MINUTES 3.1 February 9, 2017 Meeting Minutes MOVED BY COUNCILLOR TRACY FYFE that the minutes of the February 9, 2017 Municipal Planning Commission meeting be adopted as presented. Ell MOTION CARRIED 4. CALL FOR POST AGENDA ITEMS The Chairman called for post agenda items. J 5. ADOPTION OF AGENDA P-14/17 MOVED BY COUNCILLOR KELLY CHRISTMAN that the agenda be adopted as presented. MOTION CARRIED 6. DEVELOPMENT PERMITS a) DP 2017001 - Lot 1, Block 4, Plan 1610813, SE 13-16-14 W4M, Move in dwelling on basement, construction of additions The Manager of Planning & Development provided background information on the proposed application. The Manager of Planning & Development noted that a security deposit in the amount of $2500 needs to be added to the conditions of approval. Councillor K. Christman asked why the amount requested for the security deposit for this permit was different than the lower amount granted at the last MPC meeting. The Manager of Planning & Development replied that the security recommendation for this application is the minimum amount under the Land Use Bylaw. The reduced security amount approved during the last meeting was because the applicant requested a reduction. P-15/14 MOVED BY COUNCILLOR BRIAN DE JONG That the Municipal Planning Commission APPROVE Development Permit 2017001, for the installation of a 858 ft2 (80 m2) moved in dwelling, with a 546 ft2 (51 m2) addition and 504 ft2 (47 m2) covered deck, subject to the conditions outlined below. This permit is being granted only to provide approval for the installation of 858 ft2 (80 m2) moved in dwelling, with a 546 ft2 (51 m2) addition and 504 ft2 (47 m2) covered deck, on lands legally described as Lot 1, Block 4, Plan 1610813, SE 13-16-14 W4M. Any additional development shall require prior approval of a separate permit application. The proposed development complying with: a) The provisions pertaining to the Agricultural District and all relevant schedules, as outlined in the County of Newell Land Use Bylaw #1755-12. b) All Federal, Provincial and Municipal statutes, regulations, codes and standards. c) All Alberta Building Codes and Safety Codes, where applicable. Reasons for Approval The Municipal Planning Commission has approved DP 2017001 for the following reasons: 1. The proposed development complies with the Municipal Development Plan. 2. The Development Authority is satisfied that the proposed development is suitable for the purpose for which it is intended under the Agricultural District (Schedule 2) and Standards of Development (Schedule 3) as specified in the County of Newell Land Use Bylaw #1755-12. C�` 3. No objections have been received from adjacent landowners or referral agencies with respect to the proposed development. Conditions of Development a) That this development is located as shown on the site plan approved in this application and submitted January 10, 2017. Any changes to that plan shall require the written approval of the Development Officer. b) That the property is not used for conducting a business or commercial operation without first obtaining the required permits. c) That any dwelling/structure is located a minimum distance of 3 m (10 ft) from any right of way or easement on the parcel. d) That any dwelling/structure is located a minimum distance of 100 m (328 ft) from any gas or oil well site, operating or abandoned, on or adjacent to the property. e) The developer must start construction before February 28, 2018. In the event that this date cannot be met, the developer may be required to apply for a new permit. f) That the following setbacks on all sides are maintained for this development: Front (east): 100 ft (30 m) Side (north): 25 ft (7.6 m) Rear (southwest): 25 ft (7.6 m) g) That the developer provide a security deposit, in the amount of $2500.00 to ensure the following conditions of development are met: i. once installed, the structure must pass inspection by the County building inspector Once the development has met the conditions of the security deposit to the satisfaction of the County, the deposit will be refunded. h) That the applicant install a temporary sign at their approach at the time of construction displaying their rural address. This sign must remain until it is replaced by a County of Newell issued sign. MOTION CARRIED b) DP 2017003 - Parcel A, Plan 4089FF, SE 2-17-13 W4M, Approval for existing shipping containers The Manager of Planning & Development provided background on the proposed application. There were no questions. P-16117 MOVED BY COUNCILLOR GORDON SIMPSON That the Municipal Planning Commission APPROVE Development Permit 2017003, for 3 existing 320 ft2 (30 m2) shipping containers on the site, subject to the conditions outlined below. This permit is being granted only to provide approval for 3 existing 320 ft2 (30 m2) shipping containers on lands legally described as SE 2-17-13 W4M. Any additional development shall require prior approval of a separate permit application. The proposed development