Bowen Excused from Meetinn All members were in attendance at this meeting. 2. Minutes 3. 4. Minutes of the May 25, 1995 meeting were presented. Moved by Councillor Douglass that we adopt these minutes as circulated. Carried. Call for Post Agenda Items The Chairman called for post agenda items. Adoption of Agenda Moved by Councillor Stobbs that we adopt the agenda as amended. Carried. June 8, 1995 Page 98 5. Business from Minutes 10- Municipal Library Board Representative - Divs 5 & 10 Moved by Councillor Berg that we appoint Cheryl Pierson as the County of Newell representative on the Municipal Library Board for Division 5 & 10. Carried. 6. Correspondence 1. CP Rail -Disposition of Abandoned Right-of-way The Administrator presented a letter from CP Rail advising they had received our letter stating we are interested in purchasing a portion of this right-of-way. More information will be forthcoming. 2. Alberta Sport Recreation - 1998 Winter Games This item was received as information. 7. Other Business 1. By-law to Prevent Littering by Covering Loads Councillor Daniels reported that he is obtaining more information on this matter. 2. A.A.M.D. & C. -Internal Trade Agreement Moved by Councillor Douglass that we advise the A.A.M.D. & C. that we support their current position on the Internal Trade Agreement. Carried. 3. Closing & Selling of Road Allowance E of NE 3-20-17-4, E of SE 3-20-17-4, N of 35-19-17-4, Pt. E of NE 35-19-17-4, Pt. E of SE 2-20-17-4, Pt. E of NE 36-19.17-4 Administration advised that no requests to be heard by Council had been received. Moved by Councillor Baxter that we send this By-law to the Minister of Transportation & Utilities for approval. Carried. June 8, 1995 Page 99 8. Committee Reports Municipal Councillor Scheuerman gave this report. M.P.C. 95 SE 48 - SW 14-20-14-4 -Bert Rommens Reeve Rommens asked to be excused from discussion and voting on this item. Councillor Scheuerman asked to be excused from discussion and voting on this item. Moved by Councillor Barg that we deny this subdivision as Council did nat approve the Land Use Change and, therefore, it does not conform to our Land Use By-law. Carried. Reeve Rommens and Councillor Scheuerman resumed participation in the meeting. Land Use Change -Guy & Nancy Doherty Pt. SW 13-19-14-4 Parcel A Plan IRR. 1363 ~-law 1144-95 Moved by Councillor Barg that we approve this Land Use Change from Agriculture to Country Residential subject to registration of the Registered Plan for this area. Carried. Moved by Councillor Barg that By-law 1144-95, being a By-law to amend Land Use By-law 1004.90 in Pt. SW 13-19-14-4 Parcel A Plan IRR 1363 from Agricultural to Country Residential, receive first reading. Carried. 9. Cheques for Payment Moved by Councillor Barg that Cheques #5783 - 5990, in the amount of $575,966.56, be approved for payment. Carried. ~-~ ~ (~ June 8, 1995 r~ `_-' Page 100 10. Post Agenda Items 1. Scandia Water Reserve Administration advised that funding has been approved from Alberta Transportation & Utilities for the up-grading of the Scandia Water Treatment Plant, and the portion that the local residents will have to pay is approximately 58,800.00. Moved by Councillor Stobbs that we approve the expenditure for this repair out of the Scandia Water Reserve Account. Carried. 2. H. Jager Development Administration presented information on the H. Jager Development and concerns regarding their building codes and by-laws and the County's approval. The Development Control Officer is to get a letter of approval from H. Jager Development Inc. when development permits for this subdivision are requested. ' 3. Assessment Open House Administration advised Council that an Open House to assist the ratepayers in understanding the assessment notices will be held June 26-29, and also evenings of June 27 & 28. Moved by Councillor Barg that we place this advertisement in the Brooks & Bassano papers. Carried. 4. Used Oil Councillor Fabian presented information on a Stakeholders Meeting to 6e held in Edmonton on June 27th regarding Alberta Used Oil Management Association's Pilot Project. Moved by Councillor Stobbs that Councillor Fabian be allowed to attend this Meeting. Carried. 