Carried Public Works Supervisor, Larry Seitz, departed from the meeting. Administration was directed to submit our concerns regarding irrigation works to the County of Lethbridge. 7. Business from Minutes 14 By-law 1218.97 -Municipal Deuelo~ment Plan A letter from the Town of Brooks requesting that we delay final reading of Bylaw 1218.97 was read to Council. .... ~~ Vote on the proposed motion from the July 10, 1997 Council meeting which reads, "Moved by ~p,~~~ , ,, ~ ~ ~~ Councillor Baksa that B -law 1218.97, receive third readin ." Y g 7 Mid-West Pump (90) ltd. -Offer to Purchase Fuel System Moved by Councillor Daniels that we counter the offer received from Mid-West Pump (90) Ltd. for the purchase of our fuel system at 56000.00. Carried. 10 Subdivision 97 NL 24 - Ptn. NW 31.18.14.4.Ochsner, Erwin & Syluie The vote on the following motion was postponed at the July 10, 1997 meeting : " Moved by Councillor Scheuerman that we approve this subdivision subject to the land Use By-law rezoning this property from Urban Fringe to Country Residential being passed; subject to the applicant meeting all requirements of the Eastern Irrigation District with respect to the conveyance of water; subject to the applicant en~ering into a Development Agreement with the County of Newell for the provision of access to the proposed southerly parcel; subject to payment of money in- place-of municipal reserve in the amount of $3,400.00, being 10% of the existing market value of the land; ,and subject to the applicant dedicating a 5-metre road right-of-way paralleling the road allowance on the west side of the proposed subdivision." July 24, 1997 Page 125 Moved by Councillor Baksa that this motion be amended by deleting the requirement for payment of money in-place-of municipal reserve and replacing it with the requirement to register a deferred reserve caveat. Alberta School Boards Association Zone 6 -Invitation to Education Growth Summit A letter from the Alberta School Boards Association Zone 6 inviting representation from County Council at an Education Growth Summit to be held in Lethbridge was presented to Council. Moved by Councillor Harbinson that Reeve Douglass and Councillor Steinbach represent the County of Newell at the Education Growth Summit. Alberta Irrigation Projects Association -Invitation to meeting regarding the regulatory review of control of local Roads and Irrigation District Bridges A letter from the Alberta Irrigation Projects Association inviting representation at a meeting to discuss the regulatory review of control of local Roads and Irrigation District Bridges to be held in Lethbridge on July 28, 1997 was presented to Council. Moved by Councillor loewen that an administrative representative attend this meeting. Carried. 5. Bryan Mushinski -letter of Resign tion A letter of resignation from Parts Foreman, Bryon Mushinski, was presented to Council. Moved by Councillor Baksa that we accept this resignation with regret. Carried. 6. Town of Brooks -Request for Comments of Subdivision Application -lots 31 & 32, Block 5 Plan 9610578 A letter from the Town of Brooks requesting our comments on the above noted subdivision was presented to Council. Moved by Councillor Berg that we inform the Town of Brooks that we have no objections to this subdivision. Carried. July 24, 1997 Page 126 7. Alberta Municipal Affairs -Extension of Section 11 0# the .Subdivision and Development Regulation A letter from Alberta Municipal Affairs regarding the extension to March 31, 1998, of section 11 of the Subdivision and Development Regulation was presented to Council. Moved by Councillor Harbinson that we accept this item as information. Carried. 8. A.A.M.D.& C. • Election of Regional Health Authority Boards A letter from the A.A.M.D. & C. enclosing the Council of Chairs concerns on the election of Regional Health Authority Boards was presented to Council. Moved by Councillor Stobbs that we continue to support the position of the A.A.M.D. & C. and that of the Palliser Health Authority that regional Health Authority Boards consist totally of elected members. Carried. 9. A.A.M.D. & C. - RHA Boundary Review Committee a~ ~- ~ ,This item will be brought back to the next Council meeting. ~ a .... 