complying with: a) The provisions pertaining to the Agricultural District and all relevant schedules, as outlined in the County of Newell Land Use Bylaw #1755-12. b) All Federal, Provincial and Municipal statutes, regulations, codes and standards. c) All Alberta Building Codes and Safety Codes, where applicable. Reasons for Approval That the Municipal Planning Commission has approved DP 2017003 for the following reasons: 1. The proposed development complies with the Municipal Development Plan. 2. The Development Authority is satisfied that the proposed development is suitable for the purpose for which it is intended under the Agricultural District (Schedule 2) and Standards of Development (Schedule 3) as specified in the County of Newell Land Use Bylaw #1755-12. 3. No objections have been received from adjacent landowners or referral agencies with respect to the proposed development. Conditions of Development a) That this development is located as shown on the site plan approved in this application and submitted January 23, 2017. Any changes to that plan shall require the written approval of the Development Officer. b) That the property is not used for conducting a business or commercial operation without first obtaining the required permits. c) That the shipping containers are not stacked more than two containers high. d) That the following setbacks on all sides are maintained for this development: Front (south): 148 ft (45 m); as specified by Alberta Transportation Side (west): 6 ft (1.8 m); variance from 25 ft (7.6 m) MOTION CARRIED c) DP 2017004 - Lot 9, Block 1, Plan 7811389, Hamlet of Scandia, Installation of a manufactured home 2 The Manager of Planning & Development provided background information on the proposed application. There were no questions. P-17117 MOVED BY COUNCILLOR WAYNE HAMMERGREN That the Municipal Planning Commission APPROVE Development Permit 2017004 for the installation of a 1216 ft2 (113 m2) manufactured home 2 and 552 ft2 (51 m2) deck with a variance to the front yard setback, subject to the following conditions: This permit is being granted only for the installation of a 1216 ft2 (113 m2) manufactured home 2 and 552 ft2 (51 m2) deck with a variance to the front yard setback, on lands legally described as Lot 9, Block 1, Plan 7811389, NE 19-15-15 W4M. Any additional development shall require prior approval of a separate permit application. The proposed development complying with: a) The provisions pertaining to the Hamlet Residential District and all relevant schedules, as outlined in the County of Newell Land Use Bylaw #1755-12. b) All Federal, Provincial and Municipal statutes, regulations, codes and standards. c) All Alberta Building Codes and Safety Codes, where applicable. Reasons for Approval The Municipal Planning Commission has approved DP 2017004 for the following reasons: 1. The proposed development complies with the Municipal Development Plan. 2. The Development Authority is satisfied that the proposed development is suitable for the purpose for which it is intended under the Hamlet Residential District (Schedule 2) and Standards of Development (Schedule 4) as specified in the County of Newell Land Use Bylaw #1755-12. 3. No objections have been received from adjacent landowners or referral agencies with respect to the proposed development. Conditions of Development a) That this development is located as shown on the site plan approved in this application and submitted January 24, 2017. Any changes to that plan shall require the written approval from the Development Officer. b) That the property is not used for conducting a business or commercial operation without first obtaining the required permits. c) That the developer provide a security deposit, in the amount of $5000.00 to ensure the following conditions of development are met: i. proper installation of the building on a foundation or piles; skirting installed; no damage to curbs or County road ii. once installed, the structure must pass inspection by the County building inspector, prior to refunding the security Once the development has met the conditions of the security deposit to the satisfaction of the County, the deposit may be refunded. d) That the following setbacks on all sides are maintained for this development Front (northwest): 15 ft (4.6 m); variance from 20 ft (6 m) Side (northeast & southwest): 5 ft (1.5 m) Rear (southeast): 20 ft (6.1 m) e) That the developer must start construction before March 14, 2018. In the event that this date cannot be met, the developer must apply for an extension and may be required to apply for a new permit. MOTION CARRIED d) DP 2017005 - SW 3-19-14 W4M, Construction of a solar array facility The Manager of Planning & Development provided background information on the proposed application. D. Eaton indicated to MPC that his organization is looking forward to this project and from discussions with the residents, it appears that the project will be well received. Councillor B. de Jong inquired about the location of buildings on the site and how drainage will be handled. D. Eaton responded that the company is talking with the Eastern Irrigation District to ensure that drainage and their canal is managed properly. He added that the controller building will be located on the west side of the approach road and any temporary buildings used during the construction phase will be located in the northwest section of the parcel. Councillor W. Hammergren inquired if the conversion of power from DC to A C will be done on site. D. Eaton confirmed that all power conversions will be completed on the site. Councillor T. Fyfe inquired about the economic impact regarding local employment. G. Miller responded that at the peak of construction up to 200 people will be employed by the project. He added that contractors will be encouraged to employ as many people as possible from the local area. Councillor T. Fyfe also asked about the construction timetable and fencing for the project. G. Miller indicated that construction will occur over 6-8 months. D. Eaton said that the fence will most likely be chain link with some kind of screening insert. There was further discussion, including comments that the project will provide power for 3000 - 5000 homes and that the company is looking into other projects in the province. P-18/17 MOVED BY COUNCILLOR WAYNE HAMMERGREN That the Municipal Planning Commission APPROVE Development Permit 2017005 for the construction of a solar array facility, subject to the following conditions: This permit is being granted only to provide approval for the construction of a solar array facility, on lands legally described as Block 2, Plan 9710449 and a portion of SW 3-19-14 W4M. Any additional development shall require prior approval of a separate permit application. The proposed development complying with: a) The provisions pertaining to the Rural Industrial District and all relevant schedules, as outlined in the County of Newell Land Use Bylaw #1755-12. b) All Federal, Provincial and Municipal statutes, regulations, codes and standards. c) All Alberta Building Codes and Safety Codes, where applicable. d) It is the responsibility of the developer to obtain all permits from an accredited inspection agency. Reasons for Approval The Municipal Planning Commission has approved DP 2017005 for the following reasons: 1. The proposed development complies with both the Municipal Development Plan and the Intermunicipal Development Plan. 2. The Development Authority is satisfied that the proposed development is suitable for the purpose for which it is intended under the Rural Industrial District (Schedule 2) and Standards of Development (Schedule 4) as specified in the County of Newell Land Use Bylaw #1755-12. 3. No objections have been received from adjacent landowners or referral agencies with respect to the proposed development. Conditions of Development a) That this development is located as shown on the site plan approved in this application and submitted February 1, 2017. Any changes to that plan shall require the written approval of the Development Officer. b) That no building or structure involved with the solar array facility is used for living purposes. c) This permit applies to the following development on the site: 1. a combination of arrays in 2x6 and 2x3 table configurations. The 2x6 tables are 2 panels high (2m high per panel) by 6 panels wide (1 m wide per panel). The majority will be 2x6 arrays, with the smaller 2x3 arrays sited in areas where 2x6 tables cannot fit. The total area taken up by each array is approximately 22m2 for the 2x6 arrays and 11 m2 for the 2x3 arrays. There are approximately 4200 2x6 tables and 160 2x3 tables in the current design. 2. Each Inverter/Transformer Platform to cover a 22 m2 (240sq-ft) area, with 9 platforms totalling 201 m2 (2,170 sq-ft). d) The following structures will be included on the site: • (1) 20' x 60' for main office • (2) 10' x 40' trade offices • (1) 8' x 16' portable bathroom building • (1) 8' x 16' portable first aid building e) That access can be provided for Emergency Services vehicles to all sides of the site controller building. Furthermore, the developer must provide an Emergency Response Plan, to the satisfaction of the County Fire and Emergency Services Coordinator, prior to starting up operations. f) That the engineered Stormwater Management Plan is submitted to the County of Newell prior to operations commencing and that any required approvals under AEP be obtained and filed with the County. g) That a Vegetation Plan be established and submitted to the County of Newell Agricultural Services. h) That the setbacks on the site are retained as per the attached site plan. i) The developer must start construction before March 14, 2018 and be completed by March 14, 2019. In the event that these dates cannot be met, the developer may be required to apply for a new permit. MOTION CARRIED 7. POST AGENDA ITEMS There were no post agenda items. 8.
