That the developer must start construction before October 14, 2021. In the event that this date cannot be met, the developer must apply for an extension and may be required to apply for a new permit. The proposed development must comply with: a) The provisions pertaining to the Hamlet Residential District and all relevant schedules, as outlined in the County of Newell Land Use Bylaw 1892-17. b) All Federal, Provincial and Municipal statutes, regulations, codes and standards.