10. A.A.M.D. & C. -Growth Summit Two letters from the A.A.M.D. & C. requesting our input for the Growth Summit were presented to Council. Moved by Councillor Stobbs that we send a copy of the brief sent to the Alberta Growth Summit to the A.A.M.D. & C and that this item be brought to the next Council meeting for further input. Carried. Arrived at Meeting Councillor Daniels arrived from the lunch recess at 1:45 p.m.. 11. A.A.M.D. & C. -Alberta's 100th Anniversary Celebrations A letter from the A.A.M.D. & C. requesting submissions on appropriate ways to celebrate Alberta's centennial in 2005 was presented to Council. A.A.M.D. & C. - 1997 A.A.M.D. & C Fall Convention A letter from the A.A.M.D. & C. regarding the 1997 fall convention was presented to Council. Administration will make the appropriate registrations. 13. Municipal Affairs -New Regulation for Municipal Government Board Hearings of Appeals from the Assessment Review Board A letter from Municipal Affairs regarding a new regulation for Municipal Government Board Hearings of appeals from the Assessment Review Board was presented to Council. Moved by Councillor Berg that we accept this item as information. Carried. $, Other Business 1. Assessment Review Board Assessment Review Board members were reminded of the Assessment Review Board meeting to be held on July 28, 1997 commencing at 10:00 a.m. M • • , Excused from meetinq Councillor Steinbach excused herself from the meeting at 2:00 p.m. 2. Substance Abuse Policy The proposed Substance Abuse Policy was presented to Council. Moved by Councillor Berg that this policy be amended to decrease the tolerance level for alcohol to Zero. Carried. Moved by Councillor loewen that this policy be amended to state that all substance abuse testing be at the expense of the employer. Carried. Moved by Councillor loewen that this policy be amended so that all employees are subject to this policy. Carried. Moved by Councillor Daniels that this policy be amended by adding, where applicable, that substance abuse testing is also done to insure satisfactory performance. Carried. July 24, 1997 Page 128 Moved by Councillor Fabian that this policy be amended to indicate that the employee is responsible for any cost of treatment. Carried. Moved by Councillor Baksa that this policy be amended to indicate that any suspensions of employees for substance abuse are to be without pay. Carried. 3. Special Constable us. RCMP Contracting Administration presented information to Council regarding RCMP contracting. Moved by Councillor Daniels that we hire our own Special Constable. Carried. Moved by Councillor Baksa that our hiring committee for the Special Constable consist of the Reeve, Municipal Chairman, Public Works Supervisor, Assistant Public Works Supervisor, County ~.Y Administrator, and Assistant County Administrator. Carried. ~~ A •yA„ ~~• . • . r , 4. lake Newell Resort Road Engineering Proposals Administration presented the engineering proposals for the lake Newell Resort Road which were received from UMA, EXH, Jubilee, and Torchinsky. Moved by Councillor Daniels that we award the engineering services for the lake Newell Resort Road to UMA providing that the terms of the development agreement with H. Jager Developments Inc. have been met. Moved by Councillor Baksa that this motion be tabled. Carried 5. Cassils Wheat Pool Elevator Access Road Council was informed of an information meeting to be held on July 28, 1997 at the Cassils Community Centre at 7:00 p.m. regarding the Cassils Wheat Pool Elevator and the access road. The road surface was also discussed. 9. Treasurer's Report Moved by Councillor Loewen that the Treasurer's Report for June, 1997 be approved. Carried. Administration presented a counter offer to our counter offer #rom Willms Honey Producers ltd. to purchase the above noted lots. Moved by Councillor Stobbs that we accept this offer. Carried. Moued by Councillor Harbinson that we concentrate our efforts on redoing our land Use Bylaw so that it adheres to the Municipal Deuelopment Plan and that we hold off on the Inter-municipal Deuelopment Plan until our land Use Bylaw has been redone as an extension has been granted to Section 11 of the Subdivision and Development Regulation.
