HomeMy WebLinkAbout1989-05-25 Council (Regular) MinutesCounty of Newell No. 4 Council Meeting May 25, 1989 The regular Council Meeting of the County of Newell No. 4 was held in the County Office at Brooks, Alberta on Thursday, May 25, 1989 commencing at 10:00 a.m. Members Present Reeve Councillors Administrator F. Workes P. Wallace V. Fabian K. Conners L. Nelson K. Bulger F. Regehr B. Scheuerman M. Douglass W. Wells D. James 1. Minutes Minutes of the May 11, 1989 meeting were presented to Council. Moved by Councillor Douglass that we adopt these minutes as circulated. Carried. 2. Business from Minutes 5-8 Town of Bassano - Disaster Services - Mutual Aid No report. 12-2 Chizik Road No report. 6-4 A.A.M.D. & C. - Mission Statement & Goals Council reviewed the A.A.M.D. & C. Mission Statement & Goals. After discussion, it was moved by Councillor Wells that we accept the Statement & Goals as presented by the Association and that they be advised of this. Carried. 3. Correspondence 1. Southeastern Alberta Health Unit - Water Reports Water reports from the various Hamlets were presented, all being satisfactory. ~g~~~ 2. Southeastern Alberta Health Unit - Landfill Site Report This report was presented to Council for information along with a report from Ed Pratt, the A.S.B. Fieldman. 3. Minister of Environment - Environment Week Letter from the Minister of Environment advising that the week of June 4 - 10, 1989 has been set for Environment Week was presented. Moved by Councillor Wallace that the County proclaim the week of June 4 - 10 as Environment Week within the County of Newell. Carried. Page 48 May 25/89 4. J. Slomp - Road Allowance Letter from J. Slomp advising that a road allowance in 17-19-12-4 has been closed off by a ranching company was presented to Council. After discussion, it was moved by Councillor Wells that a letter be sent to the Bar 4T Ranch advising them that, under the Municipal Government Act, this road must be opened to the public. Carried. 5. Provincial Government - Grant Pavments Information was presented to Council in regard to the recent Grant payments received for Municipal Assistance and the Public Transportation Handibus for 1989. Moved by Councillor Fabian that a letter of thanks be sent to the Minister, and M.L.A., in regard to these Grants. Carried. 6. Dinosaur Triathalon - Use of County Roads Letter from the Brooks Dinosaur Triathalon Association requesting use of County roads for the July 22nd Triathalon was presented to Council. Moved by Councillor Wallace that we approve this request subject to the Association assuming all liability for those taking part in the Triathalon. Carried. 7. Broersen Construction Ltd. - Purchase of Dynapac Wheels Letter from Broersen Construction Ltd. requesting the purchase of four surplus Dynapac wheels from the County, was presented. After discussion, it was moved by Councillor Wells that we sell the four wheels to Broersen Construction Ltd. for the sum of $1000.00 each subject to the terms as set out in his letter of May 14, 1989. Carried. 4. Committee Reports Municipal Councillor Bulger gave this report. Board of Education '~~ No report. A.S.B. No report. Brooks Hospital & Nursing Home Councillor Workes gave this report. Hamlet of Patricia - Minutes One item from the Hamlet of Patricia Advisory Committee Minutes was that the County review the price of the County Lots in Patricia with the possibility of reducing these to a more salable price. Moved by Councillor Conners that we move into camera. Carried. Moved by Councillor Nelson that we move out of camera. Carried. Moved by Councillor Conners that we set the selling price on the County Lots at Patricia as follows: ~~ - anyone wishing to purchase a County Lot at Patricia for cash would receive a 50% reduction in the present cost of these ~'" Lots as set by the County. - anyone wishing to purchase a County Lot at Patricia on time payments, as per County Policy, would be permitted to do this over a period of 5 years. Vote on the motion - Carried. 2. Alberta Fish & Wildlife - Aqueduct Fish Pond Request from Alberta Fish & Wildlife to have the County grade the access road into this fish pond was presented. Moved by Councillor Wells that we approve the grading of this access road when the County grader is going past this area, and that it be done two or three times, or as necessary, throughout the year. Carried. 3. Hamlet of Patricia - Operating Costs - C. Morris Information was presented to Council in regard to this matter. After discussion, it was moved by Councillor Nelson that we draw up the necessary Agreement for this purpose and present it back to Council. Carried. 