HomeMy WebLinkAbout2023-05-25 Municipal Planning Commission (Regular) MinutesCOUNTY OF NEWELL MUNICIPAL PLANNING COMMISSION May 25, 2023 The regular Municipal Planning Commission (MPC) Meeting of the County of Newell was held in the County Office at Brooks, AB and livestreamed to the public via Lifesize on Thursday, May 25, 2023 commencing at 10:02 a.m. A notice was posted at the front entrance advising the public of the meeting. CALL TO ORDER The Chair called the meeting to order at 10:02 a.m. EXCUSED FROM MEETING MOVED BY COUNCILLOR AMANDA PHILPOTT that Councillor E. Unruh and Councillor H. Johnson be excused from the meeting. MINUTES MOTION CARRIED P-29/23 MOVED BY COUNCILLOR ADENA SKANDERUP that the minutes of the May 11, 2023 Municipal Planning Commission meeting be adopted as presented. MOTION CARRIED Municipal Planning Commission May 25, 2023 4. CALL FOR POST AGENDA ITEMS The Chair called for post agenda items. No additions to the agenda 5. ADOPTION OF AGENDA P-30/23 MOVED BY REEVE ARNO DOERKSEN that the agenda be adopted as presented. MOTION CARRIED 6. DEVELOPMENT PERMITS 6.1 DP 2023027 - NE 18-16-13-W4 - Application is to operate a Home Based Business 2 -firewood sales The Municipal Intern - Planning provided background information on the proposed permit application. MPC was given the opportunity to ask questions. Discussion followed regarding how Planning and Development evaluates intensification. The Supervisor of Planning and Development responded that if visits to the business grow substantially and there is increased nuisance to adjacent landowners, the permit would be reviewed based on any potential complaints. If the business were to expand and set up more stands, then a new development permit would be required. Discussion followed with regard to the origin of the wood supplied and whether the County should be concerned about potential threats including imported weed seeds or disease. The Supervisor of Planning and Development indicated that there is a condition of the permit that the proposed development complies with all Federal, Provincial and Municipal statutes, regulations, codes, and standards. Therefore, if there are provincial policies on the transportation of wood the applicant would be responsible for complying. P-31/23 MOVED BY COUNCILLOR GREG SKRIVER that the Municipal Planning. Commission APPROVE Development Permit 2023027 for the operation of a firewood sales business, on lands legally described as NE 18-16-13-W4, and the sale of firewood be allowed on the NW 19-17-12-W4 and NE 36-16-14-W4. This development approval is subject to the conditions outlined below. DP 2023027 is Approved for the following reasons: 1. The proposed development complies with the Municipal Development Plan. 2. The Development Authority is satisfied that the proposed development is suitable for the purpose for which it is intended under the Section 5, Agriculture General District, Section 3, General Regulations and Section 4, Specific Uses and Activities, as specified in the County of Newell Land Use Bylaw 2016-21. Conditions of the approval: a) This approval is effective as of June 14, 2023 (21-day appeal period). Page 2 of 4 Municipal Planning Commission May 25, 2023 b) The development must be located as shown on the site plan approved with the application and submitted April 20, 2023. It must be built according to the description provided with this approval. Any changes shall require the written approval of the Development Authority. c) That the proposed development complies with all Federal, Provincial and Municipal statutes, regulations, codes, and standards. d) Any additional development shall require prior approval of a separate permit application. e) That the following setbacks are maintained for the firewood stand located on NE 36-16-14-W4: Front (east): 7.5m (25ft); variance from 30 m (100 ft) f) That any intensification of use must be reported to the Development Officer, intensification of use may require re-evaluation of the permit and other further action. MOTION CARRIED 7. OTHER BUSINESS There was no other business to discuss at this meeting. 8. POST AGENDA ITEMS There were no post agenda items to discuss at this meeting. 9.
