MINUTES 3.1 April 9, 2015 Meeting Minutes P-35115 MOVED BY COUNCILLOR ANNE MARIE PHILIPSEN that the minutes of the April 9, 2015 Municipal Planning Commission meeting be adopted as presented. MOTION CARRIED 4. CALL FOR POST AGENDA ITEMS The Chairman called for post agenda items. Municipal Planning Commission April 23, 2015 5. ADOPTION OF AGENDA P-36/15 MOVED BY COUNCILLOR ELLEN UNRUH that the agenda be adopted as presented. MOTION CARRIED 6. DEVELOPMENT PERMITS 6.1 DP 3944 - NW 8-23-18-W4 - Construction of a multi -unit dwelling The Development Clerk provided background information on the proposed development permit and responded to questions. P-37/15 MOVED BY COUNCILLOR LIONEL JUSS that the Municipal Planning Commission APPROVE Development Permit #3944 for the construction of a new 12,288 ft2 (1142 m2) multi -unit dwelling, subject to the following conditions: This permit is being granted only to provide approval for the construction of a new 12,288 ft2 (1142 m2) multi -unit dwelling, on lands legally described as NW 8-23-18 W4M. Any additional development shall require prior approval of a separate permit application. The proposed development complying with: 1. The provisions pertaining to the Agricultural District and all relevant schedules, as outlined in the County of Newell Land Use Bylaw #1755-12. 2. All Federal, Provincial and Municipal statutes, regulations, codes and standards. 3. All Alberta Building Codes and Safety Codes, where applicable. Reasons for Approval The Municipal Planning Commission has approved DP #3944 for the following reasons: 1. The proposed development complies with the Municipal Development Plan. 2. The Development Authority is satisfied that the proposed development is suitable for the purpose for which it is intended under the Agricultural District (Schedule 2) and Standards of Development (Schedule 3) as specified in the County of Newell Land Use Bylaw #1755-12. 3. No objections have been received from adjacent landowners or referral agencies with respect to the proposed development. Conditions of Development 1. That this development is located as shown on the site plan approved in this application and submitted February 24, 2015. Any changes to that plan shall require the written approval of the Development Officer. 2. That the property is not used for conducting a business or commercial operation without first obtaining the required permits. 3. That there is a 10 ft (3 m) separation distance between the new building and any other buildings or structures. 4. The developer must start construction before May 7, 2016. In the event that this date cannot be met, the developer may be required to apply for a new permit. 5. That the following setbacks on all sides are maintained for this development: Page 2 of 7 Municipal Planning Commission April 23, 2015 Front (west): 100 ft (30 m) Side (north and south): 25 ft (7.6 m) Rear (east): 25 ft (7.6 m) MOTION CARRIED 6.2 DP 3949 - SW 31-17-12-W4 - Installation of a moved -in building to be used as an office trailer The Development Clerk provided background information on the proposed development permit and responded to questions. Councillor A.M. Philipsen suggested that the addition of an office be considered for a permitted use during the upcoming Land Use Bylaw discussions. P-38/15 MOVED BY COUNCILLOR KELLY CHRISTMAN that the Municipal Planning Commission APPROVE the assertion that the moved -in office trailer is `similar to' a moved -in dwelling, with the removal of the sleeping areas; further, that the Municipal Planning Commission APPROVE Development Permit #3949, for the installation of a 1400 ft2 (130 m2) moved in building to be used as an office trailer on the battery site, subject to the following conditions: This permit is being granted only to provide approval for the installation of a 1400 ft2 (130 m2) office trailer on the battery site, on lands legally described as SW 31-17-12 W4M. Any additional development shall require prior approval of a separate permit application. The proposed development complying with: 1. The provisions pertaining to the Agricultural District and all relevant schedules, as outlined in the County of Newell Land Use Bylaw #1755-12. 2. All Federal, Provincial and Municipal statutes, regulations, codes and standards. 3. All Alberta Building Codes and Safety Codes, where applicable. Reasons for Approval The Municipal Planning Commission has approved DP #3949 for the following reasons: 1. The proposed development complies with the Municipal Development Plan. 2. The Development Authority is satisfied that the proposed development is suitable for the purpose for which it is intended under the Agricultural District (Schedule 2) and Standards of Development (Schedule 3) as specified in the County of Newell Land Use Bylaw #1755-12. 3. No objections have been received from adjacent landowners or referral agencies with respect to the proposed development. Conditions of Development 1. That this development is located as shown on the site plan approved in this application and submitted March 18, 2015. Any changes to that plan shall require the written approval of the Development Officer. 2. That there is a 10 ft (3 m) separation distance between the new building and any other buildings or structures. 3. That the proposed moved -in office trailer is not used for living purposes. In the event that this date cannot be met, the developer may be required to apply for a new permit. 5. That the following setbacks on all sides are maintained for this development: Side (north and south): 25 ft (7.6 m) Rear (east): 25 ft (7.6 m) Front (west): 279 ft (85 m) Alberta Transportation approval MOTION CARRIED 6.3 DP 3951 - Lot 9, Block 1, Plan 8310515 (NE 8-19-14-W4) - Construction of a residential accessory building (garage) The Development Clerk provided background information on the proposed development permit and responded to questions. P-39/15 MOVED BY COUNCILLOR TRACY FYFE that the Municipal Planning Commission APPROVE Development Permit #3951 for the construction of a residential accessory building, subject to the following conditions: This permit is being granted only for the construction of an 768 ft2 (71 m2) residential accessory building, on lands legally described as Lot 9, Block 1, Plan 8310515, NE 8-19-14 W4M. Any additional development shall require prior approval of a separate permit application. The proposed development complying with: 1. The provisions pertaining to the Direct Control District and all relevant schedules, as • outlined in the County of Newell Land Use Bylaw #1755-12. 2. All Federal, Provincial and Municipal statutes, regulations, codes and standards. 