EXCUSED FROM MEETING All members were present. 3. MINUTES 3.1 December 22, 2016 Meeting Minutes MOVED BY COUNCILLOR KELLY CHRISTMAN that the minutes of the December 22, 2016 Municipal Planning Commission meeting be adopted as presented. l MOTION CARRIED 4. CALL FOR POST AGENDA ITEMS The Chairman called for post agenda items. 5. ADOPTION OF AGENDA P-02/17 MOVED BY COUNCILLOR TRACY FYFE that the agenda be adopted as presented. MOTION CARRIED 6. DEVELOPMENT REPORT a) Permitted Use Report - December 1 - 31, 2016 The Development Clerk responded to questions from MPC. 7. DEVELOPMENT PERMITS a) DP 2016122 2016123 - NW 15-22-19 W4M, Construction of two multi -unit dwellings The Development Clerk provided background information on the proposed application. There were no questions from MPC. P-03/17 MOVED BY COUNCILLOR WAYNE HAMMERGREN That the Municipal Planning Commission APPROVE Development Permits 2016122 & 2016123, for the construction of a 11500 ft2 (1068 m2) multi -unit dwelling and a 10994 ft2 (1021 m2) multi -unit dwelling for Fairville Colony, subject to the conditions outlined below. This permit is being granted only to provide approval for the construction of a 11500 ft2 (1068 m2) multi -unit dwelling and a 10994 ft2 (1021 m2) multi -unit dwelling for Fairville Colony, on lands legally described as NW 15-22-19 W4M. Any additional development shall require prior approval of a separate permit application. The proposed development complying with: a) The provisions pertaining to the Agricultural District and all relevant schedules, as outlined in the County of Newell Land Use Bylaw #1755-12. b) All Federal, Provincial and Municipal statutes, regulations, codes and standards. c) All Alberta Building Codes and Safety Codes, where applicable. Reasons for Approval The Municipal Planning Commission has approved DP 2016122 & 2016123 for the following reasons: 1. The proposed development complies with the Municipal Development Plan. 2. The Development Authority is satisfied that the proposed development is suitable for the purpose for which it is intended under the Agricultural District (Schedule 2) and Standards of Development (Schedule 3) as specified in the County of Newell Land Use Bylaw #1755-12. �� 3. No objections have been received from adjacent landowners or referral agencies with respect to the proposed development. Conditions of Development a) That this development is located as shown on the site plan approved in this application and submitted November 29, 2016. Any changes to that plan shall require the written approval of the Development Officer. b) That the property is not used for conducting a business or commercial operation without first obtaining the required permits. c) That there is a 10 ft (3 m) separation distance between the new building and any other buildings or structures. d) The developer must start construction before January 24, 2017. In the event that this date cannot be met, the developer may be required to apply for a new permit. e) That the following setbacks on all sides are maintained for this development: Side (north and south): 25 ft (7.6 m) Rear (west): 100 ft (30.5m) MOTION CARRIED b) DP 2016124 - SW -25-17-13 W4M, Installation of a moved in building to be used as an addition to dwelling The Development Clerk provided background information on the proposed application. Councillor E. Uruh asked if the landowner was aware that he would have to remove the addition when the main building was replaced. The Development Clerk replied that she had spoken with the applicant and informed MPC that he would prefer the addition to stay, but was aware that he would be required to apply for a new permit at that time. P-04/17 MOVED BY COUNCILLOR GORDON SIMPSON That the Municipal Planning Commission APPROVE DP 2016124, for the installation of a 432 ft2 (40 m2) moved in building to be used as an addition to the existing dwelling, subject to the following conditions: This permit is being granted only for the installation of a 432 ft2 (40 m2) moved in building to be used as an addition to the existing dwelling, on lands legally described as SW 25- 17-13 W4M. Any additional development shall require prior approval of a separate permit application. The proposed development complying with: a) The provisions pertaining to the Fringe District and all relevant schedules, as outlined in the County of Newell Land Use Bylaw #1755-12. b) All Federal, Provincial and Municipal statutes, regulations, codes and standards c) All Alberta Building Codes, and Safety Codes, where applicable. Reasons for Approval The Municipal Planning Commission has approved DP 2016124 for the following reasons: 1. The proposed development complies with the Municipal Development Plan. 2. The Development Authority is satisfied that the proposed development is suitable for the purpose for which it is intended under Schedule 4 in the County of Newell Land Use Bylaw #1755-12. 3. No objections have been received from adjacent landowners or referral agencies with respect to the proposed development. Conditions of Development a) That this development is located as shown on the site plan approved in this application and submitted December 2, 2016. Any changes to that plan shall require the written approval of the Development Officer. b) That the applicant must remove the addition to the manufactured home, no later than July 31, 2019 which coincides with the deadline for removing the manufactured home. At the time the manufactured dwelling and addition are removed, the applicant must provide written confirmation to the County that both have been removed. c) That the property is not used for conducting a business or commercial operation without first obtaining the required permits. d) The developer must start construction before January 24, 2018. In the event that this date cannot be met, the developer may be required to apply for a new permit. e) That the following setbacks on all sides are maintained for this development: Front (south): 100 ft (30 m) Side:(east and; west) 25 ft (7.6 m) Rear: (north) 25 ft (7.6 m) MOTION CARRIED 8. POST AGENDA ITEMS There were no post agenda items. 9. IN CAMERA There were no in camera items. 10. INFORMATION ITEMS 10.1 LA16045 Hutterian Brethren of Bow City Decision 11. QUESTION PERIOD Councillor E. Unruh inquired if a development permit would be required for a farm building to be erected. The Manager of Planning and Development responded that so long as it was an agricultural building being constructed on a parcel in the Agricultural District and it met all the land use bylaw requirements, a development permit would not �_f� be required. She added that, in order for the landowner to be sure, he/she should come talk to Planning and Development staff. 12.
