HomeMy WebLinkAbout2023-01-12 Municipal Planning Commission (Regular) MinutesCOUNTY OF NEWELL MUNICIPAL PLANNING COMMISSION MEETING January 12, 2023 The regular Municipal Planning Commission (MPC) Meeting of the County of Newell was heid in the County Office at Brooks, AB and livestreamed to the public via Lifesize on Thursday, January 12, 2023 commencing at 10:01 a.m. A notice was posted at the front entrance advising the public of the meeting. Axelson, Applicant - DP 2022107 1. CALL TO ORDER The Chairman called the meeting to order at 10:01 a.m. 2. EXCUSED FROM MEETING All members were in attendance at this meeting. 3. MINUTES 3.1 Minutes - Municipal Planning Commission (November 24, 2022) P-01/23 MOVED BY COUNCILLOR GREG SKRIVER that the minutes of the November 24, 2022 Municipal Planning Commission meeting be adopted as presented. MOTION CARRIED Municipal Planning Commission January 12, 2023 4. CALL FOR POST AGENDA ITEMS The Chairman called for post agenda items. 5. ADOPTION OF AGENDA P-02/23 MOVED BY COUNCILLOR AMANDA PHILPOTT that the agenda be adopted as presented. MOTION CARRIED 6. DEVELOPMENT REPORT The Development Clerk presented the Development Report and MPC was given the opportunity to ask questions. This item was accepted as information. 7. SUBDIVISIONS 7.1 2022-0-015 - To subdivide an approximate 24.7 ha (61.0 ac) portion from the SW 6-22-15-W4 and a 50.6 ha (125.1 ac) portion from the SE 6-22-15-W4 to be consolidated to create one new parcel 75.3 ha (186.1 ac) in size The Supervisor of Planning & Development provided background information on fhe proposed subdivision application. MPC was given the opportunity to ask questions. The Supervisor of Planning & Development responded to questions regarding physical access to the subdivided parcel. The Supervisor of Planning & Development stated the purpose for the subdivision is to divide the land that is irrigated from the grassland used for grazing and MPC can consider approval without physical access because it is for agriculture purposes. If future development on fhe proposed subdivision requires physical access, the developer will be responsible for costs associated with constructing the road to County standards. Discussion followed. The Supervisor of Planning & Development responded to further quesfions, indicating that the County is not responsible for providing physical access. She suggested a Development Agreement could be registered on the land title to make potential buyers aware of the requirement to construct physical access to County standards. She indicated on the map the locations of road allowances to the east and west. The Manager of Planning, Development & Engineering provided additional information, indicating that there is no expectation that these lands will be developed in the future. Discussion followed. The Supervisor of Planning & Development indicated that she had spoken to the applicant regarding the property lines and there is currently a fence along the proposed boundary. P-03/23 MOVED BY COUNCILLOR NEIL JOHNSON that the Municipal Planning Commission APPROVES the subdivision to create one new parcel, 75.3 ha (186.1 ac) in size. The remainder of the section will be consolidated into one parcel containing 182.9 ha (452.1 ac) for agricultural purposes with conditions, for the following reasons: Page 2 of 4 _ Municipal Planning Commission January 12, 2023 1. The proposed subdivision is consistent with the South Saskatchewan Regional Plan and complies with the County of Newell Municipal Development Plan, and the Land Use Bylaw. 2. The Subdivision Authority is satisfied that the proposed subdivision is suitable for the purpose for which the subdivision is intended pursuant to Section 7 of the Subdivision and Development Regulations. CONDITIONS: 1. That, pursuant to Section 654(1)(d) of the Municipal Government Act, all outstanding property taxes shall be paid to the County of Newell. 2. That, pursuant to Section 655(1)b of the Municipal Government Act, the applicant enter into a Development Agreement with the County of Newell which shall be registered concurrently with the final plan against the title(s) being created. RESERVE: Municipal Reserve is not applicable as per MGA 663(b) - the land is to be subdivided into lots of 16.0 hectares or more and is to be used only for agricultural purposes. MOTION CARRIED 8. DEVELOPMENT PERMITS 8.1 DP 2022107 - NE 16-15-15-W4, Approval for existing agricultural building The Development Clerk provided background information on the proposed permit application. The applicants responded to questions from MPC regarding the portion of the structure that has been removed. P-04/23 MOVED BY COUNCILLOR DAN SHORT that the Municipal Planning Commission APPROVES Development Permit 2022107 for the approval for an existing 83 mZ (896 ft2) agriculture building, with a variance to the side yard setback requirement, on lands legally described as NE 16-15-15-W4. This development approval is subject to the conditions outlined below. DP 2022107 is approved for the following reasons: 1. The proposed development complies with the Municipal Development Plan. 2. The Development Authority is satisfied that the proposed development is suitable for the purpose for which it is intended under the Agriculture General Park District (Schedule 2) Section 3, General Regulations and Section 4, Specific Uses and Activities as specified in the County of Newell Land Use Bylaw 2016-21. 3. No objections have been received from adjacent landowners or referral agencies with respect to the proposed development. CONDITIONS: 1. This approval is effective as of February 1, 2023 (21-day appeal period). 2. The development must be located as shown on the site plan approved with the application and submitted November 28, 2022. It must be built according to the description provided with this approval. Any changes shall require the written approval of the Development Authority. Page 3 of 4 Municipal Planning Commission January 12, 2023 3. Any additional development shall require prior approval of a separate permit application. 4. That the property is not used for conducting a business or commercial operation without first obtaining the required permits. 5. That the following setbacks are maintained for this development: Side (west): 1 m(3 ft) — variance from 6 m(20 ft) MOTION CARRIED LEFT THE MEETING D. Axelson and D. Axelson left the meeting at 10:35 a.m. 9. POST AGENDA ITEMS There were no post agenda ifems to discuss at this meeting. 10. IN CAMERA There were no in camera items to discuss at this meeting. 11. QUESTION PERIOD A question period was held. No County ratepayers were in attendance. The moderator indicated that there were no questions from the public. 12.