3. All Alberta Building Codes and Safety Codes, where applicable. r 4. It is responsibility of the developer to obtain all permits from an accredited inspection agency. Reasons for Approval The Municipal Planning Commission has approved DP #3951 for the following reasons: 1. The proposed development complies with both the Municipal Development Plan and the Intermunicipal Development Plan. 2. The Development Authority is satisfied that the proposed development is suitable for the purpose for which it is intended under the Direct Control District (Schedule 2) and the Standards of Development (Schedule 4), as specified in the County of Newell Land Use Bylaw #1755-12. 3. No objections have been received from adjacent landowners or referral agencies with respect to the proposed development. Conditions of Development 1. That this development is located as shown on the site plan approved in this application and submitted March 23, 2015. Any changes to that plan shall require the written approval of the Development Officer. 2. That there is a 10 ft (3 m) separation distance between the new building and any other buildings or structures on the parcel. 4. That the proposed building is not used for living purposes. 5. The developer must start construction before May 7, 2016, if this date is not met, the developer may be required to apply for a new permit. MOTION CARRIED 6.4 DP 3953 - SE 17-21-16-W4 - Installation of a 2nd Dwelling The Development Clerk provided background information on the proposed development permit and responded to questions. Councillor E. Unruh asked about the criteria for allowing a second dwelling on a parcel. The Director of Corporate Services replied that this is generally seen in larger parcels where a second dwelling is required for hired help for farm operations. P-40/15 MOVED BY COUNCILLOR ELLEN UNRUH that the Municipal Planning Commission APPROVE Development Permit #3953, for the installation of a 1088 ft2 (101 m2) 2006 manufactured dwelling, to be used as a second dwelling on the farm site, subject to the following conditions: This permit is being granted only to provide approval for the installation of a 1088 ft2 (101 m2) 2006 manufactured dwelling, to be used as a second dwelling on the farm site, on lands legally described as SE 17-21-16 W4M. Any additional development shall require prior approval of a separate permit application. The proposed development complying with: 1. The provisions pertaining to the Agricultural District and all relevant schedules, as outlined in the County of Newell Land Use Bylaw #1755-12. 2. All Federal, Provincial and Municipal statutes, regulations, codes and standards. 3. All Alberta Building Codes and Safety Codes, where applicable. Reasons for Approval The Municipal Planning Commission has approved DP #3953 for the following reasons: 1. The proposed development complies with the Municipal Development Plan. 2. The Development Authority is satisfied that the proposed development is suitable for the purpose for which it is intended under the Agricultural District (Schedule 2) and Standards of Development (Schedule 3 & 4) as specified in the County of Newell Land Use Bylaw #1755-12. 3. No objections have been received from adjacent landowners or referral agencies with respect to the proposed development. Conditions of Development That this development is located as shown on the site plan approved in this application and submitted March 25, 2015. Any changes to that plan shall require the written approval of the Development Officer. 1. That the property is not used for conducting a business or commercial operation without first obtaining the required permits. 2. The developer must start construction before May 7, 2016. In the event that this date cannot be met, the developer may be required to apply for a new permit. 4. That the following setbacks on all sides are maintained for this development: Front (south): 315 ft (96 m) as set by Alberta Transportation Side (east & west): 25 ft (7.6 m) Rear (north): 25 ft (7.6 m) MOTION CARRIED 6.5 DP 3955 - Block 2, Plan 0011250 (SE 8-19-14-W4) - Construction of a garage The Development Clerk provided background information on the proposed development permit and responded to questions. P-41/15 MOVED BY COUNCILLOR WAYNE HAMMERGREN that the Municipal Planning Commission APPROVE DP #3955, for the construction of a 1500 ft2 (139 m2) garage with a 5 ft (1.5 m) variance to the side yard setback, subject to the following conditions: This permit is being granted only for the construction of a 1500 ft2 (139 m2) garage with a 5 ft (1.5 m) variance to the side yard setback, on lands legally described as Block 2, Plan 0011250, SE 8-19-14 W4M. Any additional development shall require prior approval of a separate permit application The proposed development complying with: 1. The provisions pertaining to the Fringe District and all relevant schedules, as outlined in the County of Newell Land Use Bylaw #1755-12. 2. All Federal, Provincial and Municipal statutes, regulations, codes and standards. 3. All Alberta Building Codes, and Safety Codes, where applicable. Reasons for Approval The Municipal Planning Commission has approved DP #3955 for the following reasons: 1. The proposed development complies with the Municipal Development Plan. 2. The Development Authority is satisfied that the proposed development is suitable for the purpose for which it is intended under Schedule 4 in the County of Newell Land Use Bylaw #1755-12. 3. No objections have been received from adjacent landowners or referral agencies with respect to the proposed development. Conditions of Development 1. That this development is located as shown on the site plan approved in this application and submitted March 27, 2015. Any changes to that plan shall require the written approval of the Development Officer. 2. That the property is not used for conducting a business or commercial operation without first obtaining the required permits. 3. That there is a 10 ft (3 m) separation distance between the new building and any other buildings or structures. 4. That the proposed accessory building (garage) is not used for living purposes. 5. The developer must start construction before May 7, 2016. In the event that this date cannot be met, the developer may be required to apply for a new permit. 6. MOTION CARRIED Councillor B. de Jong requested clarification regarding the process for requesting additional information regarding a development permit that is to be discussed during a Municipal Planning Commission meeting. Councillor G. Simpson provided background information, indicating that staff had requested his comments. He acknowledged that decisions must be made based on common information. 12.
