Douglass, Councillor A.M. Philipsen, Councillor, Vice M.P.C. Chair B. de Jong, Councillor L. Juss, Councillor G. Simpson, Councillor& M.P.C. Chair C. Amulung, Councillor E. Unruh, Councillor W. CALL TO ORDER The Chairman called the meeting to order at 9:58 a.m. 2. EXCUSED FROM MEETING P-70/15 MOVED BY COUNCILOR A. M. PHILIPSEN that Councillor K. Christman be excused from the meeting. MOTION CARRIED 3. MINUTES 3.1 July 9, 2015 Meeting Minutes P-71/15 MOVED BY COUNCILOR T. FYFE that the minutes of the July 9, 2015 Municipal Planning Commission meeting be adopted as presented. MOTION CARRIED ""' 4. CALL FOR POST AGENDA ITEMS The Chairman called for post agenda items. 5. ADOPTION OF AGENDA P-72/15 MOVED BY COUNCILOR B. DE JONG that the agenda be adopted as presented. MOTION CARRIED 6. DEVELOPMENT PERMITS a) DP 3991 - Lot 1, Plan 7810394 -Accessory Building (Horse Shelter) with variance to ROW setback The Development Clerk provided background information for the application. Councillor G. Simpson inquired if the landowner had come forward for a permit, since the structure had been constructed around 10 years ago. The Development Clerk replied that he came in regarding another permit and realized that the horse structure required a permit. P-73/15 MOVED BY COUNCILOR L. JUSS that the Municipal Planning Commission APPROVE Development Permit#3991, for the approval of an existing 240 ft2 (22 m2)accessory building (horse shelter), subject to the conditions outlined below. This permit is being granted only to provide approval of an existing 240 ft2 (22 m2) accessory building (horse shelter), on lands legally described as Lot 1, Plan 7810394, NE 34-19-14 W4M. Any additional development shall require prior approval of a separate permit application. The proposed development complying with: a) The provisions pertaining to the Acreage Residential District and all relevant schedules, as outlined in the County of Newell Land Use Bylaw#1755-12. b) All Federal, Provincial and Municipal statutes, regulations, codes and standards. c) All Alberta Building Codes and Safety Codes, where applicable. Reasons for Approval The Municipal Planning Commission has approved DP#3991 for the following reasons: 1. The proposed development complies with the Municipal Development Plan. 2. The Development Authority is satisfied that the proposed development is suitable for the purpose for which it is intended under the Acreage Residential District(Schedule 2) and Standards of Development(Schedule 4) as specified in the County of Newell Land Use Bylaw #1755-12. Conditions of Development a) That this development is located as shown on the site plan provided with this application and submitted June 9, 2015.Any changes to that plan shall require the written approval from the Development Officer. b) That the property is not used for conducting a business or commercial operation without first obtaining the required permits. c) That the following setbacks are maintained for this development: Front(north): 36 ft(11 m); variance from 50 ft(15 m) Side(east): 50 ft(15 m) Rear(south): 25 ft(7.6m) ?OM, Side(west): 25 ft(7.6m) MOTION CARRIED C7.
