Minutes Minutes of the March 6, 1991 meeting were presented. Moved by Councillor Baksa that we adopt these minutes as circulated. Carried. 3. Call for Post Agenda Items The Reeue called for post agenda items. 4. Adoption of Agenda Moved by Councillor Stobbs that we adopt the agenda as amended. Carried. March 20, 1997 Page 48 5. Business from Minutes 13.3 litter Bylaw 1206-91 Moved by Councillor Daniels that Bylaw 1206.97 be amended by incorporating the suggestions from Brownlee Fryett, our legal advisors. Carried. Moved by Councillor Baksa that Bylaw 1206.91 receive third reading. Carried. 12.2 Subdivision 93 SE 100 -Extension Arrived at Meeting Councillor Harbinson arrived at the meeting at 10:01 a.m. Moved by Councillor Harbinson that we approve aone-year extension for the above-noted subdivision. Carried. ;~ .... MPC Subdivision 91 NL 02 • N'/z 21.16.16.4 - Sandau Donald & lorrie Moved by Councillor Daniels that this item be lifted from the table. Carried. Vote on the amended motion which now reads: "Moved by Councillor Baksa that we approve this subdivision subject to the applicant meeting a(I requirements of the Eastern Irrigation District with respect to the conveyance of water, and subject to dedication of a 5-metre road right-of- way along the one mile north and one-half mile east of the property containing the proposed subdivision." Moved by Councillor Stobbs that this motion be tabled. Carried. MPC Subdivision 91 Nl 03 - SE 13.19.15.4 -lakeside Farm Industries Moved by Councillor Baksa that we lift this item from the table. Carried. Vote on the amended motion which now reads: "Moved by Councillor Fabian that we approve this subdivision and waive the agricultural parcel size requirement for the proposed parcel subject to the applicant meeting all requirements of the Eastern Irrigation District with respect to the conveyance of water; subject to the applicant entering into a Development Agreement with the County of Newell for the provision of accesses to both the proposed and remnant parcel; and March 20, 1997 Page 49 subject to dedication of a 5•metre road right-of-way for the half mile south of this property and a 10-metre right-of-way on the east side of the property." Carried. 911 - B}~laws The latest revision of the 911 By-laws was presented to Council. Maned by Councillor Baksa that we approve the By-laws of the Newell 911 Dispatch Association. Carried. 6. Correspondence 1. Resignation -Bob Baxter A letter of resignation from Bob Baxter was presented to Councif. Moved by Councillor Stobbs that we accept this resignation with regret. Carried. 2. Carmen Thomsen -Rolling Hills lagoon ~- ~~ A letter from Carmen Thomsen regarding the Rolling Hills lagoon was presented to Council. Administration is to send a letter advising that we sympathize with her concerns and that it is unfortunate the sewage field in Rolling Hills was not adequate, but we feel we cannot give any refunds. 3. Town of Brooks -Development Application - 97 D 66 The above-noted application was presented to Council. Administration is to advise the Tawn of Brooks that the County does not maintain this portion of highway and that they should advise Alberta Transportation & Utilities of this development permit. This letter should also ask them to provide more details regarding accesses on future development permits. 7. Other Business 1. Spring Convention Resolutions Council reviewed the resolutions that will be brought forth at the Spring Convention and arrived at a consensus. March 20, 1997 Page 50 2. By•election • Division 6 (Bassano area) Moved by Councillor Stobbs that Nomination Day for a By•election in Division 6 (Bassano area) be set for May 1, 1997, with an election be held on May 29, 1997, if required, and that we con#act Ella Endersby to see if she will act as Returning Officer f or the County. Carried. 3. Borrowing Bylaw 1211.97 Bylaw 1211.97, being a Borrowing By•iaw for the County of Newell, was presented to Council. Moved by Councillor Scheuerman that By-law 1211.97 receive first reading. Carried. Moved by Councillor Stobbs that Bylaw 1211.97 receive second reading. Carried. Moved by Councillor Daniels that consent of Council be given for third and final reading of Bylaw 1211.91. Carried Unanimously. ~~ Moved by Councillor Baksa that Bylaw 1211.91 receive third reading. Carried. .... 