HomeMy WebLinkAbout1994-02-24 Council (Regular) MinutesCounty of Newell No. 4 Minutes of Council Meeting February 24, 1994 The regular Council Meeting of the County of Newell #4 was held in the County Office at Brooks, Alberta on Thursday, February 24, 1994 commencing at 10:00 a.m. Members Present Councillors W. Daniels Administrator V. Fabian N. Berg R. Burton W. Rommens B. Baxter M. Loewen B. Scheuerman P. Barg M. Bowen 1. Excused from Meeting Moved by Councillor Barg that Reeve Douglass be excused from this meeting. Carried. Deputy Reeve Rommens took the chair in the absence of Reeve Douglass. 2. Minutes Minutes of the February 10, 1994 meeting were presented. Moved by Councillor Loewen that we approve these minutes as circulated subject to questioning. Carried. 3. Business from Minutes 8-3 Hamlet Water Agreements Moved by Councillor Berg that we approve the draft copies of the Hamlet Water Agreements with the E.I.D. Carried. February 24, 1994 Page 22 10-2 ReQuest for Road Closure - N of NW 36-20.15-4 & E of 35-20-15.4 By-law 1094-94 After discussion, it was moved by Councillor Barg that we approve the road closure and leasing of that portion of the road N of NW 36.20.15.4 and that By-law 1094.94 receive first reading. Carried. Moved by Councillor Loewen that By-law 1094-94 receive second reading. Carried. Moved by Councillor Berg that we deny the request for the closure of the road E of 35-20-15-4 as this is being used for public travel. Carried. 8.4 Rental of Haddington School Councillor Berg and the Administrator provided further information on the present rental fees of buildings and costs the County is now incurring on the Haddington School. Councillor Berg was instructed to obtain more information to bring back to a future Council Meeting. 4. Correspondence 1. CP Rail System - Right-of-way Taxes Letter from the CPR regarding their concerns on paying taxes on operating right-of-ways was presented to Council. After discussion, it was moved by Councillor Fabian that we deny any exemption of taxes on the railway right-of-way. Carried. 2. A.A.M.D. & C. - Ambulance Service Act Letter from the Alberta Association of Municipal Districts & Counties regarding regulations under the Ambulance Service Act was presented to Council for information. 3. Jubilee Insurance - Umbrella Liability Insurance Letter from Jubilee Insurance advising that a fifth layer of coverage is available to Municipalities, was presented to Council. Moved by Councillor Barg that we receive this letter as information. Carried. February 24, 1994 Page 23 4. Canada Alberta Infrastructure Works Program Information on the Canada Alberta Infrastructure Works Program was presented to Council. This will be reviewed and brought back at a later meeting. 5. Other Business 1. 1994 Ambulance Requisition The 1994 Ambulance Requisition in the amount of $87,043.07 was presented to Council. Moved �-- by Councillor Fabian that we accept this requisition as presented. Carried. 2. 1993 Membership Fees After discussion on the membership list, it was moved by Councillor Baxter that we maintain our membership with the Brooks & District Chamber of Commerce, Hudson Bay Route Association, /0 Bassano Chamber of Commerce, Foothills Little Bow Association, and A.A.M.D. & C. Carried. Moved by Councillor Barg that we reduce the $4,000.00 grant to the Brooks Airport by 5%. Moved by Councillor Fabian that we amend this motion to read: "that we reduce the grant to the Brooks Airport to $3,000.00." Vote on the amendment - Lost. Vote on the original motion - Carried. 3. Report on P.W. Supervisor's & Administrator's Meeting with County of Wheatland, M.D. of Starland & M.D. of Rocky View The Administrator reported that an informal meeting with personnel from the County of Wheatland, M.D. of Starland and M.D. of Rocky View took place to see if there are areas where we could share services or use machinery and equipment available in these areas. 