HomeMy WebLinkAbout2023-04-06 Municipal Planning Commission (Regular) MinutesCOUNTY OF NEWELL MUNICIPAL PLANNING COMMISSION April 6, 2023 The regular Municipal Planning Commission (MPC) Meeting of the County of Newell was held in the County Office at Brooks, AB and livestreamed to the public via Lifesize on Thursday, April 6, 2023 commencing at 10:04 a.m. A notice was posted at the front entrance advising the public of the meeting. MEMBERS PRESENT: A. Doerksen, Reeve K. Christman, Councillor, MPC Chair H. Johnson, Councillor, MPC Vice Chair L. Kopp, Councillor G. Skriver, Councillor E. Unruh, Councillor A. P-15/23 CALL TO ORDER The Chairman called the meeting to order at 10:04 a.m. EXCUSED FROM MEETING MOVED BY COUNCILLOR HOLLY JOHNSON that Councillor A. Skanderup and D. Short be excused from the meeting. MOTION CARRIED MINUTES MOVED BY COUNCILLOR LYNETTE KOPP that the minutes of the March 9, 2023 Municipal Planning Commission meeting be adopted as presented. MOTION CARRIED Municipal Planning Commission April 6, 2023 4. CALL FOR POST AGENDA ITEMS The Chairman called for post agenda items. 5. ADOPTION OF AGENDA P-16/23 MOVED BY COUNCILLOR AMANDA PHILPOTT that the agenda be adopted as presented. MOTION CARRIED ARRIVED AT MEETING Councillor D. Short arrived at 10:06 a.m. 6. DEVELOPMENT REPORT The Development Clerk presented the Development Report. This item was accepted as information. DEVELOPMENT PERMITS 7.1 DP 2023007 - SE 16-20-14-W4M, Construction of a single family dwelling with an attached garage and deck to be used as a second dwelling. The Development Officer provided background information on this item. The applicant was present to answer questions. MPC asked why a dwelling required MPC approval. The Planning and Development Supervisor responded that a maximum of 4 dwellings are allowed on a parcel zoned agricultural, however the second and additional dwellings are discretionary to ensure the site is suitable for additional dwellings. P-17/23 MOVED BY COUNCILLOR DAN SHORT that the Municipal Planning Commission APPROVE Development Permit 2023007 for the construction of a 223 m2 (2400 ft2) single family dwelling with a 107 m2 (1152 ft2) attached garage and 22 m2 (240 ft2) deck to be used as a second dwelling, on lands legally described as SE 16-20-14 W41M. This development approval is subject to the conditions outlined below. DP 2023007 is Approved for the following reasons: 1. The proposed development complies with the Municipal Development Plan, 2. The Development Authority is satisfied that the proposed development is suitable for the purpose for which it is intended under the Agriculture General District (Schedule 2) Section 3, General Regulations and Section 4, Specific Uses and Activities as specified in the County of Newell Land Use Bylaw 2016-21. Page 2 of 4 Municipal Planning Commission April 6, 2023 3. No objections have been received from adjacent landowners or referral agencies with respect to the proposed development. Conditions of Development Approval a) This approval is effective as of April 26, 2023 (21-day appeal period). b) The development must be located as shown on the site plan approved with the application and submitted February 14, 2023. It must be built according to the description provided with this approval. Any changes shall require the written approval of the Development Authority. c) The applicant/owner must obtain all construction permits applicable to development and is responsible to ensure all permits are closed with work complying to the building code. d) Any additional development shall require prior approval of a separate permit application. e) That the property is not used for conducting a business or commercial operation without first obtaining the required permits. f) That the following setbacks are maintained for this development Front (south): as per Alberta Transportation Side (east): 30 m (100 ft) Rear (north): 6 m (20 ft) Side (west): 6 m (20 ft) MOTION CARRIED 8. OTHER BUSINESS There was no other business to discuss at this meeting. 9. POST AGENDA ITEMS There were no post agenda items to discuss at this meeting. 10. IN CAMERA There were no in camera items to discuss at this meeting. 11. QUESTION PERIOD A question period was held. The moderator indicated that there were no questions from the public.
