HomeMy WebLinkAbout2021-03-25 Municipal Planning Commission (Regular) MinutesCOUNTY OF NEWELL MUNICIPAL PLANNING COMMISSION MEETING March 25, 2021 The regular Municipal Planning Commission Meeting of the County of Newell was held in the County Office at Brooks, AB and livestreamed to the public via Lifesize on Thursday, March 25, 2021 commencing at 10:05 a.m. A notice was posted at the front entrance advising the public of the meeting. CALL TO ORDER The Vice MPC Chairman called the meeting to order at 10:05 a.m. 2. EXCUSED FROM MEETING There were no members excused from the meeting. 3. MINUTES 3.1 Minutes - Municipal Planning Commission (March 11, 2021) Municipal Planning Commission March 25, 2021 P-26121 MOVED BY COUNCILLOR HUBY KALLEN that the minutes of the March 11, 2021 Municipal Planning Commission meeting be adopted as presented. MOTION CARRIED 4. CALL FOR POST AGENDA ITEMS The Chairman called for post agenda items. 5. ADOPTION OF AGENDA P-27121 MOVED BY COUNCILLOR ANNE MARIE PHILIPSEN that the agenda be adopted as presented. MOTION CARRIED 6. DEVELOPMENT PERMITS 6.1 DP 2021011 - Lot 2, Block 1, Plan 8810971, SE 3-19-14 WW, Approval of existing accessory building with variance to setback , The Development Clerk provided background information on the proposed permit application. The Development Clerk commented that there was an error in the conversion from metric and the applicant was requesting an 91 ft variance to the south side. There were no questions from MPC. P-27121 MOVED BY REEVE MOLLY DOUGLASS That the Municipal Planning gommission APPROVE Development Permit 2021011, for the approval of an existing 384 ft2 (36 m2) accessory building with a variance to the side yard setback, on lands legally described as Lot 2, Block 1, Plan 8810971, SE 3-19-14 W4M. This development approval is subject to the conditions outlined below. DP 2021011 is Approved for the following reasons: 1. The proposed development complies with the Municipal Development Plan. 2. The Development Authority is satisfied that the proposed development is suitable for the purpose for which it is intended under the Acreage Residential Dastrict (Schedule 2) and Standards of Development (Schedule 4) as specified in the County of Newell Land Use Bylaw 1892-17. 3. No objections have been received from adjacent landowners or referral agencies with respect to the proposed development. Conditions of Development Approval: a) This approval is effective as of April 14, 2021 (21-day appeal period) The development must be located as shown on the site plan approved with the application and submitted February 18, 2021. b) Any additional development shall require prior approval of a separate permit application. c) That the property is not used for conducting a business or commercial operation without first obtaining the required permits. Page 2 of 5 Municipal Planning Commission March 25, 2021 d) That the following setbacks are maintained for this development: Front (west): 50 ft (15.2 m) Side (south): 11 ft (3.3 m); variance from 25 ft (7.6 m) to 14 ft (4 m) Rear (east): 25 ft (7.6 m) The proposed development must comply with: a) The provisions pertaining to the Acreage Residential District and all relevant schedules, as outlined in the County of Newell Land Use Bylaw 1892-17. b) All Federal, Provincial and Municipal statutes, regulations, codes and standards. c) All Alberta Building Codes and Safety Codes, where applicable. MOTION CARRIED LEFT THE MEETING G. Huber left at 10:09 a. m. 6.2 IJ-P 2021013 - Lot 7, Block 3, Plan 0910886, NW 12-20-16 W4M, Home Occupation for a mobile and sandblasting business The Development Clerk provided background information on the proposed permit application. MPC raised a question regarding the use and the intent of the Development Permit. If the applicant was only using their residence to store items related to the business, why was the permit for a mobile paint and sandblasting operation and not just for storage. The Development Clerk commented that this application came to the attention of the Planning & Development department as an enforcement issue. Permitting it as a Home Occupation would allow the applicant to operate the mobile business within the County but under specific conditions. A. discussion followed regarding notification of landowners adjacent to the locations that the work will be conducted. The Supervisor of Planning & Development commented that most of the work being done would be in remote locations or inside a building. MPC noted there should be minimal concems as the conditions listed cover most of the concerns. ARRIVED AT MEETING C. Amulung arrived:at 10:14 a.m. x The applicant, B. Shiller, assured MPC that he takes all neighbours concerns into account and informs all nearby residents of any work going on in their area. P-28121 MOVED 8Y COUNCILLOR BRIAN DE JONG That the Municipal Planning Commission APPROVE the Home Occupation Permit 2021013 to approve an existing mobile paint and sandblast business, on lands legally described as Lot 7, Block 3, Plan 0910885, NW 12-20-15 W4M. This development approval is subject to the conditions outlined below. DP 2021013 is Approved for the following reasons: 1. The proposed development complies with the Municipal Development Plan. 2. The Development Authority is satisfied that the proposed development is suitable for the purpose for which it is intended under the Acreage Residential District (Schedule Page 3 of 5 Municipal Planning Commission March 25, 2021 1 2), Standards of Development (Schedule 3) and Home Occupations (Schedule 4 Section 9), as specified in the County of Newell Land Use Bylaw 1892-17. 3. No objections have been received from adjacent landowners or referral agencies with respect to the proposed development. Conditions of Development Approval a) This approval is effective as of April 14, 2021 (21-day appeal period), b) Any additional development shall require prior approval of a separate permit application. c) That there be no painting or sandblasting done on the residence parcel. d) Where the sandblasting is located within 492 ft (150 m) of an existing residential use or residential park, conservation, or institutional use the operations must be done in a fully contained building designed to contain noise, odours and dust. In all instances, the building or structure containing the approved sandblasting operation shall be located no closer than 295 ft (90 m) to an adjacent residence. e) That painting is not permitted within 250 ft (75 m) of the boundary of any acreage residential or grouped rural residential land use district, or within 328 ft (100 m) from an existing residential dwelling, whichever distance is greater. f) That substances shall not be released in the air that will or may cause a significant adverse effect. g) That all materials used in the business are stored and disposed of properly. h) That there are no more than 2 resident employees involved in the operation of this business. i) That there is no outdoor storage, all equipment will be stored inside a trailer or building. The proposed development must comply with: a) The provisions pertaining to the Acreage Residential District and all relevant schedules, as outlined in the County of Newell Land Use Bylaw 1892-17. b) All Federal, Provincial and Municipal statutes, regulations, codes and standards. c) All Alberta Building Codes and Safety Codes, where applicable. MOTION CARRIED LEFT THE MEETING B. Shiller left 10:23 a.m. 7. POST AGENDA ITEMS There were no post agenda items. 8. IN CAMERA There were no in camera items. 9. INFORMATION ITEMS The Supervisor of Planning & Development provided background information on the NRCB applications. MPC also noted that one of the applications had Cypress County listed instead of County of Newell. ARRIVED AT MEETING L. Juss arrived at 10:28 a.m. P-29121 MOVED BY COUNCILLOR KELLY CHRISTMAN that the NRBC applications be accepted as information and that the response to the applications be sent to the NRCB as presented.
