MOTION CARRIED 3. MINUTES 3.1 May 7, 2015 Meeting Minutes P-50/15 MOVED BY COUNCILLOR B. DE JONG that the minutes of the May 7, 2015 Municipal Planning Commission meeting be adopted as presented. MOTION CARRIED 4. CALL FOR POST AGENDA ITEMS fir*► The Chairman called for post agenda items. 5. ADOPTION OF AGENDA P-51/15 MOVED BY COUNCILLOR A. PHILIPSEN that the agenda be adopted as presented. MOTION CARRIED0 6. SUBDIVISIONS a) 2015-0-073 - Lot 1, Block 2, Plan 1013745, NE1/4 27-14-14-W4M, To reconfigure an existing parcel approximately 6.11 acres (2.47 ha) in size, containing an existing farmstead, by subdividing and consolidating lands from the adjacent quarter section to create a new parcel approximately 6.60 acres (2.67 ha) in size. The County Planner provided background information on the proposed application. There were no questions from MPC. P-52/15 MOVED BY COUNCILLOR C. AMULUNG that the Country Residential/Agricultural subdivision of Lot 1, Block 2, Plan 1013745 within NE1/4 27-14-14-W4M, to reconfigure an existing parcel approximately 6.11 acres (2.47 ha) in size, containing an existing farmstead, by subdividing and consolidating lands from the adjacent quarter section to create a new parcel approximately 6.60 acres (2.67 ha) in size be APPROVED subject to the following: 1. That all outstanding property taxes shall be paid to the County of Newell. irli)> 2. That the subdivided portion of NE1/4 27-14-14-W4M be consolidated to Lot 1, Block 2, Plan 101 3745 to create a new parcel approximately 6.60 acres (2.67 ha) in a manner such that the resulting Certificate of Title could not be subdivided without the approval of the Subdivision Authority. 3. That the residual portion of Lot 1, Block 2, Plan 101 3745 be consolidated with the0 adjacent parcel legally known as NE1/4 27-14-14-W4M in a manner such that the resulting Certificate of Title could not be subdivided without the approval of the Subdivision Authority. DEVELOPMENT PERMITS a) DP 3967 - Block A, Plan 4465FC, NE 7-17-13 W4M, Farm Building with variance to side yard setback Left the Meeting Layne Johnson left the meeting at 10:08 a.m. The Development Clerk provided background information on the proposed application. There were no questions from MPC. I'I Returned to Meeting L. Johnson returned at 10:09 a.m. P-53/15 MOVED BY COUNCILOR A. PHILIPSEN that the Municipal Planning Commission APPROVE Development Permit#3967, for the construction of an 800 ft2 (74 m2)farm building with a 40 ft (12 m) variance to the road right-of-way, subject to the conditions C)outlined below. This permit is being granted only to provide approval for the construction of an 800 ft2 (74 m2)farm building, on lands legally described as Block A, Plan 4465FC, NE 7-17-13 W4M. Any additional development shall require prior approval of a separate permit application. The proposed development complying with: a) The provisions pertaining to the Agricultural District and all relevant schedules, as outlined in the County of Newell Land Use Bylaw#1755-12. b) All Federal, Provincial and Municipal statutes, regulations, codes and standards. c) All Alberta Building Codes and Safety Codes, where applicable. Reasons for Approval The Municipal Planning Commission has approved DP#3967 for the following reasons: 1. The proposed development complies with the Municipal Development Plan. 2. The Development Authority is satisfied that the proposed development is suitable for the purpose for which it is intended under the Agricultural District (Schedule 2) and Standards of Development (Schedule 3) as specified in the County of Newell Land Use Bylaw#1755-12. 3. No objections have been received from adjacent landowners or referral agencies with respect to the proposed development. Conditions of Development a) That this development is located as shown on the site plan approved in this application and submitted April 21, 2015. Any changes to that plan shall require the written approval of the Development Officer. b) That the property is not used for conducting a business or commercial operation without first obtaining the required permits. c) That there is a 10 ft (3 m) separation distance between the new building and any other buildings or structures. d) The developer must start construction before June 4, 2016. In the event that this date cannot be met, the developer may be required to apply for a new permit. e) That the following setbacks on all sides are maintained for this development: Hwy 875 (east): 100 ft (30 m) TR 17-2 (north): 60 ft (18 m) variance from 100 ft (30 m) Rear(west): 25 ft (7.6 m) Side (south): 25 ft (7.6 m) MOTION CARRIED b) DP 3971 - Lot 2, Block 3, Plan 0511627, NW 7-19-14 W4M, Accessory Building to Wreckage and Salvage yard business The Development Clerk provided background information on the proposed permit. Mr. Larson informed MPC that when the original parcel was subdivided and resurveyed, the property pin had been moved north by about 60 feet. This resulted in his parcel being narrower than he originally wanted. Now, the new building needs the setback variance so that his truck and trailer unit can make the turn into it. Councillor G. Simpson asked the applicant if the new building would be up against the fence. The applicant responded that the building would be about 6 ft from the south fence. Councillor C. Amulung