DOUGLASS that Councillor B. de Jong be excused from the meeting. MOTION CARRIED 3. MINUTES 3.1 February 25, 2016 Meeting Minutes P-18116 MOVED BY COUNCILLOR A.M. PHILIPSEN that the minutes of the February 25, 2016 Municipal Planning Commission meeting be adopted as presented. MOTION CARRIED 4. CALL FOR POST AGENDA ITEMS The Chairman called for post agenda items. 5. ADOPTION OF AGENDA P-19/16 MOVED BY COUNCILLOR G. SIMPSON that the agenda be adopted as presented. 6. DEVELOPMENT REPORT a) Permitted Use Report - Feb 1 - 29, 2016 The Development Clerk provided background information. There were no questions. P-20/16 MOVED BYCOUNCILLOR K. CHRISTMAN that the Development Report be adopted as presented. MOTION CARRIED 7. SUBDIVISIONS a) 2016-0-027 - SE 17-17-16-W4M, To create one new parcel approximately 11.32 acres (4.58 ha) in size, containing an existing farmstead, from a historically subdivided quarter section for residential use. The County Planner provided background information on the proposed subdivision application. The County Planner suggested that the application be Tabled until the next M.P. C. meeting to review information from the Provincial Wetlands Policy regarding the wetlands that have been identified on the proposed subdivision. There was further discussion about wetlands mitigation directives from the Province and how the County would be required to meet these directives. P-21/16 MOVED BY COUNCILLOR M. DOUGLASS THAT the Residential subdivision of SE 1/4 17-17-16-W4M (Certificate of Title No. 111 066 284), to create one new parcel approximately 11.32 acres (4.58 ha) in size, containing an existing farmstead from a historically subdivided quarter section for residential use be TABLED subject to further investigation of the newly discovered wetlands. MOTION CARRIED LEFT THE MEETING J. & S. Brummelhuis left at 10:22 a.m. 8. DEVELOPMENT PERMITS a) DP 2015148 - Lot 10, Block 1, Plan 7910803, SW 8-19-13 W4M, Construction business with a variance to the number of trailers; installation of a shipping container for the business The Development Clerk provided background information on the proposed application. Councillor A. M. Philipsen suggested that conditions `e — f be combined into one general condition about fire safety for the site. The Manager of Planning & Development responded that the Manager of Fire & Emergency Services was requested to be specific to allow for enforcement, if needed. J. Penner informed MPC that the shipping container will only store tools for the business. P-22/16 MOVED BY COUNCILLOR A.M. PHILIPSEN that the Municipal Planning Commission APPROVE the Home Occupation 2015148 to establish a H02 construction business, which will include 2 commercial vehicles and 3 trailers and the shipping container for storage, subject to the conditions below: This permanent permit is being granted only for the roofing and siding construction business, located on lands legally described as Lot 10, Block 1, Plan 7910803, SW 8-19- 13 W4M. Any additional development shall require prior approval of a separate permit application. The proposed development complying with: a) The provisions pertaining to the Acreage Residential District and all relevant schedules, as outlined in the County of Newell Land Use Bylaw #1755-12. b) All Federal, Provincial and Municipal statutes, regulations, codes and standards. c) All Alberta Building Codes and Safety Codes, where applicable. Reasons for Approval The Municipal Planning Commission has approved HO 2015148 for the following reasons: 1. The proposed development complies with the Municipal Development Plan. 2. The Development Authority is satisfied that the proposed development is suitable for the purpose for which it is intended under the Agricultural District (Schedule 2), Standards of Development (Schedule 3) and Home Occupations (Schedule 4 Section 9), as specified in the County of Newell Land Use Bylaw #1755-12. 3. No objections have been received from adjacent landowners or referral agencies with respect to the proposed development. Conditions of Development a) That this development is located as shown on the site plan approved in this application and submitted January 18, 2016. Any changes to that plan shall require the written approval from the Development Officer. b) That there are no more than 2 resident employees and 2 non-resident employees involved in the operation of this business. c) There will be no more than 2 trucks, and 3 trailers for the business. d) That the exterior of the shipping container must be kept clean and regularly painted. e) Portable Fire Extinguishers are to be located in close proximity to the containers. f) If any Flammable or Combustible Liquids or Dangerous Goods are going to be stored within the shipping containers then they need to be placarded. g) This area should be considered a Non Smoking area for fire safety. h) Year round access for firefighting needs to be maintained. i) Vegetation control needs to be maintained. Setbacks and Separation Distances a) That the following setbacks on all sides are maintained for this development: Front (west): 50 ft (15 m) Side (north & south): 25 ft (7.6 m) Rear (east): 25 ft (7.6 m) b) That there is a 10 ft (3 m) separation distance between the shipping container and any other buildings or structures on the parcel. MOTION CARRIED b) DP 2016003 - Lot 1, Plan 9010909, NE 29-19-14 W4M, Construction of a shop with a side yard variance The Development Clerk provided background information on the proposed application. There were no questions. P-23/16 MOVED BY COUNCILLOR L. JUSS That the Municipal Planning Commission APPROVE Development Permit 2016003, for construction of a 3696 ft2 (343 m2) shop, subject to the conditions outlined below. This permit is being granted only to provide approval for construction of a 3696 ft2 (343 m2) shop, on lands legally described as Lot 1, Plan 9010909, NE 29-19-14 W4M. Any additional development shall require prior approval of a separate permit application. The proposed development complying with: a) The provisions pertaining to the Agricultural District and all relevant schedules, as outlined in the County of Newell Land Use Bylaw #1755-12. b) All Federal, Provincial and Municipal statutes, regulations, codes and standards. c) All Alberta Building Codes and Safety Codes, where applicable. The Development Authority is satisfied that the proposed development is suitable for the purpose for which it is intended under the Agricultural District (Schedule 2) and Standards of Development (Schedule 3) as specified in the County of Newell Land Use Bylaw #1755-12. 3. No objections have been received from adjacent landowners or referral agencies with respect to the proposed development. Conditions of Development a) That this development is located as shown on the site plan approved in this application and submitted February 4, 2016. Any changes to that plan shall require the written approval of the Development Officer. b) That the property is not used for conducting a business or commercial operation without first obtaining the required permits. c) That there is a 10 ft (3 m) separation distance between the new building and any other buildings or structures. d) The developer must start construction before March 24, 2017. In the event that this date cannot be met, the developer may be required to apply for a new permit. e) That the following setbacks on all sides are maintained for this development: Front (east): 200 ft (60 m) as approved by Alberta Transportation Side (north): 25 ft (7.6 m) Rear (west): 25 ft (7.6 m) Side (south) 12 ft (3.7 m); variance from 25 ft (7.6 m) MOTION CARRIED 9.
