COUNTY OF NEWELL
MUNICIPAL PLANNING COMMISSION MEETING
November 19, 2020
The regular Municipal Planning Commission Meeting of the County of Newell was held in the
County Office at Brooks, AB on Thursday, November 19, 2020 commencing at 10:00 a.m.
A notice was posted at the front entrance advising the public of the meeting. There were no
members of the public physically in attendance.

The Chairman called the meeting to order at 10:00 a.m.

3.1 November 5, 2020 Meeting Minutes
MOVED BY COUNCILLOR KELLY CHRISTMAN that the minutes of the November 5,
2020 Municipal Planning Commission meeting be adopted as presented.

4. CALL FOR POST AGENDA ITEMS
The Chairman called for post agenda items.
5. ADOPTION OF AGENDA
P-79120 MOVED BY COUNCILLOR ANNE MARIE PHILIPSEN that the agenda be adopted as
presented.

6. SUBDIVISIONS
6.1 2020-0-067 - NE 23-18-16W4M, The purpose of this application is to reconfigure
2 existing titles by subdividing a t0.667 ha (t1.65 ac) portion of Block 1, Plan
9811976 within the NE 23-18-15W4M containing a farmstead development and
consolidating the remaining t2.703 ha (t6.68 ac) portion to the adjacent NE 23-
18-15W4M.
The Supervisor of Planning & Development provided background information on
the proposed subdivision application.
The Supervisor of Planning & Development recommended that a condition be
added requiring the developer to submit copies of any easements, utility right of
ways and/or agreements to the Planning & Development department for
registration with the subdivision with Alberta Land Titles office.
Councillor W. Hammergren asked what would happen if there is an abandoned
well within the proposed subdivision parcel. The Supervisor of Planning &
Development indicated that setbacks would be required as well as approval from
the Alberta Energy Regulator (AER).
Councillor A.M. Philipsen inquired about the moveable shed located on the
property and mentioned that at one time she thought it had been used as a living
space. The Supervisor of Planning & Development replied she was not aware if
that was the case but indicated that a condition could be added restricting the use
of the shed.
Councillor K. Christman asked if the County holds any responsibility to the use of
cisterns. The Supervisor of Planning & Development commented that in the case
of this subdivision with an existing farmstead, any cisterns would be
grandfathered in. The Supervisor of Planning & Development added that if any
changes were made, the applicant would be required to apply for permits.
Councillor L. Juss indicated that since the County is unsure about the intentions
of how any of the buildings will be used, conditions should not be added to the
decision.
P-80120 MOVED BY COUNCILLOR LIONEL JUSS THAT the Country Residential subdivision to
reconfigure 2 existing titles by subdividing a t0.667 ha (t1.65 ac) portion of Block 1,
Plan 9811976 (Certificate of Title No. 201 167 966) within the NE 23-18-15W4M
containing a farmstead development and consolidating the remaining t2.703 ha (t6.68
ac) portion to the adjacent NE 23-18-15W4M (Certificate of Title No. 181 224 541) be
approved subject to the following:
CONDITIONS:
1. That, pursuant to Section 654(1)(d) of the Municipal Government Act, all outstanding
property taxes shall be paid to the County of Newell.
2. The developer is required to supply copies of any utility right of way plans,
easements, and/or agreements which are to be registered as a requirement for any
affected utilities to the County prior to the subdivision's registration with Alberta Land
Titles.
3. That the residual portion of Block 1, Plan 9811976 be consolidated with the adjacent
parcel legally known as the NE 23-18-15W4M in a manner such that the resulting
Certificate of Title could not be subdivided without the approval of the Subdivision
Authority.
