Thiessen, Applicant The Chairman called the meeting to order at 10:00 a.m. 2. EXCUSED FROM MEETING All members were present. 3. MINUTES 3.1 April 7, 2016 Meeting Minutes MOVED BY COUNCILLOR MOLLY DOUGLASS that the minutes of the April 7, 2016 Municipal Planning Commission meeting be adopted as presented. MOTION CARRIED 4. CALL FOR POST AGENDA ITEMS The Chairman called for post agenda items. 5. ADOPTION OF AGENDA P-39/16 MOVED BY COUNCILLOR ANNE MARIE PHILIPSEN that the agenda be adopted as presented. MOTION CARRIED 6. SUBDIVISIONS a) 2016-0-048 - NE1/4 30-16-13-W4M, To create one (1) new parcel approximately 5.15 acres (2.09 ha) in size, containing an existing farmstead, from an unsubdivided quarter section for residential use. The County Planner provided background information on the proposed application. Councillor B. de Jong inquired about excess water drainage and if the dugout would be used for the purpose of collecting excess water. The County Planner replied that drainage issues are not typically addressed during the initial stages of an application. P-40/16 MOVED BY COUNCILLOR GORDON SIMPSON THAT the Country Residential subdivision of NE1/4 30-16-13-W4M (Certificate of Title No. 051 255 104+1), to create one (1) new parcel approximately 5.15 acres (2.09 ha) in size, containing an existing farmstead, from an unsubdivided quarter section for residential use BE APPROVED subject to the following: CONDITIONS: 1. That, pursuant to Section 654(1)(d) of the Municipal Government Act, all outstanding property taxes shall be paid to the County of Newell. REASONS: 1. The proposed subdivision is consistent with the South Saskatchewan Regional Plan and complies with both the Municipal Development Plan and Land Use Bylaw. 2. The Subdivision Authority is satisfied that the proposed subdivision is suitable for the purpose for which the subdivision is intended pursuant to Section 7 of the Subdivision and Development Regulation. MOTION CARRIED 7. DEVELOPMENT PERMITS b) DP 2016015 - Lot 2, Block 1, Plan 1411232, SW 28-23-18 W4M, Construction of a multi -unit dwelling The Development Clerk provided background information on the proposed application. There were no questions. P-41/16 MOVED BY COUNCILLOR LIONEL JUSS That the Municipal Planning Commission APPROVE Development Permit 2016015 for the construction of a 12,696 ft2 (1179 m2) multi -unit dwelling for Clearview Colony, subject to the conditions outlined below. This permit is being granted only to provide approval for construction of a 12,696 ft2 (1179 m2) multi -unit dwelling for Clearview Colony on lands legally described as Lot 2, Block 1, Plan 1411232, SW 28-23-18 W4M. Any additional development shall require prior approval of a separate permit application. The proposed development complying with: a) The provisions pertaining to the Agricultural District and all relevant schedules, as outlined in the County of Newell Land Use Bylaw #1755-12. b) All Federal, Provincial and Municipal statutes, regulations, codes and standards. c) All Alberta Building Codes and Safety Codes, where applicable. Reasons for Approval The Municipal Planning Commission has approved DP 2016015 for the following reasons: 1. The proposed development complies with the Municipal Development Plan. 2. The Development Authority is satisfied that the proposed development is suitable for the purpose for which it is intended under the Agricultural District (Schedule 2) and Standards of Development (Schedule 3) as specified in the County of Newell Land Use Bylaw #1755-12. 3. No objections have been received from adjacent landowners or referral agencies with respect to the proposed development. Conditions of Development a) That this development is located as shown on the site plan approved in this application and submitted March 16, 2016. Any changes to that plan shall require the written approval of the Development Officer. b) That the property is not used for conducting a business or commercial operation without first obtaining the required permits. c) That there is a 10 ft (3 m) separation distance between the new building and any other buildings or structures. d) The following setback must be maintained for this dwelling: I. Rear (west): 100 ft (30.5 m) II. Sides (north & south): 25 ft (7.6 m) e) The developer must start construction before May 5, 2017. In the event that this date cannot be met, the developer may be required to apply for a new permit. MOTION CARRIED b) DP 2016016 - Lot 2 Block 1 Plan 1411232 SW 28-23-18 W4M, Approval to relocate an existing multi -unit dwelling. The Development Clerk provided background information on the proposed application. There were no questions. P-42/16 MOVED BY COUNCILLOR ANNE MARIE PHILIPSEN That the Municipal Planning Commission APPROVE Development Permit 2016016 for the relocation of an existing 5400 ft2 (502 m2) multi -unit dwelling for Clearview Colony, subject to the conditions outlined below. This permit is being granted only to provide approval to relocate an existing 5400 ft2 (502 m2) multi -unit dwelling for Clearview Colony on lands legally described as Lot 2, Block 1, Plan 1411232, SW 28-23-18 W4M. Any additional development shall require prior approval of a separate permit application. The proposed development complying with: a) The provisions pertaining to the Agricultural District and all relevant schedules, as outlined in the County of Newell Land Use Bylaw #1755-12. b) All Federal, Provincial and Municipal statutes, regulations, codes and standards c) All Alberta Building Codes and Safety Codes, where applicable. Councillor B. de Jong asked if water runoff would stay on the property or runoff onto the neighbours. J. Thiessen replied that any runoff would stay on his property. Councillor A.M. Philipsen inquired if there were any trees or barriers between his and the neighbouring buildings. J. Thiessen responded that the area was wide open. Councillor A.M. Philipsen asked if J. Thiessen was using the neighbour's driveway to access his property. J. Thiessen commented that they are using their own driveway. The Development Clerk added that the 2012 airphoto does not show the newly built approach and driveway. P-43/16 MOVED BY COUNCILLOR BRIAN DE JONG That the Municipal Planning Commission APPROVE Development Permit 2016017, for the construction of a 1836 ft2 (171 m2) detached shop with a side yard variance, subject to the conditions outlined below. Reasons for Approval The Municipal Planning Commission has approved DP 2016017 for the following reasons: 1. The proposed development complies with the Municipal Development Plan. 2. The Development Authority is satisfied that the proposed development is suitable for the purpose for which it is intended under the Acreage Residential District (Schedule 2) and Standards of Development (Schedule 4) as specified in the County of Newell Land Use Bylaw #1755-12. 3. No objections have been received from adjacent landowners or referral agencies with respect to the proposed development. This permit is being granted only to provide approval for the construction of a 1836 ft2 (171 m2) detached shop with a side yard variance, on lands legally described as Lot 8, Block 3, Plan 1110256, NW 12-20-15 W4M. Any additional development shall require prior approval of a separate permit application. The proposed development complying with: a) The provisions pertaining to the Acreage Residential District and all relevant schedules, as outlined in the County of Newell Land Use Bylaw #1755-12. b) All Federal, Provincial and Municipal statutes, regulations, codes and standards. c) All Alberta Building Codes and Safety Codes, where applicable. Conditions of Development a) That this development is located as shown on the site plan provided with this application and submitted March 18, 2016. Any changes to that plan shall require the written approval from the Development Officer. b) That the property is not used for conducting a business or commercial operation without first obtaining the required permits. c) That there is a 10 ft (3 m) separation distance between the new building and any other buildings or structures. d) That the following setbacks are maintained for this development: Front (west): 50 ft (15.2 m) Side (north): 12 ft ( 3.7 m) variance from 25 ft (7.6 m) Rear (north): 25 ft (7.6m) e) That the developer must start construction before May 5, 2017. In the event that this date cannot be met, the developer must apply for an extension and may be required to apply for a new permit. MOTION CARRIED 8.
