MUNICIPAL PLANNING COMMISSION MEETING
October 6, 2016
The regular Municipal Planning Commission Meeting of the County of Newell was held in the
County Office at Brooks, AB on Thursday, October 6, 2016 commencing at 10:00 a.m.

6 DEVELOPMENT REPORT
6.1 Permitted Use Report - September 1 - 30, 2016
The Development Clerk responded to questions from MPC.
Councillor A. M. Philipsen asked what the change of use was for DP 2016108. The
Development Clerk replied that the business originally was a garden centre and has
recently been changed to a lawn care and landscaping/ snow removal business.
7 SUBDIVISIONS
a) 2016-0-129 - To create one (1) new parcel approximately 7.03 acres (2.84 ha) in size,
containing an existing farmstead from a historically subdivided quarter section for
residential use, SW1/4 5-17-13-W4M, Division 2
County Planner provided background information on the proposed application.
The County Planner indicated that a portion of the Planner's Preliminary Comments had
not been included in the agenda package. She noted that the proposed subdivision is
offset from the north boundary of the quarter by a 10 m panhandle. The applicant
requested the panhandle in order to provide access from Highway 875 to the residual
land. She recommended that MPC remove the panhandle because access to the
residual parcel is provided elsewhere along Highway 875.
There was further discussion about Alberta Transportation's requirement to provide a 20
meter wide service road dedicated by caveat for the subdivision.
P-91/16 MOVED BY COUNCILLOR ANNE MARIE PHILIPSEN THAT the Residential
subdivision of SW1/4 5-17-13-W4M (Certificate of Title No. 111 251 794, 111 245 948
+1) to create one (1) new parcel approximately 7.03 acres (2.84 ha) in size, containing
an existing farmstead from a historically subdivided quarter section for residential use
BE APPROVED subject to the following:
CONDITIONS:
1. That, pursuant to Section 654(1)(d) of the Municipal Government Act, all outstanding
property taxes shall be paid to the County of Newell.
2. That the proposed parcel be enlarged in size to the north quarter section line to
remove the 10 m panhandle as proposed by the tentative plan of survey.
3. That a 20-metre wide service road shall be dedicated by caveat located perpendicular
and across the highway frontage of the parcel to be created to comply with Section
15(2) of the Subdivision and Development Regulation. The applicant should contact
Alberta Transportation to finalize this condition.
REASONS:
1. The proposed subdivision is consistent with the South Saskatchewan Regional Plan
and complies with both the Municipal Development Plan and Land Use Bylaw.
2. The Subdivision Authority is satisfied that the proposed subdivision is suitable for the
purpose for which the subdivision is intended pursuant to Section 7 of the Subdivision
and Development Regulation.

b) 2016-0-130 - To subdivide an existing fragmented quarter section by subdividing and
creating separate titles east and west of an existing EID Canal (North Branch Canal),
SW1/4 25-24-16-W4M, Division 9
The County Planner provided background information on the proposed application.
Councillor E. Unruh asked whether a deferred development agreement for future road
access could be included in the conditions for approval. The County Planner replied that
Planning & Development would prefer to deal with access requirements during the
development permit application process.
P-92/16 MOVED BY COUNCILLOR LIONEL JUSS THAT the Agricultural subdivision of SW1/4
25-24-16-W4M (Certificate of Title No. 151 282 319 +1), to subdivide an existing
fragmented quarter section by subdividing and creating separate titles east and west of
an existing EID Canal (North Branch Canal) BE APPROVED subject to the following:
