MINUTES 3.1 Minutes - Municipal Planning Commission (March 28, 2024) P-10/24 MOVED BY COUNCILLOR ADENA SKANDERUP that the minutes of the March 28, 2024 Municipal Planning Commission meeting be adopted as presented. MOTION CARRIED 4. CALL FOR POST AGENDA ITEMS The Chair called for post agenda items. There were no post agenda items. 5. ADOPTION OF AGENDA P-11/24 MOVED BY COUNCILLOR AMANDA PHILPOTT that the agenda be adopted as presented. MOTION CARRIED 6. DEVELOPMENT REPORT The Development Officer presented the Development Report and there were no questions from Council, This item was accepted as information. 7. DEVELOPMENT PERMITS 7.1 DP 2024016 - Construction of a detached garage The Development Officer provided background information on this item to MPC. MPC inquired about the conditions of the proposed approach. Administration responded that the existing road approach is to an acceptable standard and has been reviewed by Municipal Services. MPC asked the applicant if the proposed building would be compatible with the surrounding development. Mr. Christman responded that it would. P-12/24 MOVED BY COUNCILLOR NEIL JOHNSON That the Municipal Planning Commission APPROVE Development Permit 2024016 for the construction of a 187 m2 (2013 ft2) detached garage with a variance to the maximum height, on lands legally described as Lot 5, Block 1, Plan 8011346, SE 25-18-15-W4. This development approval is subject to the conditions outlined below. DP 2024016 is APPROVED for the following reasons: 1. The Development Authority is satisfied that the proposed development is suitable for the purpose for which it is intended under the Residential Rural District (Schedule 2) Section 3, General Regulations and Section 4, Specific Uses and Activities as specified in the County of Newell Land Use Bylaw 2016-21. 3. Adjacent landowners and referral agencies have been notified and have had the opportunity to comment. Any comments or concerns should be received by the County administration by April 5, 2024. Conditions of approval: a) This approval is effective as of May 1, 2024 (21-day appeal period) b) The development must be located as shown on the site plan approved with the application and submitted March 7, 2024. It must be built according to the description provided with this approval. Any changes shall require the written approval of the Development Authority. c) The applicant/owner must obtain all construction permits applicable to development and is responsible to ensure all permits are closed with work complying to the building code. d) That the proposed development complies with all Federal, Provincial and Municipal statutes, regulations, codes, and standards. e) Any additional development shall require prior approval of a separate permit application. fl That the accessory building be similar to and complement the principal building in exterior material, colour and appearance. g) That the applicant has an approved road approach agreement. h) That the property is not used for conducting a business or commercial operation without first obtaining the required permits. i) That the height does not exceed 6 m(20 ft); variance from 5 m(16 ft) j) That the following setbacks are maintained for this development: Front (east): 6 m (20 ft) Side (north & south): 3 m(10 ft) x J , �'� I�l[t�iiit,i��a! r'lz�r�€n�>:cs E��c�rr=�rti;s:>it3t�3 t;��ti? 11; z��i2� Rear (west): 3 m (10 ft) MOTION CARRIED 7.2 DP 2024021 - Installation of a 123 m2 (1320 ft2) manufactured dwelling and addition, 36 m2 (384 ft2) deck, 6 m2 (64 ft2) deck and approval for an existing 16m2 (168 ft2) accessory building for residential use. The Development Officer provided background information on this item to MPC. The subject manufactured dwelling is currently located north of Tilley and will be moved to Rolling Hills. P-13/24 MOVED BY COUNCILLOR ELLEN UNRUH That the Municipal Planning Commission APPROVE Development Permit 2024021 for the installation of a 123 m2 (1320 ftz) manufactured dwelling with an addition, 36 m2 (384 ft2) deck, 6 m2 (64 ft2) deck and approval for an existing 16m2 (168 ft2) accessory building, on lands legally described as Lot 3, Block 2, Plan 7410502, SE 6-15-13- W4. This development approval is subject to the conditions outlined below. DP 2024021 is APPROVED for the following reasons: 1. The proposed development complies with the Municipal Development Plan 2. The Development Authority is satisfied that the proposed development is suitable for the purpose for which it is intended under the Residential Hamlet District (Schedule 2) Section 3, General Regulations and Section 4, Specific Uses and Activities as specified in the County of Newell Land Use Bylaw 2016-21. 3. Adjacent landowners and referral agencies have been notified and have had the opportunity to comment. Any comments or concerns should be received by the County administration by April 8, 2024. Conditions of approval: a. All Federal, Provincial and Municipal statutes, regulations, codes, and standards. b. The provisions pertaining to the Hamlet Residential District and all relevant schedules, as outlined in the County of Newell Land Use Bylaw #2016-21. c. This development approval is effective on May 1, 2024. The approved development must be located as shown on the site plan and must be built according to the description provided with this approval. The applicant/owner must obtain all Alberta Safety Code permits applicable to development and is responsible to ensure all permits are closed with work complying to the building code. e. That any dwelling/structure is not located on any right of way or easement on the parcel. f. That the property is not used for conducting a business or commercial operation without first obtaining the required permits. g. That the following minimum setbacks on all sides are maintained for this development: Front (south): 6 m (20 ft) Side (east & west): 1.5 m(5 ft) Rear (north): 6 m (20 ft) h. That the applicant submits the $5000 security deposit as specified in Section 4.15 Moved-in Buildings in the Land Use Bylaw 2016-21, to be returned when the Alberta Building Code permits have been approved and closed. i. That the dwelling does not exceed 5 m in height. j. That the dwelling has CSA certification. k. That the dwelling be placed on a foundation, skirted within 30 days of siting to the satisfaction of the Development Authority and all axles, wheels and trailer hitches removed. That the developer must start construction before May 1, 2025. If this date cannot be met, the developer must apply for an extension and may be required to apply for a new permit. The Development shall be completed before May 1, 2026. MOTION CARRIED 8 9 OTHER BUSINESS There were no other business items to discuss at this meeting.
