HomeMy WebLinkAbout2021-12-09 Municipal Planning Commission (Regular) MinutesCounty of Newell Meeting Minutes Municipal Planning Commission December 9, 2021 - 10:01 AM The regular Municipal Planning Commission Meeting of the County of Newell was held in the County Office at Brooks, AB and livestreamed to the public via Lifesize on Thursday, December 9, 2021 commencing at 10.01 a.m. A notice was posted at the front entrance advising the public of the meeting. CALL TO ORDER The Chairman called the meeting to order at 10:01 a.m. 2. EXCUSED FROM MEETING All members were present. 3. MINUTES 3.1 Minutes - Municipal Planning Commission (November 18, 2021) P-103121 MOVED BY COUNCILLOR ELLEN UNRUH that the minutes of the November 18, 2021, Municipal Planning Commission meeting be adopted as presented. MOTION CARRIED k-- Municipal Planning Commission December 9, 2021 4. CALL FOR POST AGENDA ITEMS The Chairman called for post agenda items. 5. ADOPTION OF AGENDA P-104121 MOVED BY COUNCILLOR HOLLY JOHNSON that the agenda be adopted as presented. MOTION CARRIED 6. DEVELOPMENT REPORT The Development Clerk was available to respond to questions. This item was accepted as information. 7. DEVELOPMENT PERMITS 7.1 DP 2021098 - E 36-20-15 W4M, Home Occupation 2 for the operation of a Dog Grooming business. The Development Clerk provided background information on the proposed permit application. MPC inquired on the wording that was used by the Village of Duchess in their response, referencing the previous Land Use Bylaw 1892-17. The Supervisor of Planning & Development explained that the land surrounding the Village of Duchess is under dispute and County staff is unsure which lands are affected. The Supervisor of Planning & Development indicated that County staff is working with the Village of Duchess to determine which lands are being affected by the dispute and the conditions as they are written, will satisfy both Land Use Bylaws. MPC asked the applicant if there are provisions to keep pets outside if they are not picked up. The applicant indicated that she tries to do one client at a time and if the client is late in picking up their pet, she has a spare kennel inside she would keep the animal in. The applicant indicated that at no time will any animals be kept outside. P-105121 MOVED BY COUNCILLOR NEIL JOHNSON That the Municipal Planning Commission APPROVE the Home Occupation Permit 2021098 to establish a dog grooming business, on lands legally described as E 36-20-15 W4M. This development approval is subject to the conditions outlined below. DP 2021098 is Approved for the following reasons: 1. The proposed development complies with the Municipal Development Plan. 2. The Development Authority is satisfied that the proposed development and that it is suitable for the purpose for which it is intended under the County of Newell Land Use Bylaw. Page 2 of 3 V Municipal Planning Commission December 9, 2021 3. No objections have been received from adjacent landowners or referral agencies with respect to the proposed development. Conditions of Development Approval a) This approval is effective as of December 29, 2021 (21-day appeal period). b) The development must be located as shown on the site plan approved with the application and submitted November 1, 2021. It must be built according to the description provided with this approval. Any changes shall require the written approval of the Development Authority. c) That the business operates with one resident employee and no more than two non- resident employees. d) That any intensification of the use must be reported to the Development Authority, intensification of use may require re-evaluation of the permit and other further action. e) Any additional development shall require prior approval of a separate permit application.
