MUNICIPAL PLANNING COMMISSION MEETING
April 20, 2017
The regular Municipal Planning Commission Meeting of the County of Newell was held in the
County Office at Brooks, AB on Thursday, April 20, 2017 commencing at 10:00 a.m.

3.1 April 6, 2017 Meeting Minutes
MOVED BY COUNCILLOR TRACY FYFE that the minutes of the April 6, 2017
Municipal Planning Commission meeting be adopted as presented.

6. DEVELOPMENT PERMITS
6.1 DP 2017019 - SE 35-18-15 W4M, Addition to existing building with variance to
setback
The Development Clerk provided background information on the proposed application.
The applicant was available to respond to questions from MPC.
Councillor K. Christman asked the Development Clerk what constituted an addition. The
Development Clerk replied that the definition of an addition was any structure that is
attached to a current building. Councillor E. Unruh inquired if the property was on the
proposed truck route. The Manager of Planning & Development responded that the
parcel was west of the truck route. The applicant added that if the proposed truck route
is developed there would be less traffic along RR 15-1 where his property is located.
P-37/17 MOVED BY COUNCILLOR ANNE MARIE PHILIPSEN That the Municipal Planning
Commission APPROVE Development Permit 2017019, for the approval of an existing
1440 ft2 (134 m2) accessory building and the construction of a 9000 ftZ (836 m2) addition
to the accessory building with a variance to the road right of way setback, subject to the
conditions outlined below.
This permit is being granted only to provide approval of an existing 1440 ft2 (134 m2)
accessory building and the construction of a 9000 ft2 (836 m2) addition to the accessory
building with a variance to the road right of way setback, on lands legally described as
SE 35-18-15 W4M. Any additional development shall require prior approval of a
separate permit application.
The proposed development complying with:
a) The provisions pertaining to the Agricultural District and all relevant schedules, as
outlined in the County of Newell Land Use Bylaw #1755-12.
b) All Federal, Provincial and Municipal statutes, regulations, codes and standards.
c) All Alberta Building Codes and Safety Codes, where applicable.
Reasons for Approval
The Municipal Planning Commission has approved DP 2017019 for the following
reasons:
1. The proposed development complies with the Municipal Development Plan.
2. The Development Authority is satisfied that the proposed development is suitable for
the purpose for which it is intended under the Agricultural District (Schedule 2) and
Standards of Development (Schedule 3) as specified in the County of Newell Land
Use Bylaw #1755-12.
3. No objections have been received from adjacent landowners or referral agencies
with respect to the proposed development.
Conditions of Development
a) That this development is located as shown on the site plan approved in this
application and submitted March 22, 2017. Any changes to that plan shall require the
written approval of the Development Officer.
b) That the property is not used for conducting a business or commercial operation
without first obtaining the required permits.
c) That there is a 10 ft (3 m) separation distance between the addition to an existing
building and any other buildings or structures not attached.
d) The developer must start construction before May 9, 2018. In the event that this date
cannot be met, the developer may be required to apply for a new permit.
e) That the following setbacks on all sides are maintained for this development:
Front (east): 60 ft (18 m); variance from 100 ft (30 m)
Side (north and south): 25 ft (7.5 m)
Rear (east): 25 ft (7.5 m)

6.2. DP 2017020 - SE 35-18-15 W4M, Approval for existing dwelling
The Development Clerk provided background information on the proposed application.
There were no questions from MPC.
P-IR/17 MOVED BY COUNCILLOR ELLEN UNRUH That the Municipal Planning Commission
APPROVE Development Permit 2017020, for the approval of an as -built 1675 ft2 (156
m2) single family dwelling with a variance to the road right of way setback, subject to the
conditions outlined below.
This permit is being granted only to provide approval of an as -built 1675 ft2 (156 m2)
single family dwelling with a variance to the road right of way setback, on lands legally
described as SE 35-18-15 W4M. Any additional development shall require prior approval
of a separate permit application.
The proposed development complying with:
a) The provisions pertaining to the Agricultural District and all relevant schedules, as
outlined in the County of Newell Land Use Bylaw #1755-12.
b) All Federal, Provincial and Municipal statutes, regulations, codes and standards.
c) All Alberta Building Codes and Safety Codes, where applicable.
Reasons for Approval

reasons:
1. The proposed development complies with the Municipal Development Plan.
2. The Development Authority is satisfied that the proposed development is suitable for

