MINUTES 3.1 October 22, 2020 Meeting Minutes MOVED BY COUNCILLOR HUBY KALLEN that the minutes of the October 22, 2020 Municipal Planning Commission meeting be adopted as presented. a MOTION CARRIED Municipal Planning Commission November 5, 2020 4. CALL FOR POST AGENDA ITEMS The Chairman called for post agenda items. 5. ADOPTION OF AGENDA P-75120 MOVED BY COUNCILLOR ANNE MARIE PHILIPSEN that the agenda be adopted as presented. MOTION CARRIED 6. DEVELOPMENT REPORT There were no questions from MPC 7. SUBDIVISIONS 7.1 2020-0-064 - NE 02-16-16W4M, To create one new parcel, approximately t 1.882 ha (± 4.65 ac) in size, containing an existing farmstead, from a previously unsubdivided quarter section for residential use. The Supervisor of Planning & Development provided background information on the proposed subdivision application. There were no questions from MPC. P-76120 MOVED BY COUNCILLOR TRACY FYFE THAT the Residential subdivision of NE 2-16- 16W4M (Certificate of Title No. 181 232 211), to create one new parcel approximately ± 1.882 ha (± 4.65 ac) in size, containing an existing residence and improvements, from a previously unsubdivided quarter section for residential use be approved subject to the following: CONDITIONS: 1. That, pursuant to Section 654(1)(d) of the Municipal Government Act, all outstanding property taxes shall be paid to the County of Newell. MOTION CARRIED 7.2 2020-0-065 - SE 31-20-14W4M, The purpose of this subdivision is to reconfigure two (2) existing titles by subdividing a t 0.844 ha (t 2.09 ac) portion from the SE 31-20-14W4M to be consolidated with Block B, Plan 8010259 to create a new parcel approximately ± 3.887 ha (± 9.61 ac). No additional parcels will be created. The Supervisor of Planning & Development provided background information on the proposed subdivision application. Councillor L. Juss asked which option for the payment of Municipal Reserve owing the applicant was in favour of. The Supervisor of Planning & Development responded that the applicant would prefer to pay the least amount possible. She also stated that option 2 would be the Municipal Reserve option recommended by Page 2 of 4 Municipal Planning Commission November 5, 2020 staff. The Supervisor of Planning & Development added that the department is researching ways to refine the Municipal Reserve policy in attempts to remain consistent and keep the decision as straight forward as possible for MPC. Councillor B. de Jong requested clarification on the location of the parcel being subdivided. The Supervisor of Planning & Development clarified that the parcel is within the fringe IMDP area around of Duchess and not adjacent as she had previously indicated. P-77120 MOVED BY COUNCILLOR BRIAN DE JONG THAT the Agriculture and Country Residential subdivision of Plan 8010259, Block B and the SE 31-20-14W4M (Certificate of Title No. 201 063 244 & 061 432 681+1), to reconfigure two (2) existing titles by subdividing a 0.844 ha (2.09 ac) portion from the SE 31-20-14W4M to be consolidated with Plan 8010259, Block B, to create a new Country Residential parcel approximately 3.887 ha (9.61 ac) in size, be approved subject to the following: MUNICIPAL RESERVE: The 10% reserve requirement, pursuant to Sections 666 and 667 of the Municipal Government Act, be provided as money in place of land on the 0.844 ha (2.09 ac) proposed parcel for a total of $1463.00, and the Deferred Reserve Caveat registered on title for 5.005 ha (12.37 ac) remain on title for the remainder of SE 31-20-14W4M. CONDITIONS: 1. That, pursuant to Section 654(1)(d) of the Municipal Government Act, all outstanding property taxes shall be paid to the County of Newell. 2. That an easement agreement be established between the applicant and the adjacent landowner for the encroachment of the building and sheds on the western property line of the country residential parcel. 3. The subdivided parcel from the SE 31-20-14W4M be consolidated with Plan 8010259, Block B in a manner such that the resulting Certificate of Title could not be subdivided without the approval of the Subdivision Authority. MOTION CARRIED 8. POST AGENDA ITEMS There were no post agenda items. 9. IN CAMERA There were no in camera items. 10, QUESTION PERIOD Councillor C. Amulung inquired what MPC has done previously regarding the Municipal Reserve (MR). The Supervisor of Planning & Development replied that there is a municipal reserve policy that outlines the land values used to calculate the cash in lieu amount which is based in areas where the parcel is located The Supervisor of Planning & Development indicated that there is an opportunity to be more consistent with how the Page 3 of 4 ` Municipal Planning Commission November 5, 2020 MR is handled and the department is working on putting together a more coherent policy. Councillor T. Fyfe asked why Canada Post is now on the referral list for notifications. The Supervisor of Planning & Development commented that Canada Post has expressed an interest in being informed of any new parcels that may require a postal address. Councillor E. Unruh was curious to know where the MR payments go. The Supervisor of Planning & Development indicated that there is a specific account the monies are deposited in that can be used for school and playgrounds and various other uses set out in the MGA. The Director of Corporate Services added that the County is able to collect interest on the account as well as having the monies available for use for specific projects in the County. 11.