inquired if the removal of the three buildings on the site plan was the applicant's idea or a recommendation of Planning &Development. The applicant replied that removing the buildings had been his choice and that one of the buildings had already been removed from the property. P-54/15 MOVED BY COUNCILOR C. AMULUNG that the Municipal Planning Commission APPROVE Development Permit#3971 for the approval of a 9600 ft2 (892 m2) accessory building with a 20 ft (6 m) variance to the south side yard, subject to the following conditions: This permit is being granted only to provide approval of a 9600 ft2 (892 m2) accessory building with a side yard variance, on lands legally described as Lot 2, Block 3, Plan 0511627, NW 7-19-14 W4M. Any additional development shall require prior approval of a separate permit application. The proposed development complying with: a) The provisions pertaining to the Rural Industrial District and all relevant schedules, as outlined in the County of Newell Land Use Bylaw#1755-12. b) All Federal, Provincial and Municipal statutes, regulations, codes and standards. c) All Alberta Building Codes and Safety Codes, where applicable. d) It is responsibility of the developer to obtain all permits from an accredited inspection agency. Reasons for Approval The Municipal Planning Commission has approved DP#3971 for the following reasons: 1. The proposed development complies with both the Municipal Development Plan and the Intermunicipal Development Plan. 2. The Development Authority is satisfied that the proposed development is suitable for the purpose for which it is intended under the Rural Industrial District (Schedule 2) and Standards of Development (Schedule 4) as specified in the County of Newell Land Use Bylaw#1755-12. 3. No objections have been received from adjacent landowners or referral agencies with respect to the proposed development. Conditions of Development a) That this development is located as shown on the site plan approved in this application and submitted April 27, 2015. Any changes to that plan shall require the written approval of the Development Officer. Setbacks and Separation Distances a) That the following setbacks on all sides are maintained for this development: Front (west): 100 ft (30.5 m) Side (south): 5 ft (1.5 m); variance from 25 ft (7.6 m) Side (north): 25 ft (7.6 m) Rear(east): 25 ft (7.6 m) b) That there is a 10 ft (3 m) separation distance between the new building and any other buildings or structures on the parcel. SII Construction Requirements iI a) That the proposed accessory building (shop) is not used for living purposes. b) That the developer must start construction before June 4, 2016. In the event that this date cannot be met, the developer must apply for an extension and may be required to apply for a new permit. c) That the following existing structures must be removed upon completion of the new shop, not later than twelve (12) months from the date of the permit approval: 1. Detached garage 2. Storage Shed 3. Industrial Shop Building MOTION CARRIED c) DP 3972 - Lot 2, Block 3, Plan 0511627, NW 7-19-14 W4M, Dwelling unit accessory to an industrial use The Development Clerk provided background information on the proposed permit. Mr. Larson informed MPC that the house had been on the property since before the parcel had been subdivided from the quarter. P-55/15 MOVED BY COUNCILOR A. PHILIPSEN that the Municipal Planning Commission APPROVE Development Permit#3972 for the approval of an existing 1052 ft2 (98 m2) dwelling unit accessory to the industrial use, subject to the following conditions: This permit is being granted only to provide approval for an existing 1052 ft2 (98 m2) dwelling unit, being used as an accessory to the industrial use, on lands legally described as Lot 2, Block 3, Plan 0511627, NW 7-19-14 W4M. Any additional development shall require prior approval of a separate permit application. The proposed development complying with: a) The provisions pertaining to the Rural Industrial District and all relevant schedules, as outlined in the County of Newell Land Use Bylaw#1755-12. b) All Federal, Provincial and Municipal statutes, regulations, codes and standards. c) All Alberta Building Codes and Safety Codes, where applicable. d) It is responsibility of the developer to obtain all permits from an accredited inspection agency. Any changes to that plan or further �,,.r development shall require the written approval of the Development Officer. b) The dwelling must be occupied by an employee of the business for the purpose of security on the parcel. c) The dwelling may only be used for residential purposes. Any proposed business or commercial use in the dwelling shall require proper permits. d) The following setbacks maintained: Front (west): 100 ft (30.5 m) Sides (north & south): 25 ft (7.6 m) Rear(east): 25 ft (7.6 m) MOTION CARRIED Left the Meeting Doug Larsen left at 10:21 a.m. 8. INFORMATION ITEMS 10.1 Proposed Bylaw 1833-15(Amendments to Land Use Bylaw 1755-12), Changes to Definitions and Uses in Land Use Districts The County Planner provided background information on the proposed Bylaw. The County Planner requested input from MPC and indicated that the proposed Bylaw 1833-15 would be placed on the June 11, 2015 Council agenda for First Reading. There were no questions from MPC. 11.
