Minutes of Public Hearing
October 11, 2001
A Public Hearing of the County of Newell No. 4 was held in the County Office at
Brooks, AB on Thursday, October 11, 2001 commencing at 11:03 a.m.

The Reeve opened the Public Hearing at 11:03 a.m.
Jerry Martin, applicant; Ken Lutes, legal counsel for Lakeside Feeders; Garnet
'~ Altwasser, representing Lakeside Industries; Faye Altwasser, resident and Marion
Wells, resident were in attendance at this hearing.
The Administrator stated that the purpose of the Public Hearing was to hear
representations on Bylaw 1366-01 being a bylaw to amend Land Use Bylaw 1004-90
for the purpose of re-zoning Plan 9710617, Block 2 and Plan 9810587, Block 3 within
a portion of the NE 18-19-14-W4 from A -Agricultural District to I -Industrial
District.
The Contract Planner gave background on this application and stated that no objections
to this land use change had been received.
The Reeve advised those present of the procedure that would be followed for the
hearing.
The Reeve asked for representation from the applicant on this proposal.
Jerry Martin, applicant, presented information on this proposed land use amendment.
Council was given the opportunity to ask questions of the applicant.
The Reeve asked if there was anyone else wishing to speak in favour of the bylaw.
There was no one else wishing to speak in favour of the bylaw.
The Reeve asked if there was anyone wishing to speak in opposition to the bylaw.
Ken Lutes, legal counsel for Lakeside Feeders, presented a brief and spoke in
opposition to the proposed land use amendment. He presented information on
Minimum Separation Distances, conflicting land uses and violation of the Code of
Practice.
Garnet Altwasser, representing Lakeside Farms and Lakeside Packers, spoke in
opposition to the proposed land use amendment. Mr. Altwasser spoke regarding the
impact Lakeside may have on any development that may occur, increased traffic at an
intersection where there is already a maj or safety concern and the open ditch that feeds
their dugout going through this property.
Faye Altwasser, resident of the area, spoke in opposition to the proposed amendments.
Her concerns centred on increased traffic, the site vision at the access to her property
and the danger increased traffic would cause at this access site.
Marion Wells, adj acent landowner and resident, spoke in opposition to the amendment.
Her concerns were: increased traffic, dust, safety concerns and quality of life.

Council was given opportunity to ask questions of those in opposition to the proposed
land use amendment.
Council was given the opportunity to ask questions of the Planner.
The applicant was given the opportunity for rebuttal.
Jerry Martin, applicant, stated that what is planned for this area is not incompatible
with what is already there. The potential purchasers are aware of the problems with
~ Lakeside and he doesn't think they will create problems for Lakeside.
The Reeve asked if there were further questions or concerns.
There being no further discussion, it was moved by Councillor Vermeeren that the
Public Hearing adjourn at 11:26 a.m. Carried. _
