MUNICIPAL PLANNING COMMISSION MEETING
January 7, 2016
The regular Municipal Planning Commission Meeting of the County of Newell was held in the
County Office at Brooks, AB on Thursday, January 7, 2016 commencing at 10:00 a.m.

3.1 December 10, 2015 Meeting Minutes
P-02/16 MOVED BY COUNCILLOR A. M. PHILIPSEN that the minutes of the December 10,
2015 Municipal Planning Commission meeting be adopted as presented.

4. CALL FOR POST AGENDA ITEMS
The Chairman called for post agenda items.
The Director of Corporate Services indicated that Development Permit 2015128 had
been withdrawn by the applicant.

7. DEVELOPMENT PERMITS
a) DP 2015128 -Lot 1, Block 2, Plan 1113160, NE 27-17-147-W4M, Kennel
This development permit was withdrawn.
b) DP 2012134 - NE 29-16-13 W4M, Dwelling unit accessory to an industrial use
The Development Clerk provided background information on the proposed application.
Councillor B. de Jong inquired about removing the existing dwelling after the new
dwelling has been installed. The Development Clerk replied that she will add it to the
conditions.
P-05/16 MOVED BY COUNCILLOR B. DE JONG that the Municipal Planning Commission
APPROVE Development Permit 2015134 for the installation of a new 1520 ft2 (141 m2)
manufactured home with a 480 ft2 (45 m2) deck as an accessory to the industrial use,
subject to the following conditions:
This permit is being granted only to provide approval for the installation of a new 1520
ft2 (141 m2) manufactured home with a 480 ft2 (45 m2) deck as an accessory to the
industrial use, on lands legally described as NE 29-16-13 W4M. Any additional
development shall require prior approval of a separate permit application.
The proposed development complying with:
a) The provisions pertaining to the Rural Industrial District and all relevant schedules,
as outlined in the County of Newell Land Use Bylaw #1755-12.
b) All Federal, Provincial and Municipal statutes, regulations, codes and standards.
c) All Alberta Building Codes and Safety Codes, where applicable.
d) It is responsibility of the developer to obtain all permits from an accredited inspection
agency.
Reasons for Approval
The Municipal Planning Commission has approved DP 2015134 for the following
reasons:
1. The proposed development complies with both the Municipal Development Plan and
the Intermunicipal Development Plan.
2. The Development Authority is satisfied that the proposed development is suitable for
the purpose for which it is intended under the Rural Industrial District (Schedule 2)
and Standards of Development (Schedule 4) as specified in the County of Newell
Land Use Bylaw #1755-12.
3. No objections have been received from adjacent landowners or referral agencies
with respect to the proposed development.
Conditions of Development
a) That this development is located as shown on the site plan approved in this
application and submitted November 25, 2015. Any changes to that plan shall
require the written approval of the Development Officer.
b) That there is a 2 m (6.6 ft) separation distance between the manufactured home and
the existing structures.
c) That the following setbacks on all sides are maintained for this development: Front
(east): 100 ft (30 m) Side (north and south): 25 ft (7.6 m) Rear (west): 25 ft (7.6 m)
d) That the existing manufactured home be removed upon occupancy of the new
dwelling.
e) That the developer must start construction before January 21, 2017. In the event
that this date cannot be met, the developer must apply for an extension and may be
required to apply for a new permit.
Manufactured and Moved -in Dwellings or Buildings
e) For the installation of manufactured or moved -in dwellings, the County generally
requires that the applicant submit a security deposit between $2500 and $5000, to
ensure that improvements indicated in the application are completed and that the
building is installed properly. However, since this dwelling is new and requires no
improvements, it is recommended that no security is required.

c) DP 2015136 - Lot 43, Plan 94111743, NW 6-18-14-W4M, Compliance of an existing
shed with a variance to the setback from the principal dwelling
The Development Clerk provided background information on the proposed application.
Councillor E. Unruh inquired about requirements from the initial permit. The
Development Clerk responded that no permit had been issued.
P-06/16 MOVED BY COUNCILLOR T. FYFE that the Municipal Planning Commission
APPROVE Development Permit 2015136 for compliance of an existing 148 ft2 (14 m2)
shed with a variance to the setback from the principal dwelling, subject to the following
conditions:
This permit is being granted only for the compliance of an existing 148 ft2 (14 m2) shed
with a variance to the setback from the principal dwelling, on lands legally described as
Lot 43 Plan 9411173, NW 6-18-14 W4M. Any additional development shall require prior
approval of a separate permit application.
The proposed development complying with:
a) The provisions pertaining to the Hamlet Residential District and all relevant
schedules, as outlined in the County of Newell Land Use Bylaw #1755-12.
b) All Federal, Provincial and Municipal statutes, regulations, codes and standards.
c) All Alberta Building Codes and Safety Codes, where applicable.

a. Rear (east): 10 ft (3.0 m)
b. Side (north): 5 ft (1.5 m)
c) That the shed is setback the following distance from the principal dwelling:
a. Side: 7 ft (2.2 m); variance from 10 ft (3 m)
d) That the property is not used for conducting a business or commercial operation
without first obtaining the required permits.
MOTION CARRIED