6. Audit Tenders The audit tenders were presented to Council at 11:00 a.m., with seven tenders being received. Moved by Councillor Conners that we move into camera. Carried. Moved by Councillor Wells that we move out of camera. Carried. Page 50 May 25/89 Moved by Councillor Wells that we accept the tender from Young, Parkyn, McNab & Co., of Lethbridge, and that they be appointed as official County auditors for the County of Newell for 1989. Carried. Lunch Council recessed for. lunch from 12:00 - 1:30 p.m. Other Business (Cont'd.) 4. Municipal Handbook Policies The following policies were presented to Council for discussion and approval: Oiled Secondary Roads - Moved by Councillor Wells that we approve this policy as amended. Carried. Dust Control Program - Moved by Councillor Regehr that we approve this policy as amended. Carried. Hamlet Streets - Moved by Councillor Nelson that we approve this policy as amended. Carried. Form A's - Moved by Councillor Regehr that we approve this policy. Carried. Recognition of Service - Moved by Councillor Bulger that we approve this policy. Carried. Snow Plowing - Moved by Councillor Conners that we accept the amended proposals far the Snow Plowing Policy. Vote on the motion - Lost. Moved by Councillor Douglass that we approve the present Snow Plowing Policy as amended. Carried. 7. Post Agenda Items 1. County Signs A sample of a proposed County sign was presented to Council and further costs are to be obtained. 2. Secondary Road 876 - Maintenance A report was given on the contract maintenance of this road. After discussion, it was moved by Councillor Nelson that the Reeve contact Alberta Transportation to discuss this matter further with them. Carried. 3. Alberta Transportation Letter from Alberta Transportation setting out our Regular Road Grant, Dust Control Grant, Engineering Assistance Grant and Public Transportation Grant for 1989 was presented. Moved by Councillor Wallace that a letter of thanks be sent to the Government and the M.L.A. in regard to these Grants. Carried. 4. County of Lethbridge - 25th Anniversar Moved by Councillor Bulger that the County forward congratulations to the County of Lethbridge on their Anniversary. Carried. 8. Adjourn Meeting adjourned at 3:05 p.m. . . r REEVE G~~~~ COUN ADMI STRATOR Page 51 May 25/89 Policy for Sale of Lots in the Hamlet of Patricia ., ~ A motion was passed at the regular Council Meeting of May 25, 1989 regarding the sale of County Lots in the Hamlet of Patricia. Present selling price on Residential Lots $7,100.00 Mobile Home Lots $6,100.00 and as per terms of the Agreement. 1. Anyone wishing to purchase a Lot for cash will receive a 50% discount on the purchase price. All other terms of sale will remain the same. 2. Anyone wishing to purchase a Lot on time payment, may do so subject to Council approval and the following conditions: - Full purchase price - $7,100.00 or $6,100.00 per Lot - Repayment terms of 60 monthly payments with the first payment being made in advance and payable thereafter on the first of each month - Purchaser will be responsible for all taxes and water and sewer costs throughout the term of this Agreement - If any improvements take place on this property, the necessary Development Permits would have to be obtained through the County of Newell Municipal Planning Commission - Title will not be transferred to your name until the full purchase price has been paid out - If the Agreement is not paid out and the purchaser falls in default of payments, any improvements and the Lot will be forfeited and become the property of the County of Newell - The purchaser will be responsible for the legal costs in drawing up the necessary agreements for this purchase THIS AGREEMENT MADE this day of A.D., 19 BETWEEN: (Hereinafter called "the Purchaser") " -and - ~~ THE COUNTY OF NEWELL N0. 4 Box 130, Brooks, Alberta TOJ OJO (Hereinafter called "the County") IN CONSIDERATION of the mutual covenants and agreements hereinafter contained, the parties hereto agree as follows: 1. The Purchaser agrees to purchase, and the County agrees to sell, the property legally described as Lot Block Plan Patricia for the sum of DOLLARS, payable on the signing of this Agreement. 2. The taxes shall be adjusted to the date of this Agreement. 3. The purchase price shall include the cost of installing the present water and sewer line to the .property line. 4. The purchase price does not include installation of gas lines, telephone lines and power lines. 5. The Purchaser shall be responsible for payment of his proportionate share of the water and sewer system operating costs which will be charged as a tax against the said lands. The Purchaser shall be responsible for his own costs of connecting to the water and sewer line at the property line. b. This Agreement is subject to the Purchaser complying with the following conditions: a) The Purchaser shall not move any building onto the said lands without the written consent of the County. b) The Purchaser must take out a Development Permit and complete construction of the building on the said lands. 7. No capital charges for water and sewer will be made on Prairie Street. 8. There will be a charge for Capital Frontage for sewer on Sligo Street. Upon satisfactory completion of this Agreement, Title to this property will be transferred to the Purchaser.