4 1 ! ` ~~ 4. Petition The Administrator advised that she had received a petition from Julian & Bonny M. Annicchiarco, and advised Council that this is not a legal petition. Moved by Councillor Harbinson that a letter be sent to the petitioners advising them that this is not a legal petition. Carried. 8. Cheques for Payment Moved by Councillor Harbinson that Cheques #9451.9584, in the amount of $285,677.99, be approved for payment. Carried. 9. Assessment Review Board N o report. Airport Commission No report. ..., r r ~' ~ ~ :.~ Disaster Seruices ~.i ,a Councillor Scheuerman gave this report. He advised Council that a meeting of the Disaster Seruices was held on March 11, 1991 to review and make recommendations to Council on regionalization. The Committee's recommendations were that Council check into a Joint Regional Municipal Emergency Plan only. They feel more could evolve later but we should deal with this one step at a time. Moved by Councillor Daniels that we contact the other municipalities within the County of Newell to see if they are interested in the prospect of a Regional Municipal Emergency Plan. Carried. .... Councillor Scheuerman also presented information from Alberta Transportation & Utilities on the National Emergency Preparedness Week, May 5 -11, 1991, asking if the County would like to participate in the events for this week. Moved by Councillor Scheuerman that we accept this item as information. Carried. March 20, 1997 Page 52 Municipal library Board No report. Foothills little Bow Association No report. Municipal Budget Committee Councillor Stobbs aduised that a meeting will be held on March 24, 1991. Municipal Planning Commission No report. ' Inter-municipal Subdivision Authority ~~ No report. Subdivision & Development Appeal Board Councillor Daniels advised that a Subdivision Appeal is being held on March 21, 1991. Brooks & District Ambulance Association Councillor Harbinson gave this report. ..., Newell Regional Solid Waste Management Authority Councillor Daniels gave this report and requested permission to attend a Waste Management Facilities Regulation Seminar. Moved by Councillor Scheuerman that we approve the attendance of Councillor Daniels at the Waste Management Facilities Regulation .Seminar. Carried. John Deli -Assessor's Convention Moved by Councillor Harbinson that we approve the attendance of our Assessor, John Dell, at the Assessor's Convention, April 22.25, 1991. Carried. Alberta Municipal Affairs -Pipeline Assessment Administration read a letter from Alberta Municipal Affairs advising that the pipeline assessments will be delayed this year but a preliminary assessment will be sent out around the end of March in order that we can carry on with our budgeting process. 3. Alberta Agriculture, Food & Rural Development A memo from Alberta Agriculture, Food & Rural Development regarding a site search for a new hog processing facility was presented to Council. Administration is to send a letter to Alberta Agriculture, Food & Rural Development advising them that we cannot meet the time frame of March 26th for sites but that we feel there would be suitable locations within the County close to highways, water and gas, that they could investigate. 4. CP Abandoned Right-of-way Maned by Councillor Harbinson that the County up-front the legal costs for the preliminary work regarding the Rosemary and Gem abandoned railway spurs and that this will be paid later by the adjacent landowners. Carried. L~ ~~ ~ Moved by Councillor Daniels that we advise the Committee that the County is interested in the abandoned rail line in Twp. 22 Rge. 16, being NE 10, NW 10, SW 15, SE 16, NE 16, NW 16, NE 1l, SE 20, NE 20, SE 29, NE 29, SE 32 & NE 32. Carried. Moved by Councillor Harbinson that we investigate the Canadian Pacific Ballast Pit Property, being portions of SW 29 & E'/z 30.23.14.4 Control & Verger, and advise Canadian Paci#ic that the County is interested in purchasing this area and the right-of-way in Secs. 29, 30 & 31.23.14. Carried. Moved by Councillor Harbinson that Councillor Douglass be the County's voting representative an the Committee regarding the abandoned right-of-ways on the Rosemary and Gem spurs and that Councillor loewen attend these meetings for in-put far Division 7.
