Stabbler 1. CALL TO ORDER The Chairman called the meeting to order at 10:01 a.m. 2. EXCUSED FROM MEETING P-26/17 MOVED BY COUNCILLOR ANNE MARIE PHILIPSEN that Councillor Gordon Simpson be excused from the meeting. MOTION CARRIED 3. MINUTES 3.1 March 9, 2017 Meeting Minutes P-27/17 MOVED BY COUNCILLOR Molly Douglass that the minutes of the March 9, 2017 Municipal Planning Commission meeting be adopted as presented. MOTION CARRIED 4. CALL FOR POST AGENDA ITEMS The Chairman called for post agenda items. ARRIVED AT MEETING D.Stabbler arrived at 10:03 a.m. 5. ADOPTION OF AGENDA P-28/17 MOVED BY COUNCILLOR TRACY FYFE that the agenda be adopted as presented. MOTION CARRIED 6. DEVELOPMENT PERMITS a) DP 2017009 - NE 21-16-13 W4M, Installation of a 2nd Dwelling The Development Clerk provided background information on the proposed application. Councillor A. M. Philipsen asked about the $5000 security deposit in the report and stated that she would like to see it removed. Councillor B. de Jong inquired why a security deposit was being required for a new building and for clarification regarding the requirement for a temporary rural address sign. The Manager of Planning & Development indicated that the minimum security deposit for this type of development was $5000, as provided in Schedule 4, Section 18.15, of the Land Use Bylaw. The Development Clerk added that it is at MPC's discretion to remove or reduce the security deposit. The applicant formally requested that the $5000 security deposit be removed as a condition of permit approval. The Manager of Planning & Development stated that the condition to install a rural address sign was added at the request of Fire and Emergency Services Department, who are concerned about the lack of rural address signs during construction. She added that MPC may wish to speak with the Manager of Fire & Emergency Services for clarification. There was further discussion regarding rural address signage requirements. Councillor A. M. Philipsen moved approval of the application, with the removal of the $5000 security deposit. After further discussion, Councillor A. M. Philipsen amended the motion, with a security deposit of $2500. P-29/17 MOVED BY COUNCILLOR ANNE MARIE PHILIPSEN That the Municipal Planning Commission APPROVE Development Permit 2017009, for the installation of a 1520 ft2 (141 m2) manufactured dwelling 1 with a 150 ft2 (14 m2) front deck, to be used as a second dwelling on the farm site, subject to the conditions outlined below. This permit is being granted only to provide approval for the installation of a new 1520 ft2 (141 m2) manufactured dwelling 1 with a 150 ft2 (14 m2) front deck, to be used as a second dwelling on the farm site, on lands legally described as NE 21-16-13 W4M. Any additional development shall require prior approval of a separate permit application. The proposed development complying with: a) The provisions pertaining to the Agricultural District and all relevant schedules, as outlined in the County of Newell Land Use Bylaw #1755-12. b) All Federal, Provincial and Municipal statutes, regulations, codes and standards. c) All Alberta Building Codes and Safety Codes, where applicable. Reasons for Approval The Municipal Planning Commission has approved DP 2017009 for the following reasons: 1. The proposed development complies with the Municipal Development Plan. 2. The Development Authority is satisfied that the proposed development is suitable for the purpose for which it is intended under the Agricultural District (Schedule 2) and Standards of Development (Schedule 3) as specified in the County of Newell Land Use Bylaw #1755-12. 3. No objections have been received from adjacent landowners or referral agencies with respect to the proposed development. Conditions of Development a) That this development is located as shown on the site plan approved in this application and submitted February 27, 2017. Any changes to that plan shall require the written approval of the Development Officer. b) That the property is not used for conducting a business or commercial operation without first obtaining the required permits. c) That there is a 10 ft (3 m) separation distance between the new building and any other buildings or structures. d) The developer must start construction before April 11, 2018. In the event that this date cannot be met, the developer may be required to apply for a new permit. e) That the following setbacks on all sides are maintained for this development: Front (north): 100 ft (30 m) Side (east & west): 25 ft (7.6 m) Rear (south): 25 ft (7.6 m) f) That the applicant must install a temporary rural address sign at the road approach to the site as soon as construction starts. The sign must display the rural address as assigned by the County in the