Minutes of Council Meeting
July 20, 1995
The regular Council Meeting of the County of Newell No. 4 was held in the County Office at
Brooks, Alberta on Thursday, July 20, 1995 commencing at 1 0:00 a.m.

2. Minutes
Minutes of the July 6, 1995 meeting were presented. Moved by Councillor Douglass that we
approve these minutes as amended. Carried.
Minutes of the July 6, 1995 Public Hearing were presented. Moved by Councillor Barg that we
adopt these minutes as circulated. Carried.
3. Call for Post Agenda Items
The Chairman called for post agenda items.

Moved by Councillor Stobbs that we adopt the agenda as amended. Carried.
5. Delegation
1. Lake Newell Economic Development Authority Video Presentation
Lake Newell Economic Development Authority Representatives Debra Thompson-Sweep and Pat
Hemsing were in attendance and presented the "Lake Newell Region" video to Council. Other
items discussed were the traffic concerns at the LakesidelTranscanada intersection, affordable
housing and other involvements of the Lake Newell Economic Development Authority.
6. Business from Minutes
10 By-law 1147-95 - Bylaw Enforcement OfficerlSpecial Constable
The Assistant Administrator presented a revised proposal for a By-law Enforcement OfficerlSpecial
Constable By-law. Moved by Councillor Loewen that By-law 1147-95, being a bylaw to establish
the designated officer position of By-law Enforcement Officer and to assign power and duties to
the By-law Enforcement Officer, receive first reading. Carried.

Council will review the code of conduct for the Special Constable at the next meeting.

11.3 Policy for Construction and Inspection of Drainage and Roatls in Subdivisions
Moved by Councillor Loewen that this item be referred to the Municipal Committee meeting.
Carried.
11-6 Seminar Reports
1. Elected Officials Symposium
Councillors Fabian, Berg and Loewen gave a report on the elected officials symposium.
2. Brownlee Frvett -Bill 32 Seminar
Councillor Barg gave a report on the Brownlee Fryett Bill 32 Seminar.
14-1 Land Use Channe - Rantlv & Cory Baksa • Agriculture to Mobile Home Park - SW 1-19-14.4
Randy and Cory Baksa were in attendance and presented further information on their proposed
land use change to Council. Council will inspect the site during their lunch recess.

Council recessed for lunch from 12:15 p.m. to 2:15 p.m.
Moved by Councillor Scheuerman that we refuse this land use change as it is the same basic
area that was previously applied for, and individuals that attended the Public Hearing were
opposed to this land use change. Defeated.
By-Law 1151-95
Movetl by Councillor Douglass that By-law 1151-95, being a By-law to approve the land use
change in SW 1.19.14.4 from agriculture to Mobile Home Park, receive first reading. Carried.

Agriculture Community

7. Corresaondence
1. Alberta Planning Board -Subdivision Appeal - NW 28-19.13.4
A letter from Alberta Planning Board regarding a subdivision appeal against -Kerr Torkelson's
proposed subdivision in the NW 28-19.13-4 was presented to the Council. More information will
be obtained on the appeal, and if necessary a representative from the Municipal Planning
Commission will be in attendance.
2. A.A.M.D.& C. -Discussion Paper on Alberta Cemeteries & Prearranged Funeral Legislation
A letter from the A.A.M.D.& C. regarding the discussion paper on Alberta Cemeteries and
Prearranged Funeral Legislation was presented to Council. Moved by Councillor Barg that we

3. Task Force on Am ~~
bulance and Patient Transportation Discussion Paper - A Model of
Regional Health AuthoritylMunicipallAmbulance Operator Cooperation in the Delivery of
Ambulance Services"
A letter and discussion paper received from the Task Force on Ambulance and Patient
Transportation was presented to Council. Moved by Councillor Berg that this item be referred
to the next Council meeting so that members have an opportunity to review the discussion paper.
Carried.
4. County of Forty Mile No. 8 -A.S.B. Meeting -July 28 1995
Letter from the County of Forty Mile No. 8 regarding a special Agricultural Service Board Meeting
for Region 1 was presented to the committee. Councillors Daniels, Fabian, Berg, Loewen and
Douglass will attend this meeting.

4-1. Steve Bothi • W.G.T.A. and Crow Benefit
A Letter from Steve Bothi regarding the termination of the W.G.T.A. and the Crow Benefit was
presented to Council. Moved by Councillor Fabian that a letter of thanks be sent to Mr. Bothi
for the information and informing Mr. Bothi that the County is trying to obtain funding from the
W.G.T.A. payout for use on our road infrastructure. Carried.
5. A.A.M.D. & C. -Alberta Transportation Seminar on the Contracting of Primary Highway
Maintenance
Letter from the A.A.M D. & C. regarding seminars on the contracting of primary highway
maintenance was presented to Council. Moved by Councillor Berg that personnel from Public
Works andlor Administration attend the information seminar. Carried.
8. Other Business
1. Road Closing By-law 1118-95 - NW 23.18.16.4
Council was informed that By-law 1118.95, being a by-law to close and transfer a portion of
Road Plan 2747 B.M. located in the NW 23.18-16-4, received approval for closure and sale from

Moved by Councillor Loewen that By-Law 1118-95, being a by-law to close and transfer a portion
of Road Plan 2747 B.M. located in the NW 23.18.16.4, receive third and final reading. Carried.
2. Road Closing By-law 1117-95 - NE 35-18-15-4
Council was informed that By-law 1117-95, being a bylaw to close and transfer a portion of the
road allowance in Lot 1, Block 1, Plan 8211419 - NE 35-18-15-4, received approval for closure
and sale from the Minister of Transportation.
Moved by Councillor Stobbs that By-law 1117-95, being a by-law to close and transfer a portion
of the road allowance in Lot 1, Block 1, Plan 8211419 - NE 35-18.15-4, receive second reading.

