MUNICIPAL PLANNING COMMISSION
March 14, 2024
The regular Municipal Planning Commission (MPC) Meeting of the County of Newell was held in
the County Office at Brooks, AB and livestreamed to the public on Thursday, March 14, 2024
commencing at 10:00 a.m.
A notice was posted at the front entrance advising the public of the meeting.

The Chair called the meeting to order at 10:00 a.m.

3.1 Minutes - Municipal Planning Commission
P-01/24 MOVED BY COUNCILLOR HOLLY JOHNSON that the minutes of the
December 21, 2023 Municipal Planning Commission meeting be adopted as presented.

4. CALL FOR POST AGENDA ITEMS
The Chair called for post agenda items.
5. ADOPTION OF AGENDA
P-02/24 MOVED BY COUNCILLOR ADENA SKANDERUP that the agenda be adopted as
presented.

6. DEVELOPMENT REPORT
The Development Officer presented the Development Report and responded to questions
from Council. This item was accepted as information.
7. DEVELOPMENT PERMITS
7.1 DP 2024007 - Installation of an individual ground mount solar array
The Development Officer provided background information on this item to
MPC. D. Bergquist, the landowner, and B. Schroeder, the installer, were present
to provide additional information and respond to questions from MPC. MPC was
given the opportunity to ask questions. D. Bergquist responded to questions
regarding his vegetation management plan and the reasons for choosing a ground
mounted array.
P-03/24 MOVED BY COUNCILLOR NEIL JOHNSON that the Municipal Planning Commission
APPROVE Development Permit 2024007 for the installation of a 31 m2 (334 ft2) ground
mount individual solar array, on lands legally described as Lot 1, Block 5, Plan 2111375,
SW 2-19-14-W4. This development approval is subject to the conditions outlined below.
DP 2024007 is Approved for the following reasons:
1. The proposed development complies with the Municipal Development Plan.
2. The Development Authority is satisfied that the proposed development is suitable
for the purpose for which it is intended under the Residential Rural District
(Schedule 2) Section 3, General Regulations and Section 4, Specific Uses and
Activities. as specified in the County of Newell Land Use Bylaw 2016-21.
3. Adjacent landowners and referral agencies have been notified and have had the
opportunity to comment. Any comments or concerns should be received by the
County administration by March 7, 2024.
Conditions of the approval:
a. This approval is effective as of April 4, 2024 (21-day appeal period).
b. The development must be located as shown on the site plan approved with the
application and submitted February 8, 2024. It must be built according to the

description provided with this approval. Any changes shall require the written
approval of the Development Authority.
c. The applicant/owner must obtain all construction permits applicable to
development and is responsible to ensure all permits are closed with work
complying to the building code.
d. That the proposed development complies with all Federal, Provincial and Municipal
statutes, regulations, codes and standards.
e. Any additional development shall require prior approval of a separate permit
application.
f. That the panels are located in such a way that it does not create undue glare on
neighbouring parcels or roadways.
g. That the property is not used for conducting a business or commercial operation
without first obtaining the required permits.
h. That the following setbacks are maintained for this development:
1. Front (west): 30 m (100 ft)
2. Side (north & south): 3 m (10 ft)
3. Rear (east): 3 m (10 ft)
MOTION CARRIED
B. Schroeder provided further information regarding the benefits of solar power
developments and asked Council to consider further amendments to the land use
bylaw to facilitate the development of ground mount solar arrays. Specific
amendments requested were:
• including solar arrays as a permitted use within Agriculture - General
District
• increase the allowable size for solar arrays within residential districts
B. Schroeder responded to further questions regarding solar panel installations.