letter that will be mailed to the applicant after the permit has been approved. No other address may be displayed on the site. The sign must remain in place and in full view until it is replaced by County of Newell issued rural address sign. g) That the applicant submit a $2500 security deposit to be refunded once the manufactured home has been installed and all construction permits have been completed and closed. MOTION CARRIED b) DP 2017010 - NW 5-17-11 W4M, Installation of a solar system to service wellsite The Development Clerk provided background information on the proposed application. There were no questions from MPC. P-30/17 MOVED BY COUNCILLOR BRIAN DE JONG That the Municipal Planning Commission APPROVE Development Permit 2017010, for the as -built 3200 ft2 (297 m2) ground mounted solar system to service the wellsite at this location, subject to the conditions outlined below. This permit is being granted only to provide approval for the as -built 3200 ft2 (297 m2) ground mounted solar system to service the wellsite at this location, on lands legally described as NW 5-17-11 W4M. Any additional development shall require prior approval of a separate permit application. The proposed development complying with: a) The provisions pertaining to the Agricultural District and all relevant schedules, as outlined in the County of Newell Land Use Bylaw #1755-12. b) All Federal, Provincial and Municipal statutes, regulations, codes and standards. c) All Alberta Building Codes and Safety Codes, where applicable. Reasons for Approval The Municipal Planning Commission has approved DP 2017010 for the following reasons: 1. The proposed development complies with the Municipal Development Plan. 2. The Development Authority is satisfied that the proposed development is suitable for the purpose for which it is intended under the Agricultural District (Schedule 2) and Standards of Development (Schedule 3) as specified in the County of Newell Land Use Bylaw #1755-12. 3. No objections have been received from adjacent landowners or referral agencies with respect to the proposed development. Conditions of Development a) That this development is located as shown on the site plan approved in this application and submitted March 1, 2017. Any changes to that plan shall require the written approval of the Development Officer. b) That the property is not used for conducting a business or commercial operation without first obtaining the required permits. c) That there is a 10 ft (3 m) separation distance between the new structures and any other buildings or structures. d) The developer must start construction before March 28, 2018. In the event that this date cannot be met, the developer may be required to apply for a new permit. e) That the following setbacks on all sides are maintained for this development: Front (west): 100 ft (30 m) Side (north and south): 25 ft (7.6 m) Rear (east): 25 ft (7.6 m) f) That the applicant submit a vegetation control plan to the County of Newell Fire Services. g) That the applicant submit a site specific emergency plan prepared by the owners/operators prior to operation to the County of Newell Fire Services. h) That all roads into site must be capable of handling modern fire apparatus and that fire apparatus must be capable of driving in and out of site without backing up. 61' MOTION CARRIED c) DP 2017014 - NE 21-16-13 W4M, Approval of an existing farm building with a variance The Development Clerk provided background information on the proposed application. There were no questions from MPC. P-31/17 MOVED BY COUNCILLOR LIONEL JUSS That the Municipal Planning Commission APPROVE Development Permit 2017014, for approval of a 720 ft2 (67 m2) existing farm building with a variance to the setback on the farm site, subject to the conditions outlined below. This permit is being granted only to provide approval for a 720 ft' (67 m2) existing farm building with a variance to the setback on the farm site, on lands legally described as NE 21-16-13 W4M. Any additional development shall require prior approval of a separate permit application. The proposed development complying with: a) The provisions pertaining to the Agricultural District and all relevant schedules, as outlined in the County of Newell Land Use Bylaw #1755-12. b) All Federal, Provincial and Municipal statutes, regulations, codes and standards. c) All Alberta Building Codes and Safety Codes, where applicable. QUESTION PERIOD Councillor A. M. Philipsen asked about the vegetation control plan that was listed as a condition on the permit application for DP 2017010. The Manager of Planning & Development explained that the vegetation control condition was added to the conditions of approval at the request of the Manager of Fire & Emergency Services. 11.
