HomeMy WebLinkAbout2020-12-10 Municipal Planning Commission (Regular) Minutes COUNTY OF NEWELL MUNICIPAL PLANNING COMMISSION MEETING December 10, 2020 The regular Municipal Planning Commission Meeting of the County of Newell was held in the County Office at Brooks, AB on Thursday, December 10, 2020 commencing at 10:01 a.m. A notice was posted at the front entrance advising the public of the meeting. CALL TO ORDER The Chairman called the meeting to order at 10:01 a.m. 2. EXCUSED FROM MEETING All members were present. 3. MINUTES 3.1 November 19, 2020 Meeting Minutes Municipal Planning Commission December 10,2020 P-81/20 MOVED BY COUNCILLOR HUBY KALLEN that the minutes of the November 19, 2020 Municipal Planning Commission meeting be adopted as presented. MOTION CARRIED 4. CALL FOR POST AGENDA ITEMS The Chairman called for post agenda items. 5. ADOPTION OF AGENDA P-82-20 MOVED BY COUNCILLOR TRACY FYFE that the agenda be adopted as presented. MOTION CARRIED 6. DEVELOPMENT REPORT The Development Clerk was available to respond to questions. This item was accepted as information. 7. SUBDIVISIONS 7.1 2020-0-058 - NW 6-21-15W4M, The purpose of this application is to create one new parcel, approximately 1.852 hectares (4.58 acres) in size, containing an existing residence and improvements. The Supervisor of Planning & Development provided background information on the proposed subdivision application. Councillor C. Amulung asked if there was a right-of-way(ROVI� or access into the sewage/agoons. The Supervisor of Planning &Development indicated that there is a Utility ROW on the Certificate of Title (CoT) allowing access into the sewage /agoons. P-83/20 MOVED BY COUNCILLOR ELLEN UNRUH THAT the Residential subdivision of NW 6- 21-15W4M (Certificate of Title No. 201 066 046), to create one new parcel, approximately 1.852 hectares (4.58 acres) in size, containing an existing residence and improvements for residential use be approved subject to the following: CONDITIONS: 1. That, pursuant to Section 654(1)(d) of the Municipal Government Act, all outstanding property taxes shall be paid to the County of Newell. 2. The developer is required to supply copies of any utility right of way plans, easements, and/or agreements which are to be registered as a requirement for any affected utilities to the County prior to the subdivision's registration with Alberta Land Titles. MOTION CARRIED 8. DEVELOPMENT PERMITS 8.1 DP 2020075 - Lot 2, Block 2, Plan 0011361, SE 18-19-14 W4, Operation of a cannabis extraction facility for commercial use. Page 2 of 4 Municipal Planning Commission December 10,2020 The Development Clerk provided background information on the proposed development permit application. Mr. Fischer, Uplifted Kanab Director& Senior Advisor, provided an overview of the organization and project. Mr. Fischer indicated that as per Health Canada regulations, the company was required to install a 6-foot fence with wire along the top and security cameras installed around the facility. Mr. Fischer commented that currently the water on the property is by cistern and is not connected to the rural water system. He indicated that the organization plans to approach their neighbour for water line access, but since abnormal water usage is not anticipated, the facility can continue to operate off the cistern. Councillor K. Christman asked why the County would relax the setbacks to allow for a fence along the property line. Mr. Fischer replied that he was unaware setbacks would be required and indicated that the fence could be moved further inside the property line, but currently, the existing fence does not meet Health Canada regulations. The Development Clerk added that since Health Canada has such strict requirements and there were no responses from adjacent landowners, the department is requesting a variance to allow for the new fence. Councillor 8. de Jong inquired on the time frame of getting the facility operational. Mr. Fischer replied that they will take possession of the building January 4, 2021, install the fence and security cameras, then apply to Health Canada for their license to operate. Only once approval has been received, can they begin the operation. Mr. Fischer indicated that no work is allowed to be done until Health Canada has approved the application. P-84/20 MOVED BY COUNCILLOR ELLEN UNRUH That the Municipal Planning Commission APPROVE Development Permit 2020075 for the operation of a cannabis extraction facility in an existing 12059 ftz (1120 mz) shop, on lands legally described as Lot 2, Block 2, Plan 0011361, SE 18-19-14 W4M. This development approval is subject to the conditions outlined below. DP 2020075 is Approved for the following reasons: 1. The proposed development complies with both the Municipal Development Plan and the Intermunicipal Development Plan. 2. The Development Authority is satisfied that the proposed development is suitable for the purpose for which it is intended under the Rural Business District (Schedule 2), as specified in the County of Newell Land Use Bylaw 1892-17. 3. No objections have been received from adjacent landowners or referral agencies with respect to the proposed development. Conditions of Development Approval a) This approval is effective as of December 30, 2020 (21-day appeal period). b) The development must be located as shown on the site plan approved with the application and submitted November 3, 2020. It must be built according to the description provided with this approval. Any changes shall require the written approval of the Development Authority. Page 3 of 4 Municipal Planning Commission December 10,2020 c) Any additional development shall require prior approval of a separate permit application. d) That the applicant or owner provide a copy of the current license for all activities associated with the medical marijuana production as issued by Health Canada, prior to production commencing at the facility. e) That there is no outdoor storage of goods, materials or supplies. fl That the applicant provide 17 parking spots. g) That the development must include equipment designed and intended to remove odours and particulates from the air where it is discharged from the building as part of the ventilation system. h) That access can be provided for Emergency Services vehicles to the east, west and south sides of the building. i) The developer must commence operation before December 30, 2022. In the event � that this date cannot be met, the developer may be required to apply for a new permit. The proposed development must comply with: a) The provisions pertaining to the Rural Business District and all relevant schedules, as outlined in the County of Newell Land Use Bylaw 1892-17. b) All Federal, Provincial and Municipal statutes, regulations, codes and standards. c) All Alberta Building Codes and Safety Codes, where applicable.