Use Bylaw #1755-12.

basement
The Development Clerk provided background information on the proposed application.
There were no questions from MPC.
P-39/17 MOVED BY COUNCILLOR TRACY FYFE That the Municipal Planning Commission
APPROVE Development Permit 2017021, for the installation of a 1325 ft' (123 m2)
moved in dwelling, subject to the conditions outlined below.
This permit is being granted only to provide approval for the installation of 1325 ft2 (123
m2) moved in dwelling on lands legally described as Lot 1, Block 8, Plan 1512056. Any
additional development shall require prior approval of a separate permit application.
The proposed development complying with:
a) The provisions pertaining to the Agricultural District and all relevant schedules, as
outlined in the County of Newell Land Use Bylaw #1755-12.
b) All Federal, Provincial and Municipal statutes, regulations, codes and standards.
c) All Alberta Building Codes and Safety Codes, where applicable.
Reasons for Approval
The Municipal Planning Commission has approved DP 2017021 for the following
reasons:
1. The proposed development complies with the Municipal Development Plan.
2. The Development Authority is satisfied that the proposed development is suitable for
the purpose for which it is intended under the Agricultural District (Schedule 2) and
Standards of Development (Schedule 3) as specified in the County of Newell Land
Use Bylaw #1755-12.
3. No objections have been received from adjacent landowners or referral agencies
with respect to the proposed development.
Conditions of Development
a) That this development is located as shown on the site plan approved in this
application and submitted March 30, 2017. Any changes to that plan shall require the
written approval of the Development Officer.
b) That the property is not used for conducting a business or commercial operation
without first obtaining the required permits.
c) That any dwelling/structure is located a minimum distance of 3 m (10 ft) from any
right of way or easement on the parcel.

d) The existing dwelling must be removed upon occupancy of the new dwelling.
e) That the developer submit a $2500.00 security deposit, as the minimum required
amount under Schedule 4 Section 22.4 of the County Land Use Bylaw 1755-12, to
ensure the proper installation of the dwelling. Once the development has passed
inspection by the County Safety Codes Officer (SCO), the security deposit will be
refunded.
f) That any dwelling/structure is located a minimum distance of 100 m (328 ft) from any
gas or oil well site, operating or abandoned, on or adjacent to the property.
g) The developer must start construction before May 9, 2018. In the event that this date
cannot be met, the developer may be required to apply for a new permit.
h) That the following setbacks on all sides are maintained for this development:
Front (east): 100 ft (30 m)
Side (north): 25 ft (7.6 m)
Rear (west): 25 ft (7.6 m)
Side (south): 100 ft (30 m)

10. INFORMATION ITEMS
10.1 Notice of Decision - LA16057, Springside Colony
10.2 Notice of Public Hearing - Bylaw 2017-007
The County Planner provided background information on Vulcan County's Notice of
Public Hearing.
The County Planner indicated that item 3(d) being proposed by Vulcan County has
already been adopted by Lethbridge County. The County Planner suggested that MPC
may want to consider the requirements being adopted in other rural municipalities in
southern Alberta regarding solar facility installations. Councillor C. Amulung inquired if
the issue of the potential use of irrigated land has been addressed by other
municipalities. The County Planner replied that land that has potential for irrigation has
not been discussed. Councillor L. Juss asked if Irrigation Districts have the ability to
remove irrigation from specific lands. The County Planner responded that an Irrigation
District operates under the Irrigation Act and the County may want to discuss this matter
with the Eastern Irrigation District. She commented that with the advancement of
technology, land requirements may change as the solar components become more
efficient.
Mr. B. Bildersheim inquired about the issue of decommissioning. The CAO indicated that
the County struggled with the issue of decommissioning on the County land that is
proposed for a solar facility, but considering the overall revenue, this type of
development assists with the sustainability of the County.