11. Delegations 1. Lavern Rase -Portion of Road Allowance Lying N of 32-18-15-4 Lavern Rose was present at the meeting and asked Council to reconsider their position on the closing and lease or sale of this road allowance. Af#er considerable discussion, it was moved by Councillor Barg that we proceed with the advertising far the closing and sale of this road allowance subject to Ministerial Approval; the consolidation of this area with the Ti#le to Block 2; the applicant being responsible for the cast of advertising and the transfer and registration, if approved; and that the cost of acquiring this property shall 6e set at 51,200.00 per acre. The regular Council Meeting reconvened at 3:20 p.m. after the Public Hearing. Excused from Meeting Councillor Scheuerman asked to be excused from the meeting at 2:05 p.m., during the Public Hearing. 1. Land Use Change - By-law 1131-95 - Pt. NW 28-20-14-4 Block 1 Plan 8710368 Warren & Helen Fulton -Urban Fringe to Country Residential ~~, Moved by Councillor Barg that By-law 1131-95 receive second reading. Carried. Moved by Councillor Loewen that By-law 1131-95 receive third and fiinal reading. Carried. This By-law is to take effect on the date of registration of the Registered Plan for this area. 2. Land Use Change - By-law 1132-95 - Pt. SE 3-19.14-4 Jay deJong : Country Residential to Light Industrial ~~ Moved by Councillor Darnels that By-law 1132-95 receive second reading. By-law 1128-95 to Amend Cassils Road Area Structure Plan By-law 1036-91 - SE 6-19-14-4 Moved by Councillor Barg that By-law 1128-95 receive second reading. Carried. 8. By-law 1130-95 to Incorporate Amendments to Cassils Road Area Structure Plan into Land Use By-law Moved by Councillor Douglass that By-law 1130-95 receive second reading. Carried. Bowen The Reeve opened the meeting and presented information regarding the first item to be dealt with at the Public Hearing. 1. By-law 1131-95 -Land Use Change - Pt. NW 28-20-14.4 Block 1 Plan 8710368 Warren & Helen Fulton -Urban Fringe to Countrv Residential No members of the public were in attendance to discuss this Land Use Change. 2. By-law 1132-95 -Land Use Change - Pt. SE 3-19-14-4 Jay deJonQ -Countrv Residential to Light Industrial The applicant, Jay deJong, was in attendance at the Hearing. Other members of the public also in attendance were: Howard & Audrey Muhlbeier, Gordon Olsen, Darren & Lavonne Visser, Randy Baksa, Susan Baksa, Doris Bachand, Jim & Elizabeth Baksa, Joe Duenk, Wayne Evans, and Srian Reinboldt. Administration read letters from Oonald J. & Elizabeth Hajash and James T. Baksa. Other members of the public also in attendance were: Joy Christman, Jock Airth and Darren Visser. Administration read a letter from Ralph & Lorena Siemens. Members of the public presented their views regarding this proposed Land Use Change. 4. By-law 1134-95 -Land Use Change - Pt. NW 9-18-14-4 Monty Mortensen -Apricultural to Country Residential The applicant, Monty Mortensen, was in attendance at the Hearing. Other members of the public also in attendance were: Carol Johnson, Tammy Dafoe, Terry Vanak, Rick Bos and Norma Schmidt. SW 18-19-13-4 Susan Schoneck -Apricultural to Country Residential The applicant, Susan Schoneck, was in attendance at the Hearing. Other members of the public also in attendance were: Steve & Irma Merkl, Jock Airth, Karl Slomp, Gloria Schuett, Les Schuett and Frank Merkl. Members of the public, and the applicant, presented their views regarding this proposed Land Use Change. 7. ~-law 1128-95 to Amend Cassils Road Area Structure Plan By-law 1036-91 - SE 6.19-14-4 Members of the public in attendance at this Hearing were: Harold & Merle Prentice and Nick Salonka. Administration read a letter from the Town of Brooks. Members of the public presented their views regarding this proposed Land Use Change. 8. By-law 1130-95 to Incorporate the Amended Cassils Road Area Structure Plan into the Land Use By-law Members of the public in attendance at this Nearing were: Harold & Merle Prentice and Nick Salonka. Members of the public presented their views regarding this proposed amendment. 9. By-law 1129-95 to Amend Land Use By-law 1004-90 for Rural Residential Use and the addition of a County Residential 2 (CR2) District Members of the public in attendance at this Hearing were: Jock Airth and Karl Slomp.