of the road allowance in Lot 1, Block 1, Plan 8211419 • NE 35.18.15-4, receive third and final
reading. Carried.
3. Secondary Highway 873 -Expropriation
A copy of the inquiry officers expropriation report was presented to Council.
Moved by Councillor Loewen that:
Upon being satisfied that the period within which notice of objection to the expropriation
mentioned hereunder has expired; and
Upon being satisfied that Notice of Intention to Expropriate the lands mentioned hereunder
has been served in accordance with s. 8(2) of the Expropriation Act; and
Upon being satisfied that Notice of Intention to Expropriate the lands mentioned hereunder
has been published in accordance with s. 8(4) of the Expropriation Act;

1. That having considered the report of the Inquiry Officer dated July 14, 1995, Council of the

Moved by Councillor Stobbs that:

4. Offer to Purchase -Lots 9 & 10, Block 2, Plan 8210258 • Rolling Hills
Moved by Councillor Barg that the County counter the above Offer To Purchase at 53500.00
plus G.S.T. subject to the purchaser paying for the installation of the gasline; subject to the
County paying for the installation of power to the lot line and subject to the power being
installed as per Transalta Utilities schedule, and that this counter offer be open for acceptance
until August 9, 1995. Carried.
_, Information will be brought to the next Council meeting regarding the status of the installation
of power lines by Transalta.
5. Safety Codes Act -Fire Prevention, Fire Fighting Provisions
The Assistant Administrator presented a report from a meeting he attended regarding the Fire
Prevention and Fire Fighting Provisions of the Safety Codes Act. A Representative from Alberta
Labour will be invited to the next Council meeting to provide further information.

Moved by Councillor Fabian that a letter be sent to Vern Arnold thanking him for his attendance
at our 1996 A.S.B. Summer Tour Committee Meeting and indicating to Mr. Arnold that we will
not be hiring a coordinator at this time but will keep this option open should we require this
service in the future; and that a cheque be issued to Mr. Arnold for his mileage and time to
attend the committee meeting. Carried.

Foothills Little Bow Association
A resolution will be prepared to present to the Little Bow Association for their consideration to
bring forward at the Fall A.A.M.D. & C. convention. This resolution will encourage the Provincial
Government to adopt legislation that will empower municipalities to ensure the right of the
agricultural community to farm.

1. M & E Stakeholders Groua -Industry Presentation on the M & E Taxation Issue
A letter from the M & E Stakeholders Group regarding an industry presentation, on the M & E
Taxation issue, to the standing policy committee on Natural Resources and sustainable
development was presented to Council for information.
2. Town of Brooks -Annexation
A letter from the Town of Brooks regarding their progress on their proposed annexation was
presented to Council. Moved by Councillor Stobbs that we accept this item as information.
Carried.
3. Lake Newell Economic Development Authority -Alberta Report Magazine Special Feature
A letter from the Lake Newell Economic Development Authority regarding a special feature on
the County of Newell area by the Alberta Report Magazine and the proposed advertising fees was
~~ presented to the Council. More information and a sample special feature will be obtained.

4. A.A.M.D.& C. -Coordination of Municipal and Provincial Truck Routes and Permit
Renuirements for Oversized Loads
A letter from the A.A.M.D.& C. looking for representation on a joint working committee to
establish the coordination of Municipal and Provincial truck routes and permit requirements for
oversized loads was presented to Council. Moved by Councillor Daniels that Councillor
Scheuerman be nominated to sit as a committee member. Carried.

5. Foothills Little Bow Association • Dialogue with Minister of Transportation
A letter from Foothills Little Bow Association regarding an upcoming dialogue session with the
Minister of Transportation was presented to the Council. Council members interested are
authorized to attend.
Moved by Councillor Loewen that the August Municipal Committee meeting be changed to August
9, 1995 at 10:00 a.m. Carried.
6. Speed Limit By-Law - By-law No. 1150.95
Moved by Councillor Stobbs that By-law 1150-95, being a by-law to reduce certain speed limits
to facilitate the widening and overlay of S.H. 873, receive first reading. Carried.

to facilitate the widening and overlay of S.H. 873, receive second reading. Carried.

7. Lakeside Packers • Licence to Cross County Road Allowance Agreement • Rock Lake Water
Supply Line from Rock Lake to Cann Lake
Moved by Councillor Douglass that the County grant waivers of the setback requirement for this
water pipeline in the areas indicated on the water line route drawing, subject to Lakeside
Packers, at no expense to the County, moving or removing the pipeline in the affected areas if
the applicable roads require future development and would be affected by the location of this
pipeline. Carried.
8. Secondary Highway 525 Reserve Fund
Moved by Councillor Daniels that a Secondary Highway 525 Reserve fund be established and that
contributions to this reserve come from Division 1 Road Allotments. Carried.

Guidelines for leasing the operation and management of Emerson Park will 6e drafted and
presented at the next Council meeting.

Moved by Councillor Barg that we move into camera. Carried.

1. Expropriation Proposed Payment
Moved by Councillor Daniels that we approve the proposed payments for the expropriation of
land on S.H. 873 as recommended by our legal council, Fleming Kambietz, Barristers and
Solicitors. Carried.

2. Assessment Review Board
Moved by Councillor Loewen that fees be established for the hearing of complaints by the
Assessment Review Board as follows:
a) Residential~Farmland Rated Properties: 550.00 per Roll Number for each roll number over
five being heard per ratepayer or ratepayers agent.
b) Commercialllndustrial Rated Properties: 5100.00 per Roll Number for each roll number
over five being heard per ratepayer or ratepayers agent;
and that fees be refunded for each roll number in which the rate payer or ratepayers
agent is successful in reducing the assessment. Carried.