4. Appeal Hearing re: Town of Brooks & Martin's Feedlot The Administrator advised that Leo Burgess, of Brownlee Fryett, will be attending this Hearing on behalf of the County. February 24, 1994 Page 24 5. Breakell Property The Administrator advised Council that a Partial Discontinuance has been presented and the County was withdrawn from this action. 6. Committee Reports Municipal Councillor Scheuerman gave this report. Board of Education Councillor Berg reported on the A.S.B.A. Meeting and also on the meeting with the County of Wheatland and the County of Vulcan. A.S.B. No report. Brooks Health Centre Councillors Fabian & Rommens presented information on the Brooks Health Centre. Bassano Hospital Councillor Baxter gave this report. Southeastern Alberta Health Unit Councillor Daniels gave this report. Senior Citizens' Home No report. February 24, 1994 Page 25 Municipal Salary Negotiating Committee No report. S.E.A.R.P.C. Councillor Barg gave this report. Airport Commission No report. Disaster Services Councillor Scheuerman gave this report and advised that there is a seminar available on Public Health & Safety. After discussion, it was moved by Councillor Fabian that the P.W. Supervisor, Assistant P.W. Supervisor, Administrator, and Assistant Administrator, attend this seminar if they wish. Carried. Municipal Library Board No report. Foothills Little Bow Association No report. Municipal Budget Committee No report. February 24, 1994 Page 26 M.P.C. a) Land Use Change - Joe Prins - SE 1-19-15-4 By-law 1095-94 Moved by Councillor Barg that we approve this Land Use Change from Urban Fringe to Country Residential and that By-law 1095-94 receive first reading. Carried. b) Subdivision 94 SE 12 - E.I.D./Rommens Farms Ltd. - 15-18.16-4 Moved by Councillor Loewen that Councillor Rommens be excused from discussion and voting on this Subdivision. Carried. Councillor Rommens left the Council Chambers. Moved by Councillor Daniels that Councillor Loewen take the chair. Carried. Moved by Councillor Barg that we approve Subdivision 94 SE 12. Carried. Councillor Rommens returned to the Council Chambers and took over the chair. c) Subdivision 94 SE 13 - E.I.D. - SE 11-15-13-4 Moved by Councillor Barg that we approve this Subdivision. Carried. d) Subdivision 94 SE 15 - William Harstead - SE 8-20-14.4 Moved by Councillor Barg that we approve this Subdivision. Carried. e) Subdivision 94 SE 17 - Ted Freimuth - NW 31.17-13-4 Moved by Councillor Loewen that Councillor Barg be excused from discussion and voting on this Subdivision. Carried. Councillor Barg left the Council Chambers. February 24, 1994 Page 27 Moved by Councillor Scheuerman that we approve this Subdivision. Carried. Councillor Barg returned to the Council Chambers. D.A.B. Newell Regional Solid Waste Management Authority Councillor Daniels gave this report. Urban Fringe Committee No report. Newell Minibus Committee The Administrator presented the Newell Minibus Transportation Report for January. Moved by Councillor Burton that we accept this report. Carried. February 24, 1994 Page 28 Town of Brooks Environmental Advisory Committee No report. A.A.M.D. & C. Councillor Fabian gave this report. 7. Post Agenda Items 1. A.A.M.D. & C. - Questionnaire Council is to present the Administrator with two questions they may wish to ask Premier Ralph Klein at the Spring Convention. 2. Road Closure - E of SE 22-18-16-4 By-law 1096-94 & By-law 1097.94 ' The Administrator presented two letters from the E.I.D. requesting road closures: a) portion of road E of SE 22-18.16.4 - for the closure and consolidation into a portion of land in SW 23-18.16-4. After discussion, it was moved by Councillor Burton that we approve the closure and consolidation of this portion of road allowance and that By-law 1096-94 receive first reading. Carried. Moved by Councillor Loewen that By-law 1096-94 receive second reading. Carried. b) The second portion of this road allowance is in the E.I.D. canal and they are requesting closure and consolidation of Title to the E.I.D. After discussion, it was moved by Councillor Berg that we approve the closure and consolidation of this portion of road and that By-law 1097-94 receive first reading. Carried.
